HomeMy WebLinkAbout1954-02-08The meeting was cal~d to order b~ the Chairmau at ?:30 P.M. in t~e Town Building. This was a Public Hearing. Members present: Richard G~ Whipple, Chairman, Andrew E. Alvino,. secretary, Nicholas Ntcetta, Peter Ritchie and Henry Ee ~. ~qeo¢iate members Benedict Perrone and Donald F. Smith were also present but did ~ot veto en any of the m~tters before the Board since ~he ~ Board of regular members ~ere p~esent: An application was received from Mr. ESmmnd F. ~el~d 3rd~ requesting a variance of the Zoning By-Laws of the Town ef North Andover, so as ~ permit "}dua te be~, sell a6d 'repair antique firearms. This vari~uce was requested as a non-conforming use permit ena year~ basis. The notice of the advertisement of the Public Hearing was rea~ by ~he ~e~retary. This notice was published in the Evening Tribune on the evening of January 30~ '1954e A_I_~ abutters were notified of the Hearing, Mr. Ireland was present ar~ informed .~he Boar~ that he wished te bu~, sell an~ repair antique f~rearms as a hobb~ rat~er than a ~usL~ezs. He rotated that un order to de ~his~ it was necessary that he obtain a license for fire~A~ms from the Licensing Board and that he had been informed that the Licensing Boar~ wished to get ~he a. pp~oval of the Board of Appeals ~efore Sra~ the License. Mr. Leland stated that he. would pursue this hobby em h~ father's estate on Narbleridge Road and would use qne of the m~ small buildings on this estate for this purpose~ There were no ®bjectors t~ this .application. A motion was made by Mr. Nicetta~ seconded by M~e Ritchie and it was ~aa~tm~usly voted to take ~he matter under advis .ement. After due consideration of the above application, a motion was made .by Mr. Nicetta, 'seconded. by Mr. Ritchie and it was u~animous~v voted to grant the ~arian~e requested as a non-conforming use and that this wo~ld ~ a permit issued yearly. Mr. Brasseur c~m~ before the Board te discuss the application of Charlotte Gallaher, which had been formal3~v presented to the Board e~ Dec. 14~ 1953 action en which was postponed until .approval of the Board of Health could be given. A letter .received from theBoard of Health, dated Jan. 11, 1954 stated "the construction of· individual sewerage systems is prohibitive in small areas and also in the type of soil in this ar~. a. The system now in use seems to be the best plan for this area until pablic sewers are aw~lable, Mr. Brasseur presented a plan to the Board w= which was marked to show the cess pool system rased in this area. He also presented a cop~ ~f an _ax__cerpt from the deeds which are to go with the property proposed to be sold giving the new tewa~ts the right to use the common ~ess t~ols' already in existanee. After further considering this application~ a mo~ion was made by Mr. Nicetta, and seconded by Mr, Lund, it was unar~usly voted to postpone action on ~xis application until the m~mbers who sat in on. the ~ublic Hearing could get together and vote on this appl~c4tigr~ Mr. ~egan, an associate member was at the original hearing and he will be contacted te meet with the other members to cast a vote on the application.
