M. Meeting came to Order at: 7:15 P. M. Quorum Present. Pledge of Allegiance General Business 242-784, PCOC Request,Roadways at Abbott Village Estates (North Andover Land Corp.)(Hayes Engineering, Inc.) No one was present for the applicant The applicant is requesting a continuance to the December 3, 2008 meeting A motion to continue to the December 3, 2008 meeting was made by Ms Feltovic, seconded by Mr Napoli Unanimous 242-1345, Modification & COC Request 1915 Great Pond Road (Lot 1)(Pelich)(New England Engineering Services, Inc.) Request to cont. to 12/3/08) No one was present for the applicant The applicant is requesting a continuance to the December 3, 2008 meeting A motion to continue to the December 3, 2008 was made by Ms Feltovic, seconded by Mr Napoli Unanimous 242-1382, Modification Request, 1820-1830 Turnpike Street (GFM General Contracting)(Eastern Land Survey Associates, Inc.)(Request to cont. to 11/19/08) No one was present for the applicant The applicant is requesting a continuance to the November 19, 2008 meeting A motion to continue to the November 19, 2008 meeting was made by Ms Feltovic, seconded by Mr Napoli Unanimous 242-265, PCOC Request, 46 Wintergreen Drive (Lot 20)(Albert)(Christiansen & Sergi, Inc.) No one was present for the applicant Ms Hughes states the filing was for the roadway, utilities and drainage for the subdivision There are no wetlands on this lot or within 100-feet A motion to issue the PCOC was made by Ms Feltovic, seconded by Mr Napoli Unanimous I 242-1250, COC Request,Adams Avenue(DPW)(Westin & Sampson Engineers, Inc.) Ms Hughes presented the COC request for the Town of North Andover DPW Ms Hughes inspected the drainage improvements on Adams Avenue with Gene Willis and confirms they are constructed as proposed The blueberry bushes on the bank are disturbed by foot traffic Mr Napoli asks if Autran Avenue is part of this filing Ms Hughes responds it will be a separate filing A motion to issue the COC was made by Ms Feltovic, seconded by Mr Napoli Unanimous 242-1341, COC Request, 2 Blueberry Hill Lane ffurlong)(LeBlanc Survey Associates,Inc.) The applicant Stacey Furlong and William Attrachi were present Ms Hughes states the restoration area is undisturbed and the plantings have been monitored for 2 years Several of the blueberry bushes were not thriving and the applicant planted two red maples at Ms Hughes' request The wetland markers were also moved from temporary stakes onto mature trees and one post A motion to issue the COC was made by Mr Lynch, seconded by Ms Feltovic Unanimous 242-1367, COC Request, 31 Court Street (Castricone)(Giles Surveying) No one was present for the applicant Ms Hughes states project in compliance but wetland markers are on wire stakes (not permanent) The NACC discusses the history of the project Mr Lynch recommends markers are placed on two pressure treated lumber posts at either end of the restored buffer zone Markers should be field located by the Conservation Administrator A motion to issue the COC and release the bond was made by Mr Lynch, seconded by Ms Feltovic COC should not issue until markers are in place Unanimous 242-1396,COC Request,350 Holt Road (Crusader Paper)(New England Engineering Services, Inc.) No one was present for the applicant Ms Hughes states only a small corner of the project was in jurisdiction(R.iverfront) Ms Hughes noted on a site inspection that grass was only recently planted and was not yet established Mr Lynch stated lack of stabilization in detention area could result in silty water getting to the resource area Ms Feltovic agreed Mr Lynch stated a partial bond release was possible but not a COC Mr McDonough stated the growing season is over and stabilization not likely this year A motion to continue to November 19, 2008 meeting was made by Ms Feltovic, seconded by Mr Lynch Unanimous 242-1435, COC Request, 69 Oakes Drive(Weiting)(New England Engineering Services, Inc. No one was present for the applicant Ms Hughes states a grass Swale was constructed as proposed along the rear property and is sloped to carry water away from abutters Mr Lynch confirmed that site is stabilized Ms Hughes noted slight discrepancies in the septic system location. All parts of the system are outside of 50-foot No-Build zone There is discussion about inspections done by Board of Health Mr Mabon states the Health Department would likely be stricter than NACC in system inspections A motion to issue the COC and release the bond was made by Ms Feltovic, seconded by Mr Napoli Unanimous Mr McDonough requests Ms Hughes discuss the types of inspections conducted by BOH to determine if system location is confirmed with measurements 2 No Recess Public Hearings: 8:00 P. M. Abbreviated Notice of Resource Area Delineation & Modification Request 242-1444, 575 Osgood Street (Edgewood Retirement Community,Inc.)(Christiansen & Sergi, Inc.) Anthony Capachietti of Christiansen& Sergi, Inc , David M Mermelstein of Trident Project Advantage Group, and Kevin Tremblay Director of Development and Construction were present for the applicant and Chris Ward of the Trustees of Reservation was present as an abutter Ms Feltovic read the legal notice Ms Hughes describes the resource area and confirms the wetland line is correct as depicted in the ANRAD Mr Capachietti states the open field is hayed twice per year The modification is to fence the horse paddock and remove invasive plants along the stonewall at Osgood Street A new stone wall would be added at the entrance to Edgewood Drive within the 25-foot No-Disturbance zone A post and rail fencing would be installed behind the stone walls also within the 25-foot No-Disturbance zone A motion to issue the ORAD was made by Mr McDonough, seconded by Ms Feltovic Unanimous 242-1398, Modification Request, 575 Osgood Street (Edgewood Retirement Community, Inc.)(Christiansen & Sergi, Inc. Anthony Capachietti of Christiansen & Sergi, Inc , David M Mermelstein of Trident Project Advantage Group, and Kevin Tremblay Director of Development and Construction were present Mr Capachietti presents additional modifications including a parking lot change and a utility pole removal plan Mr Capachietti states the parking lot modification would result in 2,000 s f less impervious area The pole removal is necessary as utilities have been installed underground Mr Lynch states requests the pond outlet be protected during removal of phragmites and that erosion control be shown for the remainder of the work Mr Lynch questions if the paddock will continue to be used Mr Lynch questions the applicant about stormwater changes related to the parking lot modification Mr Lynch requests documentation of TSS removal and need for a sediment forebay/forebay extension Mr Capachietti states the catch basin will be replaced with a Stormceptor Mr Mabon requests a more detailed description of the landscaping work and a construction sequence for the phragmite removal Mr McDonough discusses the location of the stone wall and fencing Mr Lynch confirms need for waiver request Ms Feltovic questions the effects of the wall on wildlife movement None anticipated Mr Mabon summarizes additional information needed including the number of utility poles to be removed and submission of a waiver request for fencing and stone walls A motion to continue to November 19, 2008 meeting was made by Ms Feltovic, seconded by Mr Napoli Unanimous Notice of Intent (s) 242-1443,,Berry Street (Lot 5)(Brooks)(Merrimack Engineering Services,Inc.)(cont. from 10/22/08) The applicant Nathan Brooks and William Dufresne of Merrimack Engineering Services, Inc were present Ms Feltovic read the legal notice Mr Dufresne presents the project Mr Dufresne states the applicant is working on a plan to access sewer line of from Route 114 This 3 j r would remove the need for waivers as an on-site system would not be needed Mr Napoli asks if project complies with zoning and discusses location of loam stockpile Mr Lynch asks for a detail of a pump and treat area/slurry pit for use when the well is installed There is discussion on moving the well NACC requires installation of a dry set field stonewall as a physical barrier to deter yard waste dumping Mr Lynch states revised plans are needed There is discussion of the restoration area and possible change in the wetland line when fill is removed Restoration area documentation needed A motion to continue to November 19, 2008 meeting for revised plans was made by Ms Feltovic, seconded by Mr Napoli Unanimous 242-1428, Lot4N-A Turnpike Street(Merrimack Condominiums)(One Hundred Fourteen Trust)(Patrick C. Garner Company,Inc.)(cont. from 10/8/08) The applicant Peter Hingorani of One Hundred Fourteen Trust, and Patrick C Garner Company, Inc were present Abutter John W Haggerty of 1874 Turnpike Street was also present Mr McDonough is recused as an abutter Mr Garner presents changes to the project Buildings cannot be moved according to the ZBA Mr Garner indicates plants and fencing will be flipped The NACC discusses the different design iterations of the project Mr Lynch indicates he does not remember wetland fill (other than the limited project crossing) being proposed when project originally filed Mr Napoli also does not remember fill proposal on earlier iterations of plans Mr Napoli is concerned about NHESP issues Mr Garner states wetland fingers were discovered during later peer review by Mark West and filling was proposed Mr Lynch discusses alternatives layouts for the H units Mr Garner discusses profitability and unit reduction Mr Mabon states ZBA is willing to consider changes if required by the NACC Mr Garner states applicant would like to avoid return to ZBA process and consider additional mitigation Ms Feltovic states she is not in favor of the filling of the wetland resource areas Mr Lynch states documentation of alternatives is needed Mr Mabon requests a copy of the ZBA financial analysis Mr Garner discusses the use of retaining wall to reduce fill Mr Napoli suggests reduction of a unit Mr Lynch expresses concern for closeness of project to resource areas It leaves little room for errors in construction Mr Lynch discusses replication and mitigation requirements Ms Hughes states this property is pristine and the loss of tree canopies would effect the resource areas Mr Lynch states they could eliminate some of the buildings on the site so the area would not be so cramped Natural Heritage is involved because of the 2 certified vernal pools on the site Off-site alternatives for mitigation are discussed Mr Garner requests a meeting regarding stormwater issues with Mr Lynch and Mr Napoli A motion to continue to November 19, 2008 meeting was made by Ms Feltovic, seconded by Mr Napoli Unanimous Decision 242-1441, 1.54 Main Street Motion to issue decision as drafted made by Ms Feltovic, seconded by Mr Napoli Unanimous A motion to adjourn the meeting at: 10: 15 P.
