HomeMy WebLinkAbout2008-03-26 Conservation Commission Minutes Conservation Commission Meeting Minutes March 26,2008 Members Present: Albert P Manzi, Jr, Chairman, Joseph W Lynch, Jr , Deborah A Feltovic, Sean F McDonough, Louis A Napoli Members Absent: Scott L Masse, Vice Chairman, John J Mabon Staff Members Present: Donna M Wedge, Conservation Secretary, Mark West of West Environmental, Inc and Curt Bellavance Community Development Director Sean F. McDonough arrived at the meeting at: 8:10 P. M. Meeting came to Order at: 7:16 P. M. Quorum Present. Pledge of Allegiance General Business Discussion: May 14,2008, Conservation Commission meeting cannot have the meeting because of Annual Town Meeting. The Conservation Commission discussed the meeting and decided not have back to back meetings they would have one meeting in May of 2008, May 28, 2008 meeting only Mr Manzi stated make sure we do not close any hearings because of the 21-day requirement 242-1245, COC Request, Gray Street Waterline Extension (The Litchfield Company, Inc.)(Eastern Land Survey Associates,Inc.)(cont. from 1/9/08) James H MacDowell of Eastern Land Survey Associates, Inc was present Mr West stated the Order of Conditions was issued on May of 2004 for the installation of 8-inch water main line with associated services and pavement path in the buffer zone to a bordering vegetated wetland Monitoring reports were in the file as required The site is totally stable with no erosion there is some silt fence out there and haybales they should be removed There are no catch basins on the roadway were the work was preformed Mr MacDowell stated Gary would go out to remove the erosion controls A motion to issue the COC and release the bond hold till the erosion controls are removed was made by Ms Feltovic, seconded by Mr Napoli Unanimous 242-634,PCOC Request& Modification, 66 Colonial Avenue (Segal)(New England Engineering Services, Inc.) Ben Osgood, Jr, of New England Engineering Services, Inc was present Mr West stated the modifications are quite intense, septic system, driveway pavement, decks ect A motion to continue to April 9, 2008 meeting for review with the Engineer was made by Mr Napoli, seconded by Ms Feltovic Unanimous 242-1302, Extension Request 430 Pleasant Street(Carlson)(The Neve-Morin Group, Inc.) Greg Hochmuth of The Neve-Morin Group Inc was present The Order of Conditions was issued May of 2005 for the construction of 2 additions, a deck and several fieldstone retaining walls and 1 installation of three concrete pads associated with AC units, a foundation drain, and associated grading and landscaping activities within the Buffer Zone to a Bordering Vegetated Wetland associated with Stevens Pond The work also includes restoration activities with the 25-foot No- Disturbance zone The construction of the garage will be outside of the Buffer Zone A motion to issue one-year extension to May 3, 2009 was made by Mr Lynch, seconded by Ms Feltovic Unanimous 242-1279,Extension Reguest, 189 Willow Street (Lot 4)(Chatteriee)(Joseph D. LaGrasse & Associates,Inc.) No one was present The Order of Conditions was issued May of 2005 for the construction of a 7,200 s f two story office building with associated grading, parking, utilities, and stormwater water management systems within the Buffer Zone to a Bordering Vegetated (for access purposes) and associated buffer zones Proposed work also includes a 609 s f of wetland replication area(2 1 mitigation as required in the Wetlands Bylaw regulations) The applicant is requesting a one-year extension to May 4, 2009 Mr West stated site inspected the lot was recently cutting of trees, erosion controls in place, incorrect DEP file number posted Request corrections and installation of stone check dam in the ditch A motion to issue an Enforcement Order cease and desist immediately was made by Ms Feltovic, seconded by Mr Lynch Unanimous The extension requested tabled for now with outcome of Enforcement Order 242-1298,Request for Extension,315 South Bradford Street(Smolak) No one was present Mr West stated the pond in place and, Blueberries fields planted Request silt fence be removed, in the spring Smolak Farms wants make sure the water level for irrigation would be enough A motion to issue one-year extension to May 4, 2009 was made by Mr Lynch, seconded by Ms Feltovic Unanimous 242-1247, COC Request, Greene Street,Kenwood Street,Maas Ave.(Capital Group Properties)(Seekamp Environmental Consulting) Patrick Seekamp of Seekamp Environmental Consulting was present Mr Seekamp stated the oil & grease catch basins have been installed and a letter went out last September the Conservation Commission knows there was a lot of erosion on the site Mr West I did not do site walk of the site A motion to continue to April 9, 2008 meeting was made by Ms Feltovic, seconded Mr Lynch Unanimous 242-1344, COC Request, 56 Saville Street(Lot 2)(Highview LLC)(Northstar Land Survey Services The applicant Robert K Ahern of Highview LLC was present Mr West no issues the site is stable no erosion site looks great A motion to issue the COC and release the bond was made by Mr Lynch, seconded by Mr Napoli Unanimous 242-1230, COC Request, 60 Saville Street(Lot 3)(Saville Development)(Northstar Land Survey Services) The applicant Robert K Ahern of RKACO LLC was present Mr West stated no issues on the site, no sign of any erosion, and site totally stabilized looks very good A motion to issue the COC and release the bond was made by Mr Lynch, seconded by Ms Feltovic Unanimous 2 f 242-1229, COC Request, 66 Saville Street(Lot 4) (JRM Development)(Northstar Land Survey Services) The applicant Robert K Ahern of RKACO LLC was present Mr West stated the site very stable no issues and no erosion on the site at all, site looks very good A motion to issue the COC and release the bond was made by Mr Lynch, seconded by Ms Feltovic Unanimous 242-1135, COC Request, 71 Saville Street(Lot B)(RKACO LLC)(Northstar Land Survey Services The applicant Robert K Ahern of RKACO LLC was present Mr West stated the play area and, swing set area laying on gravel but this play area is not shown on the as-built plan The Conservation Commission stated to the applicant you must have your surveyor show the swing set on the as-built plan A motion to continue to April 9, 2008 meeting for revised as-built plans was made by Ms Feltovic, seconded by Mr Lynch Unanimous 242-1136, 65 Saville Street (Lot A)(RKACO LLC)(Northstar Land Survey Services) The applicant Robert K Ahern of RKACO LLC was present Mr West stated there is large pile soil 6 ft to 7 ft high that needs to be removed and shed which is not shown on the as-built plan A motion to continue to April 9, 2008 meeting for revised as-built plans was made by Ms Feltovic, seconded by Mr Napoli Unanimous 242-1288, 50 Saville Street (Lot 31)(RKACO LLC)(Northstar Land Survey Services) The applicant Robert K Ahern of RKACO LLC was present Mr West stated the site very stable no sign of any erosion, site looks very good and very large walls on this site no issues A motion to issue the COC and release the bond was made by Ms Feltovic, seconded by Mr Napoli Unanimous No Recess Public Hearings at: 8:35 P. M. 242-1401,Lot 2 Forest Street (Plisinski)(Professional Land Services, Inc.)(cont. from 2/27/08) The applicant Mr Paul Plismski was present Mr West stated corridor under the settlement the plan has changed with more use of the land because Natural Heritage does not direct the applicant what to really do but they approve the pool,patio, deck and fence because they want the critters to be able to move back and forth thru out the site The new plan presented the pool, patio, deck area all outside of 50-foot No-Build zone and outside of 25-foot No-Disturbance zone some minor grading within the 50-foot No-build zone that is the whole scope of the work Mr Plxsmski I am struck between wall and hard rock right now Mr Manzi stated the Mr Urbelis the Conservation Commission can accept this or not accept this would amendment to Order of Conditions because the scope of work has changed the applicant has done the right thing going thru dealing with Natural Heritage Mr McDonough stated the inground pool, patio, deck was not within the settlement agreement with the Town of North Andover Mr Manzi polled the Conservation Commission vote 4 to 1 Mr Lynch stated have Town Counsel check on if we can accept more usage of the land than was approved by the settlement with the Town of 3 North Andover A motion to continue to April 23, 2008 meeting was made by Mr Lynch, seconded by Ms Feltovic Unanimous 242-1422, 21 High Street, (RCG East Mill LLC)(Epsilon Associates, Inc.)(cont. from 3/12/08)(Reguest to cant to 4/9/08) No one was present Mr West stated the applicant request to a continuance to April 9, 2008 meeting for further review on stormwater management structures A motion to continue to April 9, 2008 meeting was made by Mr Lynch, seconded by Ms Feltovic Unanimous 242-1420,880 Great Pond Road (Ercolini)(Andover Consultants,Inc.)(cont. from 3/12/08) Patrick Bower of Andover Consultants, Inc, was present Mr West stated the plan revised to address drainage issues in the Watershed Protection District The review to determine if plan revisions have addressed drainage issues, O nutrient load, and stone wall cross section Mr Bower stated the applicant hired Steve Erickson of Norse Environmental Services, Inc to review fertilizer and pesticide usage within the Watershed District, 13%to 10%reduction of nutrients, calculation of soil testing was done water table 2-feet to 3-feet Mr West stated there earthen berm there trying to figure out where the boundary of Lake Cochichewick is on this property if you go by the plan you would be walking within the Lake Mr Lynch stated the pavers on the driveway would be problem in the winter with freezing an thawing I do not think they would last one year They have to figure out how hold back the sheet flow from the driveway even frozen lawn would cause sheet flow no penetration when frozen A motion to continue to April 9, 2008 meeting was made by Mr McDonough, seconded Ms Feltovic Unanimous 242- , 281 Blueridge Road(Skowronek)(New England Engineering Services, Inc.)(cont. from 3/12/08) Ben Osgood, Jr , of New England Engineering Services, Inc was present Mr West stated the stonewall properly identified on the revised plans I know there is no DEP yet on this filing A motion to continue to April 9, 2008 meeting was made by Mr Lynch, seconded by Ms Feltovic Unanimous A motion to adjourn the meeting at: 9:30 P.
