The meeting was called to order at 7:45 PM. Members present were: Donald F. Smith, Chairmm
Daniel 0'Leary, Henry E. Lund and Alfred Boeglin, Associate Member who sat in place of
Kenneth Terr~ux.
Mr. Smith read the notice of the application of Anthony Alaimo requesting a variation
ef the Zonin~ Ordinane so as to permit the erection of a dwelling on the Easterly
s~de of Osgood Street on the premises ofl721 Osgood Street containing 35,900 square
feet of land, said area being less than the area required under the provisions of the
Zoning By-Law of said Town.
Atty. Petralia represented the petitioner. He presented the proper plans and explained
to the Board that a building permit was issued on April 29, 1957 and proceeded in good
faith to erect the dMelling, which is now 75% complete. The deed for the land was re-
coreded on June 10, 1957. There were no objectors to the petition. Mrs. -Alaimo and
Mr. Coppolawere present.
Mr. O'Learymade a motion to take the petition under advisement, seconded by Mr. Lurid
and voted unanimously.
Mr. Smith read the notice of the application of Norman Wiley Pitman and MaryEstella
Peitm~n req~e~sting a wriation from the Zoning Ordinane so as to permit the erection
of a dwelling on the premises located at the Easterly side of Andover By Pass and the
Southerly side of Willow Street, containing 31,802 square feet of land, said area being less
than the area required under the provisions of the Zoning ByLaw of Said Town.
Mr. Pitman Sr. explained there was not enough land to give his son the required amount
in order for h~m to build. It is lot #2 on the plan. The land was purchased in
March 1945.
The Board req~sted Mr. Pitman to submit proper plans showingthe placement of the
house on the lot so as to meet the building requirements, in order for the Board to act
upon his petition. There were no objectors to the petition. Mr. McNeil and Mr. Look
appeared in favor of the petition.
The Board then proceeded to discuss the Alaimo petition. Mr. Boeglinmade a motion to
grant the variance, seconded by Mr. O'Leary and voted u~animousely for the following
reasons: It eLppears to the Board that this dwelling is 75% complete and that the
petitioner has proceeded in good faith relying upon a building permit issued by the
Building Inspector on April 29, 1957. The area of the lot is 35,900 square feet,~ less tha~
the required area of an Industrial Zone. However in all other respects the lot meets
the requirements of the Zoning ByLaw. The Board finds that if the Petitioner were not
granted a variance, substantial hardships will result to them and that the granting of
this variance will not substatntially deregate from the intended pruposes of the By Law.
Concerning the Norman W. Pit~u petition, by una~Imous consent, the petition wtll be
tabled until such time as the proper plans are ~iled.
The meeting adjourned at 9:00 PM.
