Smith, Cha~_ ~; D~el O'Leary, Nicholas F. ~icetta, ~eth Terroux a_~ Alfred Boegl~, Associate Member. The Board met to discuss and ~-~de a decision on the petition of the Boston Ski. Development Corporation and Jo~- C. Parnua requesting a variation of the Zoning By-Laws so as to permit to change and/or extend a non-conform~E use and for a variation from the requirements of the Zoning Ordinance, and all other inconsistent provisions thereof; on the premises, located at the West side of Route 114, opposite the intersection of Johnson Street, and known as Boston The Public Heal~ was held on Monday evening, August 12, 1957. After very ther~,_gh disc~,_ssion, the Board decided as follows: Mr. Bcegl~ made the motion that the extension of the non-conform~ use be DENIED. Mr. 0'Leary seconded the motion and was voted ,-~-4mously. The petition for extension of non-co, forming use is denied on the grounds that i% would extend beyond $.be_ present ~lowable uses by reason of the uses of laud pri~r to the existing by-laws. Upon motion made by Mr. Terroux, seconded by Mr. Boeglin, it was unaui- mously voted that a var~snce be GRANTED subject to the following c~nditiens~ 1. That the uses of the land sb~ be ~ted substantially to those outlined on a certain plan entitled "Site Plan, Boston Ski Develo~nent Corp., Nox~h Andover, Mass. Bastille B~lsey Associates - Architects, dated 7-22-57." 2. That the water storage area sh~m on site plan s~ be fenced by a permanent oh~4~ ~4~ fence, 5 feet in height. 3. That the Warm~ng Hut sho~n ~n the plan, m~ be used ~ by patrons of the ski lift. 4. That the Warming Hut as shown on the p~ shall be constructed c~ly upon condition that the wooden school house shown on site plan sha]_l no longer be used in connection with the ski ~ft. 5. The par~-g area shall be limited as now sho~n ca the plan and s5,11 not include "Fut-oA-~ Parking Area". 6. The ski lifts ~2 ~ be used only in connection with skiing. 7. The Warming Hut sb~ be of fire resistant interior construction and shall be satisfactory to the Board of Fire Engineers of the to~m. The petition for a Variance is granted because the Board finds that the area in question is of a very steep grade and not suitable for use as a residential area n~r as use for far,~ or other agricultural activities. The present area has been used since prior to the effective date of the Zc~ By-Law as a ,~_~_ The Board further finds that because of the unique character cf this land and cause of its unua~,-~ topography, a variance as here applied for may be granted with~ out substant~ detriment to the public good and ~ithout n,,~ifying or substantially derogating fr~m the intent or purpose of the zo~ by-~?w. The Board finds that under the heretofore existing non-confor~g use, a serious traffic problem was caused by reason of the parking of cars of patrons of August 19, 1957 - Cont. the ski lift on the surround~ng road-~k~s. The Board also finds that trader the horetof~re existing non-conform~ use, a woode~ school buil~ on the .northeasterly side of Route ll ~ had been used in connection with the ski lift. Such use of the school house caused a traffic hazard, with pedestrians cross~8 the highway. U~der the variance hereby granted, t?~s condition wall be ~lleviated by reason of the p~o- vision for parking areas and a so-called warming hat on the westerly side of Route 114, which v~l~ el~m~B.ate the serious traffic proble~$ The meeting adjourned at 9:1~ P.~.
