Masse,Vice Chairman arrived at the meeting at: 8:16 P. M. Meeting came to Order at: 8:10 P. M. Quorum Present. Pledge of Allegiance Public Hearings: Notice of Intent(s) 242-1420, 880 Great Pond Road (Ercolini)(Andover Consultants, Inc.)(cont. from 2/27/08) Patrick Bower of Andover Consultants, Inc and David Jay of Weinmayr-Jay Associates, Inc was present Mr Napoli stated test pits need to be done in this area because there would be high ground water in this area, also the stonewall can not have open this needs to solid stonewall 2' x 2' height and width no gaps allowed in stonewalls Mr Lynch stated the porous pavement in the wintertime freeze and thaw will cause problems with sheet flow down the driveway with ice forming This house is right within 250-foot no disturbance zone within the Watershed Protection District we must be very precious with this project Ms Feltovic this filing right in the Watershed Protection District and the 0 & M Plan should be very much be established for the perpetuity on this property have to be recorded at the registry of deeds Mr Bower stated there are a lot green building now to save the environment 12 inches water running under the driveway, the bridge was surveyed in 2005 since has been removed down the road they may want to come before Conservation Commission again to put in a new bridge Mr Lynch stated are you removing the telephone pole Mr Bower stated not now the lines would be put under ground Mr Lynch stated telephone company drive truck right up there and cut the pole A motion to continue to March 26, 2008 meeting was made by Mr Masse, seconded by Ms Feltovic Unanimous 242-1421,Dale Street-Map 64, Lot 31(Powderhill Development Cory.)(Marchionda & Associates)(cont. from 2/27/08) No one was present The applicant request to continue to April 23, 2008 meeting Mr Manzi stated he has to re-advertise in the paper and re-notify abutters A motion to continue to April 23, 2008 meeting was made by Ms Feltovic, seconded by Mr Masse Unanimous 1 242-1422, 21 High Street(RCG East Mill LLC)(Epsilon Associates, Inc.) Julie Vondrak of Epsilon Associates, Inc and the applicant David Stembergh of RCG East Mill LLC was present Ms Feltovic read the legal notice The filing is for the expansion and redevelopment of existing parking lots and associated stormwater management structures, construction of new pond outlet structure, intake pipe, associated landscaping activities and associated grading within the Buffer Zone to a Bordering Vegetated Wetland and within Riverfront of Mill Pond Recommendation set up escrow account for third party review of the stormwater management structures Still under review by DEP Mrs Vondrak stated this is mixed-use project parking areas 51 parking, 6-dention ponds stormwater high street drainage weir structure western part has had flooding thru the mill area the water overtops the pond area There is a 60-inch pipe to Osgood Pond There would be mitigation water elevation hydropower historically used for Davidson & Furber there would be 1.8,000 s f under the lower pond 520 s f with the earthen berm There is waiver for the work within the 25-foot No-Disturbance zone, planting plan new vegetation would have monitored for 2 years Mr Lynch stated the proposed hydropower the applicant would have watch for downstream flooding may cause more flooding High Street the applicant should increase the size of the pipe into Osgood Street Pond A motion to set escrow amount of$5,000 for third party review stormwater management structures was made by Mr Lynch, seconded by Mr Masse Unanimous A motion to continue to March 26, 2008 meeting was made by Ms Feltovic, seconded by Mr Masse Unanimous 242-1423,281 Blue Ridge Road (Skowronek)(New England Engineering Services, Inc.) The applicant Mr & Mrs Skowronek and Ben Osgood, Jr , of New England Engineering Services, Inc was present Ms Feltovic read the legal notice The filing is for the construction of an in-ground pool, patio, fence and associated grading within the Buffer Zone to a Bordering Vegetated Wetland Still under review by DEP Mr Lynch stated you need to demark the wall you are removing on the revised plans Mr Manzi stated the contractor could remove the wrong wall we need revised showing the correct wall that would be removed A motion to continue to March 26, 2008 meeting for revised plans was made by Mr Masse, seconded by Mr Lynch Unanimous Discussion of Some Items: Mr Manzi stated that Gene Willis, Town Engineer for Department of public works set-up subcommittee for helping, Gene Willis with some work Department of public works wants to do maintenance within Conservation Commission jurisdictional areas in the Town of North Andover Mr Manzi named Joseph Lynch, Jr , and Louis Napoli to become the Conservation Commission Members to help Gene Willis get some of the work that needs to be done within the Town of North Andover without filing with the Conservation Commission The article is what is proposed for 2008 ATM. Please send me any recommendations. Article V. Amend Vote Article 42-1997 Annual Town Meeting Removal of Development Restrictions on Map 62, Parcels 18, 9, and 64. To see if the Town will vote to amend Article 42 Conservation Restriction—Town Farm approved at the May 13, 1997 Annual Town Meeting to allow construction of athletic fields on Assessors Map #64, Parcels 9, 18, 20, & 64 and if necessary to effect this change, to authorize the Board of Selectman to petition the 2 General Court of the Commonwealth of Massachusetts for appropriate legislative relief, or take any other action relative thereto Mr Manzi stated the Conservation Commission would not give up the whole open space on these parcels just what the Soccer Association needs for fields There is 150 acres out here we will only allow these parcels only Article X. Amend North Andover General Bylaw, New Chapter, Chapter 160, Stormwater Management& Erosion Control Bylaw. To see if the Town will vote to amend the Town of North Andover General Bylaws by adding a new Chapter Chapter 160, Stormwater Management & Erosion Control Bylaw Mr Bellavance stated the Federal Government wants this done by May 1, 2008 a subcommittee would include Mr Bellavance of Community Development Director, Planning Board, Conservation Commission, Eugene Willis, Town Engineer, of Department of Public Works and Town Manger Mark Rees Next meeting would be scheduled on March 21, 2008 A motion to adjourn the meeting at: 9:40 P.
