Me,tubers oresent and voting ~ere: Daniel 0~Leary, Chair~an, Kenneth ~.erroux, Secretary, Robert Burke and Donald F. Smith. Notice on the application of Fred Rogers, Sutton Street was read by ~.fr. Terroux. No on appeared for ~. Rogers. Mr. Smith ~de the motion if there was no objection this hearing be postponed for another month. ~.~. Burke seconded the mo~ion. Unanimous vote. 1st. hearing. The petition of Joseph ~.~on, 67 l~in Street. l'.~r. Byron appeared for himself ~nd state8 he would lihe to butld'a l0 foot building to be used for a "Take Out" sand~ich shop. He stated there would be no stools in the shop. He explained the building would be made of wood and wo~ld have a cin~erblock foundation. The petitioner did not present plans. Mr. Smith ma~e the ~otion to postpone this hearing without prejudice for &nether month. Mr. Terrou~ seconded the ~otion. Unanimous vote. 2nd. hearing. Mr. Lund sat in for this hearing. The pe~tion of Marie Sapienza, ~19 Joknson Street. Mr. Sapienza petitioned for a variance for the erection of a henhouse on his land but ~e did no~ have the neede~ plans. Mr. Smith made the motion that this hearing be postponed until next month or tuutiI proper plans are filed. Mr. Burke seconded the motion. Unanim~us vote. The Board went into executive session at 8:15 E~. Mr. Boeglin was absent and took no Dart in this deliberation. The Newell petition was reviewed and it was found that ~. Newell divide his two lots but selling one h~l f lot, ~ain~ the frontage only 75 feet. Mr. Smith moved that the wriance be denied. Mr. O'Leary seconded the motion. Unanimous vote. · The Kennedy appliat~on ~s revie~d~ ~ud after ~uch discussion. ~. Smith moved the Bo~rd state in its opinion a variance such ~s requested ca~ot be granted but that the Board finds by reason of 6,61 the oetitionerh~s the lot on record prior to the effective date of the ByLaw upon whic~ hem ay build provided he uses it in conjunction wit~ X~nd vacant and adjacent thereto and the Board advises the Building Inspector that he may issue a permdt in accords_uce ~ith the provisions of 6.61 submitted theft he has the lot on record as sho.~n on the plan attached hereto and made a part of this decision. Mr. Terroux seconded the notion. Unanimous vote. It was decided a letter should be ~itten to Atty. Lynch ask~ him to bring the Board up to date on the All States of Virginia case. The Bosrd also decided a letter should be ~Titten to the Bo~rd of Selectmen asking if it would be possible for arrangements for the use of the Fire House in case space was needed for hearings. ~,~.
