Me~bers p~esent: Chairman,~reg~ry Meoradkanian~. Henry ~e IAmd~ ~ Peter Rttehie, and Ja~es J. Regan associate ~e~ber who was replacing ~eAher Richard Whipple~ Secretary. Meaber Andrew E. Alvine was 'also present, later in the meting. Since ~e~ber Alvine could net be present ~ntil later in the evening~ the parties interested in the application were asked if they consented tea hearing with onl~ the four m~bers present and that this matter would be discussed with Mr. Alvino later in the eventug and a v6te taken. AI~ present were. agreeable t~ this and the ~eeting continued. Application was received~y_La~r~n--ws~ard Melamed, 270 AndOver Street, requesting a variance of the Zeroing so a s to ex'tez~ an e~isting nen..confor,~ug use ts allow the continued operation of a poultry processing plant whereby the work would be done by ~achinery instead of by hand as had been done for a number ~f yearse Mr. Mela~ed was present and explained to the B~ard that his property w~s a far~ and ha~ been a far~ l~ng before Zoning and thereby had been operating as a non~enfer~ing use for that districte Be e~plafned that the processing ef the poultry had previ~usl~ been done by hand and ~hat he was required te hire labor. This process consists ef pluckin~ and bleeding the ~ultry and shipping the~ out on the s~ d~y. The birds were net dressed at the plant. The blood and feathers were also sold and disposed of i~diately.' Mr. l/ela~d e~p,~a~ed that he wished to install ~ackinery to this work and thereby e~w~r~te the .necessit~ of hiring labor and that this work could be done by himself and his brother, ge also said that same building that had been used preViousl~ but ~odernized to be able to a ccomodate the ~ati~ And the birds are not handled at all, present a few head of cattle and a few pigs use but that there would be no slaughtering thb building t~ be used was the and that it had not been enlarged. machinery which is all auto- He also stated that they had at which they kept for their own in the plan~. Mr. Me~:~:~.s Melamd was present and stated that labor was hard to get and that they would like to operate this plant themselves which they could, if ~he machinery was installed. Mr. John Fitzgerald~ 16 Pleasant Street was present and was recorded in fawr of granting the variance. He stated that he was also representing his daughter and son-in-law who are neighbors of Mr. Mela~ed they are the nearest neighbors and he stated that there was no c~er from the p~ant and ~hat the place was kept very clean. Mr. John J, Mahoney~ 57 Davis Street also wished to be recorded ss being in favor of granting the variance. He stated that he could see n~ objection ts this as the place w~uld be ~proved by the ~dern method ef processing. Mr. Alvah Wea~er, 147 Chestnut was present and wished to be recorded as being an obJeotor to the granting of the variancee He also stated that~ he represented the Clark estate and also the Hanson' s who ars residents in the nearby neighborhood. He stated that there were no sewers in that seotion that the oder w~uld attract flies and rats and that this ~ype of should not be operated in this type of area as there ware 8oz~ very nice he, es in the visinity~ md that a plant of this type w~uld n~t be d&sireable November 13, 1951 Cont. Mrs. Robert Dews was present and also objected to the granting ef this variance. She stated that they had lived in this area ~only a short while and that they were under the impression that it was strictly a residential area, Mr. E~ard L. H~pper~ 26 Andover Street also wished to b · r~, corded as obJectinge Mrs. Pauline Blood telephoned the Board~ since she could bet be present at the me, ting and explained that she was the real estate agent for some of the new homes inh that area and e~ that gr~,-~ wished to be recorded as ebJectin~ te this application. Mr. Brewn~ 230 Andever Street also sent a message te the Board empl~-g that he could not be present at the meetin~ but wished to be recorded a.s ebJectinge Mrs Louis Scheenk% 210 Andover Street wished to be recorded as objecting. He stated tha~, he just ~aoved ever here and had left his for~er hems in So. Lawrence for Just the samo reason as thise Business and other undesireable plants were sprining up too near ~to the residential area. Mr. Will, am F. Wsod, 46 Massachusetts Avenue, was present and stated that he was in favor of the granting of this application. Be stated that in his .~p.A~on~ an~ type ef business er underta~2 of this type was being stifled in this Town. ~nen questioned further~ Mr. Mel~aed stated as follows, This ~ has been in existance since 1919 and has always been operated as a farm, He stated that he re~tzed that this was classified as a restricted residential section, but that he was operating as a non-confoi~mlng use. They have about 70 acres of lar~ and have always had cattel and ~ige and chickens en this £ar~ Insofar as the new- cc~ers to that section~ he stated that they all had the knowledge that this far~ was in existance before they bought homes and moved to this section. Ne stated that the amount of poultry also would vary with the seasons. Ne uses range shelters for the poultry. The processing originally had been done in a shed which is a part ef the barn and that the new machinery would be installed in the barn and that it would be modernized to fit the ~achinery. Mr. Melamed stated that he lives right on the premises and that he lived as well as ar~ of his neighbors and certainly would not stand for not b~ving the place clean er having o~ors around his own home.~ He stated that they would operate as they had been doing~ under state supervision and would required te have a per,it from the Board of Health, Be stated that 70% of the birds were raised on the far~ but that they did bu~ a few capons. He described the ~achine as a ~reenbriar -mchine which operated an an endless chain. The birds are hooked to one end and are then ~ and then go to an automatic soalder and then to an automatic buffer which removes the featherse They are then chilled in tanks and packed and shipped. He a~o explained that' this new ~ethod was very ~uch more sanitary than done b~ hand as the birds are not handled a t a~ 1. Upon motion made and seconded it was VOTED to take this matter under consideration. After having discussed the matter, Mr. Alvino arrived at the ~eeting a_~_d it was decided that the board would go in a body to view this plant. They did ae and found that the conditions were very goods Upon a ~oti~n ~ade and seconded~ it was then VOTED to grant the variance to Mr. Melamed for the continued operation of the poultry processing plant with the work to be done by machinery. The Board did i~pose a condition to this variance. The plant is to be restricted e~tire~ te peultry. ~Vemher 13, 1951 (~ont. An application was received frei Mr. James Schofield~ 69 ~e~-A:ick Roadp ' requesting a variance of the Zoning,, ~-Laws of the Town ~f North Andover, so as topermit t~e erection of a residence cna lot located at 107 High Street~ This lot has been on record prier to Zoning and the side yards ~ann~t ~eet the present requirements. The lot is only 50 ft wide. Mr. Rra~seur wa~ present a~d explained to the Board that the proposed residence would leave the side yards er~ 10 feet from the lot l~ee There was no objection to this app~lcatioh. Upon ~ ~ade and seconded~ it was VOTED to grant the variance to Mre Scofield. Published notices of both these Public Hearings were printed in the Evening Tribune on the evening of November 3~ 1951e Abbutters to both properties were notified.
