The applicant proposes redevelopment of the property consisting of(i)the razing of all existing structures; (ii)the construction of a 167,933 SF industrial building that encompasses the Towns of North Andover(106,321 SF)and Middleton (61,612 SF); (iii)the construction of a new access drive(located in Middleton); (iv)the construction of all associated parking areas, stormwater management structures, shared septic system(located in Middleton), and utility installations; and (v) construction of a 14,303 SF outdoor storage yard (located in Middleton). The Applicant proposes redevelopment of the property into a mixed-use development contained within a single building, rncluding ground floor Commercial space along with two floors of residential units above the first floor. A total of 24 residential units are proposed, along with parking, landscaping, lighting and other improvements to be located on a single lot consisting of approximately 28,559 SF by combining parcels known and numbered as 149 Main Street and 14 Second Street. The property is located within the General Business District and Downtown Overlay District. DISCUSSION ITEMS Potential Zoning Bylaw Amendments: •Floodplain Amy Maxner, Conservation Administrator: Presented proposed amendments to the Floodplain bylaw.National Flood Insurance Act(NFIP)was established in I968 to offer flood disaster relief in the form of insurance; federal govt. program administered by FEMA and available to residents of communities who voluntarily adopt and enforce floodplain management ordinances.NA participates in NFIP and has a Floodplain(overlay)District Bylaw, FEMA reviews community floodplain maps every 5 years; new Essex County maps are effective June 2024.New language is required to be included in local bylaws to maintain NFIP compliance. Draft amendments have been reviewed by our FEMA contact; minor edits noted our current bylaw has the incorrect effective date for the maps.Notable changes include designating a staff position as Floodplain Mgr., establishing a separate Floodplain Permit, identifying sources of information to be used as criteria for compliance; language and definitions to be revised. The proposed amendment has been shared with Town Counsel for her review. E. Goldberg: Inquired how smaller, i.e., small fence permits in the floodplain might be handled with homeowners. Cautioned that we don't want to add too many complexities for homeowners. J. Enright: Envisions this becoming part of the online permitting process, A, Maxner:Not all activities in the floodplain require attention from Conservation. There could be a gradation of permit types; FEMA does not regulate what that looks like. P. Boynton: Base Flood Elevation data is important to homeowners. What are we using for projects in areas lacking data?Does the cost fall on the homeowner to provide that and is it then the responsibility of prospective neighbors to recreate that information each time with an alternate engineer? A, Maxner: There are zones that don't have a base flood elevation assigned to them. This names sources of information the Building Commissioner can refer to in order to establish the ability to regulate the project or improvement(s)triggering review. In areas lacking adequate FEMA data,the private homeowner has engaged an engineer to do the evaluation and calculations to arrive at an elevation based on surrounding properties and other relative topography. J. Enrigllt: Alternatively, there's a process for homeowners trying to alleviate the flood insurance requirement. They Dire an engineer to acquire a Letter of Map Revision to demonstrate they are not in the floodplain. We would share this information with local abutters intending to also file. •Inclusionary Housing Re uirement J. Enriglit: Presented amendments to Part 13 Inclusionary Housing Requirement requested any feedback the Board may have. The results were consistent with the findings at other testing locations in and around the lake. Board requested it would be helpful to homeowners to include this specific location regularly in the summary so that it appears as regular historical data versus just a snapshot. E. Goldberg: When Watershed Special Permit requests are received would it be possible to obtain current data focusing on the area(s)of concern? P. Boynton: We have been discussing the utility of this testing data for this Board which acts as the Special Permit Granting Authority. This would be the best utilization of objective data we have. J. Enright: Will follow-up with the Water Treatment Plant to see if these requests could be addressed. MEETING MINUTES: Approval of the December 20, 2022,Meeting minutes.
