HomeMy WebLinkAbout1959-12-11Monaay, December ll, 1959 Regular Meeting The regular monthly meeting of the Board of Appeals was held'on Monday, December ll at the Town Building. Members present and votingwere: Daniel T. O'Leary, Chairman, Charles Foster Jr., Secretary, Henry Lund, Robert Burke and Howard Gilm,n. Attorney Charles Trembly appeared before the Board requesting info~.tion for Charles and Jo?mBreen who would like to operate a funeral home at 35-37 Merrimack Street. He pointed out it is an existing building in a Business Area. Mr. Trembly stated he believe a wriance was not need but that the Breens wanted to make sure everything was in order when they came into the Town. The Eeetin~ was called to order at Albert A. ,teznberg petitioned for a ten~pora~y sand and gravel pit. Attorney John F. Burke represented Mr. S+einberg who sought a variance under Secti'~n ~ Paragraph 4.Z~l. l,~r. Burke pointed out they would !i?e a oermit for 18 months as the sand would be used for the buildinE of the new bridge from florth Andover to Methuen which will be built soon. L. D. Boddy was present at the meeting and stated he would be the contracterwho would be trucking the sand. Mr. Boddy explained the trucks wo~ld go down Osgood Street. The yield would be appro~im~'tely 30,000 yards. Attorney Burke explained the top soil wo~ld be put back on the land to prevent erosion. Dorothy Arch~mbault, Paul Archa~bault mad Claire Ann Kennedy, all abbutters, appeared in opposition as they felt a gravel pit would cause erosion and would take down the valuation of their property. Mr. Lurid move to take the matter under advisement and that the Board look at the premises involved. Mr. Gilman seconded the~notion. Unanimous vote. i,~r. Boddy told the Board he wo~ld have the engineers put markers when the pit wo~ld be. Jo~hn Willis stated he would like to have an engineer from the Board of Public Works check to see if this pit wo~ld h~:ve any effect on the water shed. A bill for!'~1~ ..... :.~ was signed for :~ary Doherty. ],!r. Gilman moved the meeting adjourn at 9:~5 PM. Unani~:ous vote. Mr. Lund seconded the motion. Clerk
