Special M~et~ng
A special meeting of the Board of Appeals was held on Monday,
August 11, 1958 at the Towo Bu~±ding. Members oresent and
voting were: Daniel T. O'Leary, Chairman, Kenneth Terroux,
Secretary, Donald F. Smith, and Robert Burke, ~asociate Member
Alfred Boegl!n was designated to s~t in place of Mr. Lund, reE-
ular member who was absent. %~ne meeting was called to order at
7:30 PM.
let hearing~. The petition of Thermos V. Kenoedy, 20 South Border
Street, Medford. Mr. Kennedy presented plans to the Board and
asked for a revision of his petition. He stated he has found if
the house were set back 30 feet there would not be room forthe
septic tank. He, therefore, asked f¢,r a variance on the set back
as well as the additional la~d. He stated he has owned the lan8
s~nce 1908. There was no opposition to the petition.
Mr. Smith mad~ the motion that the Board wait unti~ they hear from
~. Kennedy who was going to check the Board of Health on the
septic tank layout. The motion was seconSed by Mr. Terroux.
Unanimous vote.
2nd hearing. Walter Newell, hO May Street, North Andover. Mr. Newell'e
petition was the same as that of Mr. Kennedy as they pl~ to build on
adjoin~ng lots aod ~anted to d~vide the lot for which they petitioned.
The Board stated they felt the same on this pet~tf~n as that of
Mr. Kennedy.
Mr. Smith moved to .-~alt until the Bo~rt bears from Mr. N,well
before a dec,sion is made. The motion was secondeU by Fir. Terroux.

~rd hearing. Arthur L. Redmond~ 229 Washington Street, Reading.
Mr. Redmond requeste~ a variance on the frontage of three dwellfnMs
on Cotuit Street. Mr. Redmond stated that through an error, the
houses were ~ot ~et back the ~ecessary 30 feet.
Mr. Terroux moved to take the matter under advisement. Mr. Smith
seconded the motion. Unanimous vote.
~th hearing. Mrs. J. Elaine Griff~n, 8~1 Chickering Road, North
Andover. Mrs. Grfffio petitioned for the division of the premises
~n. to two ±ots. Mrs. Griffin state5 she asked for the variance as
it is a hardship for her to maintain the property due to nedical
btll~, etc.
was aeconded by Mrs. Burke. Unanimous vote.
5th hearing. 'Albert A. Ste~nberE, Osgood Street, North Andover.
Mr. Steinberg petitioned fo~ the construntion of a driv!u~ range
at the South side of Barker Street at the corner of Osgood Street.
Mr. Smith asked what made the land different from other land on
the street and why Mr. SteinberE wanted a driving range. MR. Stein-
berg stated the water shed presented a problem.

~. Terroux asked Mr. Ra!ob Brasseur, who had surveyed the land for
Mr. Steinber~ if houses cou±dn't be built on the Land and M~, Brasseur ~
exp±a~ned four or f~ve houaes could be built on the ~and but a housing
development couldn't be made as ~t is to clo~e to tbe.LaRe.
Mr. Smith mcv~d to take the matter under adv~semtnt. Mr. Burke seconded
the motion. Unan~,~cus vote.
6th hearing. Jcsenh Jacques, 263 Man~. avenue, North Andover. F~. Jacque~
pet~.t~o~ed for a v~riance to permit the erection of a club on the
East side of 0s~ood Street at the Southwest corner of Bradford Street.
He stated he ha~ a deoos~t on the land oresently owned by R. Coppola.
He sa~d the club woui~ be small with apProxfmately 100 members and there
would be no draft beer served but only bottled beer and cockailts.
Mr. Terroux asked if sandwiches would be served and Mr. Jacues informed
the Board he '~ould serve Small sandwiches.
~r. 0'~eary asked if there were any others In favor of this club and
Mrs. Do~!nlc Moschetto said she was ~n favor of it. She stated the
Telephone Company building was oext to the land on which the club wou±d
be erected.
Mr. John Morrel, 199 Bradfor~ Street, an abutter, stated bewas a~a~nst
an estab].~sh~ent cf this kind in the area. '-
Mr. Ralph Brasseur, speakin~ for the petitioner, explained there would
be a screen about the land to g~ve abutters privacy.
Mr. 0'Leafy asked what t~oe of building would be erected and was told
it would be a br~ck bu~.ldfng.
Mr. Michael MackOr, l~ Brad£ord Street, stated he felt a clUb of this
ty?e would not be an asset to the area and if a club of this type had
been built he ,~ouZd not have a home in this area.
Mr. Stanley Ka~acz~i, 27 ~radford Street said he was against this
club and stated trash is thrown all overt his land no~.
Mr. J. J. Shaughnessy of ~estern Electric stated ~estern Electric
would like to Eo on record as ~eing opposed to th~s club. He said
they felt an astablishment of th~s t~e in this area wou~d create more
cf a trafff~c problem ~.n the area and the workers might be enduced to
stoo in goin~ to and from work and it would be a safety problem inasmuch
as ma'ch~ery'is used in their work.

Mr. Smith asked ab-ut parkings, the c~rs and the entrances to the
ciub and'~. Jacques stated he thought there wou±d be two rows of
cars ~.n front amd possibly one row in back. Mr. Brasseur stated
the State will l~m~t entrances to be used. ~'. 0'Leafy asked
the number of cars to be parked about the club and Mr. Jacques
sa~d ao~rox~matelY 30.
Daniel Olen~o of Osgood Street asked if the Board had the power
to grant a permit for a club what about the lfcens~ng. He also
stated he has. had an aopl~cat~on for a license in for one year.
Mr. Burke moved to take the matter under aSvisement. M~. Smith
seconded the motion. Unanimous vote.
~e Board went Into executive session at 9:35 PM.
J,. Elaine Griffin. Mr. Smith moved that the application for a
variance be denied as it would be substantially derogating from the
By Law. M~. Terroux seconded the motfom. Unanimous vote.
Arthur Redmond. Mr. Burke ~oved that t~e varfance be gramte5. Alfrsd
Boe~lin seconded the motion. Unanimous vote.
· Albert Steinberg, Mr. S~t~ moved that the variance be denieS.
T~rra~x seconded the motion. Uman~mous vote.
Joseph Jacques. Y~, Burke moved that the variamce be den~ed as
refusal from the bu~ld~.ng inspector for the erection 6f a club
not accompany the petition and t0ere was no evidence this land
was d~fferept from any otaer ±and ~n the area. Mr. Smith seconded
the motion. Unanimous vote.
M~. Smith made the motion to l~m~t three apr, licentious, to each
l~,~,~'~n~ unless the Cha~rm~.~n otherwise orders. M~. Burke seended
