HomeMy WebLinkAbout2023-05-22 Select Board Minutes NORTH ANDOVER SELECT BOARD MINUTES MAY 22, 2023 Call To Order: Chair Janice Phillips called the open meeting to order at 7:00PM in the Select Board Room. Select Board in Attendance: Chair Janice Phillips, Laura Bates, Clerk Rosemary Smedile and Richard Vaillancourt were present. Not present: Brian Roache Non-Board Members in Attendance: Town Manager Melissa Rodrigues was present. PUBLIC COMMENT Rebecca Healey of 33 Edmands Rd was present at the meeting to discuss the speeding and car accidents at the corner of Edmands Rd and Lyman Rd. Public hearing- Application from AT&T for small cell wireless installation on utility pole near 477 Stevens Street (continued from 5/8/22) MOTION: Mr. Vaillancourt motioned to open the public hearing for the application from AT&T for small cell wireless facility near 477 Stevens Street. Ms. Smedile seconded. Motion approved 4-0. Attorney Edward Pare, attorney for AT&T, was present at the meeting. Attorney Pare gave an update that National Grid agreed to move the pole to the property line still at the same location at 477 Stevens St., but close to 469 Stevens St.’s property line. Ms. Smedile asked how all parties involved feel about it. Mr. Vaillancourt asked if pole will be removed. Attorney Perez stated yes, the pole will be removed. William Holt, owner of 477 Stevens St., was present at the meeting. Mr. Holt stated he would like pole moved 4 feet and centered so that it does not impede with the driveway. Attorney Pare stated National Grid controls the location not AT&T. Mr. Vaillancourt stated this hearing is just for AT&T equipment to be placed on the pole, so when National Grid comes in for their public hearing the location can be discussed at that time. MOTION: Mr. Vaillancourt motioned to close the public hearing for the application from AT&T for small cell wireless facility near 477 Stevens Street. Ms. Bates seconded. Motion approved 4-0. MOTION: Ms. Bates motioned to approve the application from AT&T for small cell wireless installation on a utility pole between 469 and 477 Stevens Street. Mr. Vaillancourt seconded. Motion approved 4-0. LICENSING MOTION: Mr. Vaillancourt motioned to open a meeting of the North Andover Licensing Commission. Ms. Bates seconded. Motion approved 4-0. Public Hearing- Application for a Class II license from Fred’s Fuel Inc. d/b/a The Right Price Auto- 17 Massachusetts Avenue MOTION: Mr. Vaillancourt motioned to open the public hearing for the application for a Class II license from Fred’s Fuel Inc. d/b/a The Right Price Auto- 17 Massachusetts Avenue. Ms. Phillips seconded. Motion approved 4-0. Farid Geha, owner of 17 Massachusetts Ave, was present at the meeting seeking a dealer license. Claudette McMurray of 25 Massachusetts Avenue stated she is in favor of Mr. Geha as the new owner and he has been successful in maintaining the noise and traffic at his business. MOTION: Mr. Vaillancourt motioned to close the public hearing for the application for a Class II license from Fred’s Fuel Inc. d/b/a The Right Price Auto- 17 Massachusetts Avenue. Ms. Bates seconded. Motion approved 4-0. MOTION: Ms. Bates motioned to approve the application for a Class II license from Fred’s Fuel Inc. d/b/a The Right Price Auto- 17 Massachusetts Avenue. Mr. Vaillancourt seconded. Motion approved 4-0. 1 NORTH ANDOVER SELECT BOARD MINUTES MAY 22, 2023 Application for a Common Victualler license from Fernardo Lopez of Edifer Pizzeria- 1812 Turnpike Street Fernando Lopez was present at the meeting and Gary Ortiz, accountant for Fernando Lopez, was also present at the meeting seeking a common victuallar license. MOTION: Mr. Vaillancourt motioned to approve the application for a Common Victualler license from Fernardo Lopez of Edifer Pizzeria- 1812 Turnpike Street. Ms. Bates seconded. Motion approved 4-0. MOTION: Ms. Phillips motioned to close a meeting of the North Andover Licensing Commission. Ms. Bates seconded. Motion approved 4-0. Request of the North Andover Farmers Market to close First Street from the entrance of First & Main to Main Street every Sunday from June 18, 2023 to October 1, 2023 from 7:00AM to 2:00PM Margie Rothschild, chair of North Andover Farmer’s Market Planning Committee, was present at the meeting. Ms. Phillips recused herself from the vote. MOTION: Mr. Vaillancourt motioned to approve the request of the North Andover Farmers Market to close First Street from the entrance of First & Main to Main Street every Sunday from June 18, 2023 to October 1, 2023 from 7:00AM to 2:00PM. Ms. Bates seconded. Motion approved 3-0-1. Request of the Festival Committee to use the Town Common on July 4, 2023 for the reading of the Declaration of Independence and 4th of July celebration from 10:00AM to 2:00PM th John Lennhoff was present at the meeting and explained the program schedule for July 4. MOTION: Mr. Vaillancourt motioned to approve the request of the Festival Committee to use the Town Common on July 4, 2023 for the reading of the Declaration of Independence and 4th of July celebration from 10:00AM to 2:00PM. Ms. Bates seconded. Motion approved 4-0. Request of the Festival Committee to use the Town Common every Tuesday and Thursday from 6:00PM-7:00PM from June 27, 2023 to August 24, 2023 for the Summer Fitness Program Ashley Vaillancourt was present at the meeting and discussed the upcoming fitness class schedule. MOTION: Mr. Vaillancourt motioned to approve the request of the Festival Committee to use the Town Common every Tuesday and Thursday from 6:00PM-7:00PM from June 27, 2023 to August 24, 2023 for the Summer Fitness Program. Ms. Smedile seconded. Motion approved 4-0. Approve 5 year contract for Tasers for the police department Ms. Rodrigues explained a 5-year contract will save $48,090.00 over the 5-year period. MOTION: Ms. Bates motioned to authorize the Town Manager to enter into a 5-year contract for Tasers for the Police Department. Ms. Smedile seconded. Motion approved 4-0. Approve ARPA funding in the amount of $300,000 for design of Route 125/Great Pond Road intersection James Stanford was present at the meeting and explained this will be used for the design portion. MOTION: Mr. Vaillancourt motioned to approve ARPA funding in the amount of $300,000 for design of Route 125/Great Pond Road intersection. Ms. Bates seconded. Motion approved 4-0. 2 NORTH ANDOVER SELECT BOARD MINUTES MAY 22, 2023 Approve additional ARPA funding in the amount of $4480 for open space and recreation plan MOTION: Ms. Smedile motioned to approve additional ARPA funding in the amount of $4480 for open space and recreation plan. Ms. Bates seconded. Motion approved 4-0. CONSENT ITEMS A. Accept donations to the Youth Center for Summer shows on the Common B. Accept donation of $150.00 from the North Andover Women’s Club to the Library for books C. Accept donation of $2,500 from the North Andover Women’s Club to the Youth Center for swim lessons at Stevens Pond MOTION: Ms. Smedile motioned to accept all consent items. Ms. Bates seconded. Ms. Smedile recused herself from the vote. Motion approved 3-0-1. Ms. Smedile stated the North Andover Women’s Club voted to give a $2500 scholarship program that will be run by the Youth Center and overseen by Director Rick Gorman. This scholarship will be given to families in need to off set costs of swimming lessons. Ms. Smedile mentioned donations from residents are also being accepted and appreciated. APPROVAL OF OPEN SESSION MINUTES OF MAY 16, 2023 MOTION: Mr. Vaillancourt motioned to approve the Open Session minutes of May 16, 2023. Ms. Bates seconded. Motion approved 4-0. Town Manager’s Report - Ms. Rodrigues thanked the Town and Town Employees for a successful Town Meeting - Laurie Burzlaff received the YWCA Tribute to Woman in Government award - Recent retirements of Paul Jutras, Glen Alt and EJ Foulds Select Board Update - Ms. Smedile & Ms. Bates mentioned Sheep Sheering was a success - Ms. Bates thanked Mr. McGravey and his Civics class for a recent invitation and attendance to their classroom - Ms. Phillips reminded about the Phila Slade Art Show and Sale on 6/3 from 12-4PM - Ms. Phillips reminded about the Memorial Day Ceremony ADJOURNMENT MOTION: Ms. Smedile made a MOTION, seconded by Mr. Vaillancourt to adjourn the Select Board meeting at 7:59PM.
