M. Quorum Present. Scott Masse, Vice Chairman arrived at the meeting: 8:00 P. M. Pledge of Allegiance General Business 242-1362, COC Request, Winter Street, Foster Street, Lost Pond Lane(Mosquito Brook Drainage Improvement(DPM(VVHB) The applicant Eugene Willis Town Engineer of the Department of Public Works was present Mr West stated the site was stable all set no issues A motion to issue the COC and release the bond was made by Mr Mabon, seconded by Ms Feltovic Unanimous Article 32 Ratification Town Farm (Recreation Fields) Conservation Commission approved the Open Space parcels to recreation fields was made by Ms Feltovic, seconded by Mr Napoli Unanimous 242-1347,Update of VMP, 492 Sutton Street(Lawrence Municipal Airport)(Stantec Consulting Services, Inc.) The applicant Mr Michael Miller Manager of Lawrence Municipal Airport and Randall P Christensen of Stantec Consulting Services, Inc and Robert Dunn of Stantec Consulting Services, Inc was present Mr Napoli an abutter left the room Mr Christensen stated baseline data photo documentation growth of invasive plant trying to control from taking over areas There is punch list seeding, take care of invasive plantings and control so the planting would take over the area Mr Manzi stated we just wanted know how far you got with the Vegetated Management Plan Mr Napoli returned to the meeting 242-1135, 71 Saville Street (Lot B)(RKACO LLC)(Northstar Land Survey Services)(cont. from 4/9/08) The applicant Robert Ahern of RKACO LLC was present Mr West stated the site is stable with no issue the dirt pile has been removed A motion to issue the COC and release the bond was made by Ms Feltovic, seconded by Mr Mabon 4 to 1 vote Mr McDonough abstained from voting 1 242-1136, COC Request 65 Saville Street (Lot A)(RKACO LLC)(Northstar Land Survey Services)(cont form 4/9/08) The applicant Robert Ahern of RKACO LLC was present Mr West stated the site is stable with no issues the dirt piles have been removed A motion to issue the COC and release the bond was made by Ms Feltovic, seconded by Mr Mabon 4 to 1 vote Mr McDonough abstained from voting 242-1139, COC Request, 25 Sunset Rock Road (Lotl8)(Fieramosca)(Giles Survey) No one was present Mr West stated all set site stable A motion to issue the COC was made by Ms Feltovic, seconded by Mr Mabon 4 to 1 vote Mr McDonough abstained from voting 242-1399,_Modification Request,Berry Street(Stack)(Christiansen & Sergi, Inc.) The applicant Mr Kevin Stack and Phil Christiansen of Christiansen& Sergi, Inc was present Mr West states the site is historically disturbed wetland marginal and wetter portion is in the 50- foot No-Build zone The modification does not significantly change original permitted encroachment into buffer zone Mr Christiansen stated the well would 12-feet from the house There needs to be access for wheel chair because disabled veteran Mr Mabon I would like to continue this to next meeting so I can do site visit to the property A motion to continue to June 11, 2008 meeting for further review of the property was made by Mr Mabon, seconded by Ms Feltovic 3-0-1 vote 242-425, COC Request, 721 Middleton Street (Lot AA)(Turner)(JJB Associates, Inc.) No one was present Mr West states old project site stable all set no issue A motion to issue the COC was made by Mr Napoli, seconded by Ms Feltovic 3-0-1 vote 242-1388, COC Request, 93 Raleigh Tavern Lane(Foulds)(New England Engineering Services, Inc.) Ben Osgood, Jr , of New England Engineering Services, Inc was present Mr West states site is stable all set no issue A motion to issue the COC and release the bond was made by Mr Napoli, seconded by Ms Feltovic Unanimous 242-1403, COC Request,22 Woodlea Road (Garcia)(New England Engineering Services, Inc. Ben Osgood, Jr , of New England Engineering Services, Inc was present Mr West states site is stable all set no issue A motion to issue the COC and release the bond was made by Mr Napoli, seconded by Ms Feltovic Unanimous Enforcement Order Ratification Friends of North Andover Trails (Annual Vegetated Management Plan) Mr Mabon stated they have to revise the maps so I request this be continued to June 11, 2008 meeting 2 No Recess Public Hearings: 8:20 P. M. Notice of Intent (s) 242-1401, Forest Street (Lot 2)(Plisinski)(Professional Land Services,Inc.)(cont. from 3/26/08) Thomas J Urbelis Town Counsel was present Mrs Wedge states the Conservation Commission agreed to accept the natural heritage plan was presented on March 26, 2008 4 to 1 vote Mr McDonough did not agree because the mground pool was out side scope of the settlement with the Conservation Commission Mr Urbelis stated you should just give him his Order of Conditions I heard the Zoning Board of Appeals relief they gave to Mr Plismski might be appealed by an abutter with the Zoning Board of Appeals decision A motion to close and issue a decision within 21 days was made by Mr Masse, seconded by Ms Feltovic Unanimous 242-1428, Lot 4N-A Turnpike Street(Merrimack Condominiums)(One Hundred Fourteen Trust)(Patrick C. Garner of Garner Company,Inc.) The Applicant Peter Hingoram and Donald F Borenstem, Esq , of Johnson& Borenstem, LLC and Patrick C Garner of Garner Company Inc was present Ms Feltovic read the legal notice Mr West states the GRAD included certification of two vernal pools in southwest portion of the site The applicant included Natural Heritage sign off Make in information on wildlife habitat data provided to Natural Heritage would be helpful Set up escrow account for third party review stormwater management structures Abutters Present Mr Hagetty Mr Garner stated the drainage would not be changed when there was a filing for the Office Building, which was reviewed Mr Hagetty stated retaining walls 65% would be cedar wood fence there should soil testing done in this area A motion to set up outside account for third party review stormwater management structures for the review by Lisa Eggleston was made by Mr Masse, seconded by Ms Feltovic Unanimous A motion to set escrow account in the amount of$5,000 for outside review was made by Mr Masse, seconded by Ms Feltovic Unanimous A motion to continue to June 11, 2008 meeting was made by Mr Masse, seconded by Ms Feltovic Unanimous 242-1429, 673 Great Pond Road, (ICB Realty Trust)(Wetland Preservation Inc.) Curt Young of Wetland Preservation, Inc and Abutter Lawrence T Curran of 30 Brentwood Circle was present Ms Feltovic read the legal notice Mr West states the project includes landscaping installation of stonewalls and plantings No comments from DEP Mr Young stated restore an existing wall, installations of plantings, evergreens, and shrubs, relocations of some of the trees, reset a wall by the driveway Mr Napoli states the elevation on the lower part of the property no change in the slope Mr Young states no change within the slope Mr Young states the removal of a wall because it is 10 years old A motion to close and issue a decision within 21 days was made by Mr Masse, seconded by Ms Feltovic Unanimous 3 242-1430, 859 Winter Street(Armstrong)(Arrow Environmental LLC)(Giles Survey) The applicant Elizabeth A Armstrong was present Mr West states wetland delineation all set The 12-inch pipe inlet should be shown on the plan and maintained under new driveway to carriage house to maintain hydrology of the wetland Still under review by DEP A motion to continue to June 11, 2008 meeting for revised plans was made by Mr Masse, seconded by Ms Feltovic Unanimous Decision 242-1422,21 High Street(RCG East Mill LLC)(Epsilon Associates, Inc.) Mr West has draft decision ready A motion to accept the Order of Conditions as drafted was made by Mr Masse, seconded by Ms Feltovic Unanimous A motion to adjourn the meeting at: 9:15 P.
