the approval of the construction of a two c~r garage° This was advertised
in the Evening Tribune on July 16, 1954. Mr. Jackson explained that there
is no other suitable location for the garage, it is in ~fne with the house,
there is a ledge on one side and the rear requires f~llt~g, besides the~e
being no a~ess to the rear. Mr. Brassemr explained the garage would be
12~ feet from the 11ue of the adjoiniug lot, it is only a question of 2~ ft.
being involved on the side line.
Motion was made by Mr. Nicetta, seconded by Mr. Alvino and it was unanimously
voted to take this matter under advisement. There were no objectors to this
application.
'After further discussion of the above matter, a motion was made by Mr. Smith,
seconded by Mr. Alvino and it was unanimously voted to grant the variance
because the evidence shows that the topography of the laud will not a~lo~ the
garage to be placed elsewhere in conformity with the By-LA,~. The plans
were signed by the Board.
Upon discussion of the application of Louise M. Campbell, a motion was made
by Mr. Nicetta, seconded by ~.~. Smith and it was unanimously voted to post-
pone action u~il the Board vi~ the premises; which ~_ll be on Thursday
evening~ July 29, 1954 at 7:00 P.M. and will decide at that time whether or
not to approve the variance.
After further discussion of the application of Rose M. Clements to' operate a
Rest Home, a motion was made by .Mr. Smith, seconded by Mr. Perrone and it was
unanimously voted to grant a permit for a Rest Home at 812 Osgoed St., North
Andover, ~dNj~t~t6 the restrictions that entrance and egress be made by wa~
of the drive leading to the home from Chadwick Stre~°~l~e-~; unless, before the
renewal or successive renewal of the permit, a st or accepted wa~ is cut
through the property as shown on the plan dated May, 1954 - entitled:' "Pre-
liminsry Study for Development of Property ow~ed by Estate of Robert Bemis
Smith - Clinton F. Good~n, Reg. Prof. Engr., M~y, 1954." The pl~us were
signed by the Board.
The Board then discussed the application of the Tide l~ater Associated Oil
Compar~ for v~ich a P~blic Hearing was held on July 12, 1954 and which was
advertised in the Evening Tribune on July 3, 1954.
A motion was made by Mr. Nicetta, seconded by Mr. Alvino to grant the request
for variance. Mr. Nicetta and Mr. Alvino voted in favor of the motion and Mr.
Whipple, Mr. Perrone and Mr. Smith voted against the motion. The motion was
defeated and the application denied.
Upon motion of Mr. Smith, seconded by Mr. Perrone; Mr. Smith, Mr. Whipple and
Mr. Perrone voting in favor, ~. Nicetta ~md Mr. Alvino not voting, it was
voted that the following reasons be given by the Board for the denial of the
petition for a variance and that the decision be filed with the Town Clerk
and be sent to the interested parties:
1. A special permit was not sought no, secured by the appellant from
the Board of Appeals as required under Article VI, Section II, of the
Zoning By-Law.
