HomeMy WebLinkAbout1957-10-14October 14, 1957 The meeting was called to order at 7:45 PM. The members present were: Donald F. Smith~ Chairman, Daniel O'Lea~y, Nicholas F. Nicetta and John J. Willis, Associate Member. Mr. Norman Pitm~n, Andover By-Pass, asked the Board for information concer~ing a variance for sub-division of his property on the Andover By-Pass. He must have proper plans and then a hearing will be set. Mr. Brasseur appeared in the interest of Fred T. Azia, showing the license issued to cover the sale of goods as listed. He also showed the additional plans of the new stand, which the Board had asked for in order to act upon his petition. Mr. Smith informed ghe Board that Attorney for Michael Carradino requested ht~ to withdraw his application for a gasoline service and filling station on Osgood Street. F~tionwas made by Mr. Nicetta to withdraw the application without prejudice, seconded by Mr. O'Leary and voted unanimousely. Atty. Petratia appeared before the Board with a petition for a variance and plans for Anthony Alaimo, 1721 Osgood Street. A hearing will be called for the next meeting at 7:30 PM. Mr. Nicetta excused himself from the meetin~ in order to attend a hearing in the Select- men's office. The November meeting of the Board will be called for October 28th because Veteran's Day November 11, falls on the meeting date. The Board disuus~ed thoroughly the petition of Fred T. Azia, which hearing~as held on September 16, 1957. Mr. O'Leary, made the mStion to grant the variance, seconded by Mr. Nicetta, and voted unanimously by the four m~mbers present. Mr. Terroux was present at the hearing but absent for this voting. The reasons for decision: The petitioner has been doing business under a non-conforming use on the premises at the time of the effective date of the Zoning By-Law. The Board finds that the proposed building will eliminate traffic dangers by reason of its permitting vehiciles to drive in from the highway. The Board finds that ~because of the unusual topography of the land the petition, the proposed building cannot be erected in conformity with the requirements of the zoning law with respect to set backs from the s~reet line. The Board signed the corrected plans of Joseph Cyr. A discussion followed regarding a Town Counsel. A motionwas made by JohnJ. Willis to recommend to the Selectmen John Lynch for'counsel. The motion was seconded by Mr. O'Leary and three members voted in favor of the motion. Mr. Nicetta did not vote. The meeting adjourned at 8:30 PM. Chairmau Clerk
