McDonough and Anthony Capachietti Staff Members Present: Amy Maxner, Conservation Administrator Meeting came to Order at. 7:02 p.m. Quorum Present. Pledge of Allegiance Acceptance of Minutes • The minutes for July 27,2022 have not been reviewed. A motion to accept the minutes of September 14, 2022 as drafted is made by Mr. Mabon, seconded by Mr. Hale. • Vote 4-0,Unanimous. Notice of Intent(NOI) 242-1787, 135 North Ramp Road(DeRosa) • The Administrator states a continuance has been requested. • A motion to continue to October 26, 2022,is made by Mr. Mabon, seconded by Mr. Hale. • Vote 4-0,Unanimous. Documents Email from k arr cr�hancackassociates.cam requesting a continuance Request for Determination of Applicability 14-15 Millpond Townhomes (Millpond Homeowners Assoc.) • The Administrator states the proposal includes the reinforcement of a foundation&retaining wall between Units#14 and#15. Work will occur in the outer reaches of the 100-foot Buffer Zone, and within the outer 100-feet of the Riverfront Area. Excavation of the existing patio at Unit#14 will be required to reinforce the retaining wall. Based on site observations,the patio appears to have been disassembled with no impacts to the wetland. The foundation wall in front of Unit#14 will be excavated in sections to keep the rear foundation wall stable during excavation.New reinforcements will be installed, and the wall will be backfilled. Once the work has been completed, all grades, landscaping,patios, etc. will be returned to their pre-existing conditions. The Administrator recommends closing the hearing issuing a Negative Determination#3 with conditions requiring pre and post construction meetings, all imported fill shall be obtained from a responsible source and shall be clean of any trash and debris to avoid introducing the Asiatic Jumping Worm, any exposed soils on slope behind Unit#14 be seeded and stabilized with 100%biodegradable erosion control blanketing, as necessary. • Thomas Schomburg, Civil Design Consultants states all work being conducted will be around the patio area. Dimensions of the retaining wall and patio are provided,no expansion is proposed. • Mr. Lynch requests the soil stockpile location be determined at the preconstruction meeting and contained within the erosion controls. 2022-10-12 Conservation Commission Minutes Page 2 of 4 Approved 0112512023 • Mr.Napoli states all fill must be clean,no RCA is allowed. • Mr. Schomburg acknowledges. • No abutters are present. • A motion to close the hearing and issue Negative Determination#3 with conditions as discussed and recommended is made by Mr. Lynch, seconded by Mr. Mabon. • Vote 4-0, Unanimous. Documents 15-9901 - COM RDA - 092322, RDA Submission Materials, Unit 14, Unit 15 (2) 901 Johnson Street(Fiore) • The Administrator states the proposal includes removal and replacement of an existing brick walkway and steps located at the front of the house. The new walkway will be constructed using stone pavers. A new paver patio with a stone drip edge is proposed just outside of the 50-foot NBZ at the rear of the house within an area of lawn. Work will be conducted using a small excavator. Construction access and stockpile locations are depicted on the plan. The Administrator recommends issuing a Negative Determination#3 with conditions requiring pre and post construction meetings and a dumpster and stockpile area to be placed in the driveway. • Matthew Fiore,the Applicant is present. • No abutters are present. • A motion to close the hearing and issue Negative Determination#3 with conditions as recommended is made by Mr. Mabon, seconded by Mr. Lynch. • Vote 4-0,Unanimous. The existing stonnwater management improvements will be maintained and protected during construction. Erosion controls will be installed in locations where curbing is not present.New striping/traffic controls are proposed within parking and roadway areas. • Mr. Lynch requests the area be swept immediately. He inquired about the age of the paved areas. • Robert Coppola, Edgewood Retirement Community, states about 26-years. • Mr. Mabon expresses concerns that the application may not be appropriate for this type of project. He questions if the Town Engineer has reviewed the project to ensure the appropriate BMPs are being used. • The Administrator states the proposal was not reviewed by the Town Engineer; the area is private. • Ms. Melissa Flynn, SMRT Architects&Engineers states they are not adding additional impervious areas. The work is proposed to be conducted this year; millings will be trucked offsite. • Mr.Napoli states if stockpiling is required Conservation staff must be contacted first. • 7:21p.m. Mr. Manzi enters the room. • Mr. Hale questions if the Administrator has reviewed past permitting for the parcel. • The Administrator states she has not had time to review all of the old permits,however all of the Orders governing the main work have been closed out. She recommends issuing a Negative Determination#3 with conditions. • No abutters are present. • A motion to close the hearing and issue Negative Determination#3 with conditions is made by Mr.Napoli, seconded by Mr. Lynch. • Vote 4-1, (In Favor: Hale,Napoli,Mabon,Lynch,Abstained: Manzi). The Applicant is seeking a Modification to construct a guard shack and associated concrete entrance pad at the north side of the service entrance. The proposed guard shack location is approximately 71-feet from the wetland. Roof runoff will be managed via a stone drip edge,the increased impervious surfaces will be offset by removal of 260-sq ft of pavement. Areas around the guard shack will be loamed and seeded and planted with native species. A list of native plants has been provided. A crushed stone walking path is proposed along the south side of the access driveway. The work is outside the watershed protection zone and does not require Planning Board review. • Anthony Cleaves,Haley Ward Engineering states the utilities shown on the plan are existing,power and communications are the only utilities proposed.New power for the shack is required,he describes how this will be accomplished. Underground work is proposed within the erosion control area,he describes the additional erosion controls proposed. The proposal will result in a reduction of 80-sq ft of pervious area. He provides an update on the work completed thus far. Two conduit pipes were located along the driveway while conducting test pits; they believe these were used for lighting. • Mr.Napoli expresses concerns with the long-term maintenance of a stone walkway. • Mr. Cleaves states the size of stone was chosen for walkability. The grade for the walking path will be lower than the edge of the driveway to prevent issues during snow plowing. They will consider using plastic cells to help contain the stone. • The Administrator recommends approving the Modification as proposed with special conditions requiring pre construction meeting, 12-inch mulch sock and all excavated materials to be immediately containerized. • A motion to approve the Modification as proposed and recommended is made by Mr. Mabon, seconded by Mr. Lynch. • Vote 5-0,Unanimous. A Partial COC was issued for the completed pool work at the time of issuance the restoration plantings had not completed the two-year growing season required. A recent site inspection was performed by our Field Inspector, and the plantings have now achieved 75% survivorship. Wetland markers and posts are present, and the site is well vegetated. • A motion to issue a full and final Certificate of Compliance is made by Mr. Mahon, seconded by Mr. Lynch. • Vote 5-0,Unanimous. Documents 242-1786, 410 Summer Street PCOC, AS-BUILT 410 SUMMER ST, Request for Certificate of Compliance 09 2622 Small Project NACC#298, 137 Lancaster Road (Bunker Building& Remodeling) • The Administrator states the proposal is for the replacement of the existing decking, stair risers, deck trim and rail system for aesthetic reasons. The structural integrity of the framing will be examined once the decking has been removed.No new footings or ground disturbance is proposed. Construction debris will be disposed of in a dumpster placed in the driveway. Documents Deck Photo 09-27-22 Site Visit, Lot 40-Notice of Non-Significance, Small Project Application with Supporting Materials 10 05 22 Enforcement Order/Violation 17 Hepatica Drive(Rogers) • The Administrator provides background on the Enforcement Order heard at a previous meeting. A site visit was performed, and staff confirmed that the patio and retaining wall have been returned to their original footprints. The site is stable, erosion controls removed, and the Enforcement Order can be lifted. • A motion to lift the Enforcement Order is made by Mr. Mabon, seconded by Mr. Lynch. • Vote 5-0,Unanimous. The homeowner has engaged the services of Norse Environmental to delineate the wetlands and prepare a restoration plan. • The Commission discusses the Enforcement Order and whether fines should be assessed. Attendance by the homeowner and consultant is required at the next meeting to review the proposed restoration plan.No additional action will be taken at this time. • A motion to continue to October 26, 2022,is made by Mr. Manzi, seconded by Mr. Mabon. • Vote 5-0,Unanimous.
