M. Quorum Present. Pledge of Allegiance General Business 242-784, PCOC Request, Roadways at Abbott Village Estates (North Andover Land Corp.) (Hayes Engineering,Ine.)(Request to cont. to 10/8/08) No one was present A motion to continue to October 8, 2008 meeting was made by Ms Feltovic, seconded by Mr Lynch Unanimous 242-1319,502 Winter Street (Lot 3A)(Kindred)(Marchionda & Associates,L. P.) No one was present A motion to issue the one-year extension was made by Ms Feltovic, seconded by Mr McDonough Unanimous 242-1382, Modification Request, 1820-1830 Turnpike Street (GFM General Contracting)(Eastern Land Survey Associates, Inc.) No one was present A motion to continue to October 8, 2008 meeting was made by Ms Feltovic, seconded by Mr McDonough Unanimous NACC#39, COC Request, 100 Vest Way (Stone)(New England Engineering Services, Inc.) No one was present Ms Hughes states Order of Conditions was for replacement of a septic system Ms Hughes inspected the site several times and allowed some erosion control to be removed The site is stable with a few unvegetated patches but no-erosion problems A motion to issue the COC and release the bond was made by Ms Feltovic, seconded by Mr Lynch Unanimous 242-1345, COC Request, 1915 Great Pond Road (Pelich)(New England Engineering Services Inc.) No one was present A motion to continue to October 8, 2008 meeting was made by Ms Feltovic, seconded by Mr Lynch Unanimous Small Project NACC#45, 125 Colonial Ave. (Towler) The applicant Christopher Towler was present Ms Hughes states the applicant received a Negative Determination in 2006 for the construction of an addition and deck and stair modification The stairs were not installed as proposed but were inspected and approved by a previous agent Mr Towler states the proposed project enclose the sono tubes, pour cement pad under the existing addition, and install three walls and two doors for access The storage area size would be 256 s f or 16xl6' Ms Hughes states the Determination required submittal of an as- built plan but she did not recall a similar requirement on other Determinations issued by the NACC The Commission discussed the need for an as-built and determined the applicant should submit a hand drawn as-built using the proposed survey plan submitted with his RDA in 2006 Mr McDonough acknowledged the applicant's ongoing compliance with the wetland setbacks on his property Mr Lynch states this project should be a Small Project 4 4 2 J Mr McDonough adds a condition for no washings of concrete trucks or disposal of surplus concrete, on site Truck washing water shall not be directed to, any drainage system, or wetland resource area Concrete trucks shall be washed off site A motion to accept as a small project as 4 4 2 J was made by Mr McDonough, seconded by Ms Feltovic Unanimous A motion to require conditions pre-construction and post construction was made by Ms Feltovic, seconded by Mr Lynch Unanimous No recess Public Hearings: 8:01 P. Request for Determination of Applicability 81 Peachtree Lane (Jones)(Brouillard) The applicant Dillan Jones and Kevin M Brouillard, of Brouillard Finish Carpentry & Remodeling were present Mr McDonough read the legal notice Mr Lynch asks if proposed fence would be installed above stone wall and Mr Brouillard responded that it would The concrete patio proposed in the application has already been constructed and concrete castings were dumped at the back of the lot Mr Brouillard states the fence would in front of the wall the project is approximately 65-feet away from resource area,the patio is approximately 56-feet from resource areas Mr Lynch stated the castings previously deposited in the northeast corner of the lot should be removed and properly disposed of off site A motion to issue a#3 negative determination was made by Ms Feltovic, seconded by Mr Lynch Unanimous Notice of Intent (s) 242-14401430 Great Pond Road (Muldoon)(Merrimack Engineering Services, Inc.) The applicant Mr Gary Muldoon and Leah Basbanes of Basbanes Associates were present Ms Basbanes states the replication area would be 1,100 s f Mr Muldoon states the rain barrel proposal was accepted by the Conservation Commission at the last meeting on September 10, 2008 Mr Lynch states rain barrels were approved and proposal to remove deck and construct a three season room is complete A motion to close and issue a decision within 21 days was made by Mr McDonough, seconded by Mr Lynch Unanimous 2 242-1439, 60 Willow Street (Rohm & Haas Electronic Materials)(BSC Group, Inc.)(cont. from 9/10/08)(Reguest to cant. to 10/22/08) No one was present Ms Hughes states the Planning Board has approved this project A motion to continue to October 22, 2008 meeting was made by Ms Feltovic, seconded by Mr Lynch Unanimous 242- ,350 Winthrop Avenue (Exxon/Mobil Oil Corporation)(Groundwater& Environmental Services, Inc.) The applicant Elizabeth Zinkevic, Ryan F Carroll of Groundwater & Environmental Services, Inc, and Marty Hilfinger of Groundwater& Environmental Services, Inc were present Mr McDonough read the legal notice Mr Carroll states this project is for removal of impacted soils on the site and gives a brief history of the contamination and its monitoring The soils would be stored on site for no more than two days then would be removed off site by a hazardous waste disposal company The applicant has also filed with DEP for the hazardous waste removal Mr Lynch states the site is within the floodplam of the Shawsheen River and that sites in this area have been flooded many times The applicant confirmed the remediation area is not within floodplam Mr Lynch expresses concern for the contaminated soil pile being exposed during a heavy rainstorm There are monitoring wells on site Mr McDonough states his concerns for storage of contaminated soils on site Ms Feltovic states that 675 lbs of contaminated soil should be held on the site no more then 10 days Mr McDonough states that high ground water on the site might require dewatering and should be supervised by the Erosion Control monitor with reports sent to the Conservation Department Mr Lynch states this site should have a dewatering plan, the riprap swale on the riverbank should be cleared of debris and trash, and that there be a requirement for yearly reports to the Conservation Department of annual maintenance of the storm water management system and that they be mailed to Conservation Department in perpetuity The commission will require no discharge of frac tank water on the site A proposal to remove a wastewater storage tank associated with the garage bays was added to the plan There was a discussion of the need for floor drains Ms Hughes will seek advice from the plumbing inspector A motion to continue to October 8, 2008 meeting was made by Ms Feltovic, seconded by Mr Lynch Unanimous Decision 242-1440, 1430 Great Pond Road Ms Hughes reviews the special conditions and commission signs the order as drafted Filing fee Appropriation MVPC Regional Resource Center, Inc -Scope of Services Municipal Information Mapping Access Program (MIMAP) Ms Hughes requests a filing fee appropriation for MIMAP program and explains its benefits to the Conservation Department and Town of North Andover Mr Lynch recommends due to program's ability to interact with.North Andover's permit tracking software The Planning Department is asking the Conservation Commission to contribute $500 toward the cost and views this as another step toward a GIS program Training at Northern Essex Community 3 College is included in the fee The training session will be open to up to 20 Town officials and will cover the operation of all aspects of North Andover's MIMAP A motion to appropriate $500 out of filing fee account for MIMAP was made by Mr Lynch, seconded by Ms Feltovic Unanimous Discussion 100 Willow Street The NACC discusses Jurisdiction over work performed without a building permit at 100 Willow Street 400 Willow Street Ms Hughes requests clarification on deadline for work to repair detention basin on site Commission requires detention basin work to be conducted this fall A motion to adjourn the meeting at: 9:15 P.
