HomeMy WebLinkAbout1955-08-08On motion of Mr. Smith seconded by Mr. L~ud the Board voted to grant the variance to Salvatore 7enti~iglia Meeting adjourned at 9:30 p.m. August 8, 1955 Three public hearings were schecu._ed for this meeting but due to the absence of members to make a full board, the hearings had to be postponed. Mm. Charles Hatch, appearing for Mr. Lawrence Stahley, one of the petitiners asked if he could please explain his client's case to the memoers present. The members agreed. Mr. Hatch explained that although the land in question had never been recorded, there had been conveyances as late as 1954. Mr. &Mrs. Stahley now wished to purchase two lots and entered into agreement on April 2nd and the new amendment to the by-laws was paseed by the Board on April 27th. Therefore, the Stahleys are caught in the middled. The Board informed Mr. Hatch andMr. Stahley this case would have to be reviewd after a public hearing which would be held on August 25th at the expense of the Board. The meeting adjourned at 9 :O0 p.m. August 25, 1955 The meeting was called to order by the chairman at 7:30 p.m. Members present were Mr. Lund, ~. Boeglin, Mr. Nicetta, Mr. Finck, and Mr.~ Alvino. A Public Hearing was held on the petition of Laurence Stahley of Hemlock Street Mr. Finck 9pologized to Mr. Stahley for the inability to hold this he~a~ing on the date originally scheduled. Mr. Stahley stated that he contracted to buy the land in question on April 2nd and signed an agreement and paid by check~ in part,~ for this land. Mr. Stahley stated ~.~I~. nothing about the new law and stated it was April 6th before anything app ared in the paper and therefore felt this granted him equity The deed was given to Mr. Hatch, Mr. Stahley's lawyer, on April 2nd to make the transfer. Mr. Hatch told him they could not draw this up as there were unrecorded. In April, Mr. Stahley contact the enginner, Mr. McCracken and contracted him to draw the ~aps which are dated June. He felt that equity passed on April 2nd as on that day. ~h~ new law had not been in the newspaper. Mr. Stahl~y did not feel he was asking for an mnendment as the old law was set at 7~00 sq. ft. and Mr. Stahley has 10,OOO sq. ft~ with no other land available. ? Mr. Nicetta~ asked ~ ~,r. Stahley if he ~ uld have bought the land if he could not get clear tiile~ - Mr. Stahley said no. On motion~ of Mr. Lund, seconded by Mr. Alvino, the BOard voted to take the matter under advisement. Decision On motion of Mr. Alvin% seconded by Mr. Lund the ~Board voted to deny the petition of Laurence Stahley as this variation would amount to an amsndment in the opinion of the ~oard. A Public H~ar~ng was held on the petition of ivon CarDenter who requested a variance fro~ the zoning ordinance with regard to frontage. ~nere was nothing further added to what was already stated in the petition. On motion of }'~. Nicetta, seconded by Mr. Alvino, the Board Voted to take the mater under advisement. Decision On motion of Mr. Nicetta, seconded by Mr. Lund, the Board voted to grant the variance with the understanding that the rear lot shall be at least 30' and front be no closer than 20' to the street. A ~ubllc i{carin~ was held on the petition of Arthur Kennedy, Ot~ Clark Road, requesting a special permit from the Board to allow the raising and selling of poultry.on the.premises. There was nothing further added to what was already stated in the petition On motion of Mr. Lund, seconded by Mr. Boeglin the Board voted to take the matter under advisement. Decision On motion of Mr. Nicetta, seconded by Mr. Lund, the Board unanimously voted to grant a non-con~or~inguse perrrd, t to Arthur Kennedy for one year. Meeting adjourned at 9:30 p.m.
