HomeMy WebLinkAbout1949-06-13June 13, 1949 The meeting was called to order by the Chair~n at 8:00 P.M. in the Town Building. Members presetn: John F. Alter, Chairman, Gregory Mooradkanian, Henry E. Lund and associate member James Began. An application was received from Peter Coco for a variance on the side lines of a lot located on ~ssachusetts avenue. _Mr. ~oco desires to build a small single residence and the side yards would be less than the required 15 feet. Application and advartised notice were read by the Secretary and plans were presented to the Board. Mr. Coco was present and expalined the situation to the Board. There was no objection on this application and the matter was taken under advisement. An application was received from~m~ Aziz for a renewal of the variance granted to him in 1949 for the continued use of the premises of a raad side stand to sell farm produce and hot daogs, tonic etc. There was no objection to this application and this was renewed for one year since this is a non-conforming use. and must be renewed on or before this date in 1950. An application was received from George Rennie for a variance to erect a road side stant on ~hickering Road in order to dispose of fruit and t~egetables raised on the premises. Mrs. ~elen Coolidge sent a letter to the Board objecting to the granting of this Eariance. The matter was taken under advisement. A discussion was held on the application of Peter Coco and motion was made and seconded and it was dnanimously VOTe3 to grant this variance on the condition that ~m~Jmz~x~m~ no side clearance would be less than ten feet from tbs lot line on either side of the proposed building. A discussion was held on the application of George Renn~e and mation was made and seconded that the variance be denie~ on th~ ~ollowing grounds. l- This location is in a General Residential section and according to Article 2, section 2 of the Zoning By-Laws of the To,mu Of North Andove~, there is no provision for the erection of a road side s~and in a General Residential District. 2~ Article 6, section 2,. paragraph (a) ~f the Zoning By-Laws related to the kind of permits which the Board of Appeals has the authorazation to grant, does not provide for the granting of variances for the erection of fruit stands in a General Reisdential District. 3-The Board of Appeals does not deem this an exceptional case, which will support a real need anddoes not feel that it can exercise its rights to grant a permit such as this under Article 5, sectionl, paragraph (e). 40 On the other hand, the Board finds that the gra~ting of this permit would b~ in violation in general of the Zoning By-Laws, Article 6,' Section 1,~ paragraph (d) which prohibits the Board of Appeals from granting permits which would amount to an amendment of the By-Laws. Notion was made and seconded and it was VOTED that this meeting would be the las~ cf the season unless there was some ~pplications which re- quired the immediate attention of the Board in which case a meeting would be calledatthe discretion of the Chairman.
