HomeMy WebLinkAbout1969-04-14Monday - April l~, 1969 Regular Meeting & Hearing The BOARD OF APPEALS held their regular meeting on Monday evening, April l~, 1969 at 7:30 P.M. in the Town Office Building with the following members present and voting: Arthur Drummond, Daniel T. O'Leary, Donald J. Scott and J. PhiLip Arsenault. Chairman James A. Deyo has resigned because he has been appointed to the Advisory Board. It was necessary to elect a new chairman. Mr. O'Learymade a motion that Arthur Drummond be elected the new chairman. Mr. Arsenault seconded the motion and the vote was unanimous. Mr. Drummond designated Mr. O'Leary to be the Clerk. There were 5 people present for the meeting. HEARI~13: Marjorie Hargreaves. Mr. O'Leary read the legal notice Lu the appeal of Marjorie Hargreaves who requested a variation of Sec. 6.31 of the Zoning By-Law so as to permit the division of an existing lot of land thereby creating lot of petitioner of approx. 10,900 sq. ft. in size; on the premises, located at the east side of Marblehead Street and west side of Baldwin Street; and known as ~2-~4 Marblehead Street. Atty. Arthur M. Khouryrepresented the petitioner and stated that she was unable to financially ma~utain the entire lot in a presentable manner. It is the intention to convey a portion to adjo~n~ug landowner thereby assuring maintenance of the neighborhood and a neat appearance. Speaking in favor of the petition was the intended purchaser of the land, Mr. Melillo, who owns the adjoining property. Mrs. Elwyn King, an abutter, expressed concern about possible construction on the proposed lot but when assured by the proposed new owner that he intended it only for a play area for his children, she was satisfied; and he stated that any stipulation by the Board to this effect would be acceptable. Mr. Scott made a motion to take the petition under advisement; Mr. O'Leary seconded the motion and the vote was unanimous. ME~RINACKMAT~IALS, INC. Merrimack Materials, Inc. are requesting the Board to renew the earth removal permit. Mr. Arsenault made a motion to request a report from the Building Inspector Mr. O'Leary seconded the motion and the vote was unanimous. FINAL DEC~,RE: KE~IN C. DONOVAN. A letter was received from Town Counsel notifying the Board of the Final Decree in the court action of Donovan v. North Andover Board of Appeals. The court directs that a building permit be issued for the construction of a single family dwelling. A letter will be sent to the Buil~ug Inspector informing him of this action. HARGREAVES: Mr. Arsenault made a motion to GRANT the variance with the condition that no building shall be constructed on the lot. Mr. O'Leary seconded the motion and the vote was unanimous.
