HomeMy WebLinkAbout1960-03-14Regular Meeting The regular monthly meeting of the Board of Appeals was held c~ Monday, March 14, 1960 at 7:30 PM at the Town Building. Members present and voting ware.' D~n~el T. O'Leary, Chairman, Charles Foster Jr. Secretary, Howard Gilman, Robert Burke and Henry Lund. 1st hearing. The Estate of Alfred Garneau requested a varia-ce so as to allow a ten foot side line on their property on Brightwood Avenue. Ralph Brasseur appeared for the petitioner and pointed out this is a .,..11 lot with no other adjoining property and this small lot conforms with o$her lots in the neighborhood. Clarence Walters, 16 Brightwood Avenue, James Lyons, Brightwood Avenue and George Cullen of Brightwood Avenue opposed the request because they objected to such a small lot. Mr. Burke moved to take the matter under advisement. Mm. C~llman seoondad the motion. 2nd hearing. Mr. O'Leary designated Mr. Morley to sit in place of Mr. Lund. Oliver Kirk requested a variance in order te sell one lot of land on Stevens Street. Mr. Kirk appeared for himself and explained to the Board he had to F~rchase this piece of p~operty because of the zoning law. He told the Board land across the street was zoned Village Residential. There is sewerage on the property. Ralph Brasseur explained the lot in question is higher than Mr. Kirkts house and is of no value to Mr. Kirk. There was no opposition to the petition. Mr. Burke moved to take the matter under advisement. Mr. Foster seconded the motion. Unanimous vote. Edward Keeler's application was continued with Members O'Leary, Burke, GJ~m~, Foster and Lund voting. Attorney Alfred Daniels appeared for the pe~ttioner end explained he hsd brought more detailed plans as requested. His reason for the request was the same as before. Mr. Lund asked how much was intended to be spent for the building and was told a mimlmm of $40,000. William Ohepulis, 1018 Osgood Street opposed the petition as he felt the Planning Board should not be able to allow a petitioner to appear before the Board of Appeals again before a two year period. Mr. Ohepulis stated if a restaurant ware allowed it would oreate more traffice problems in the area. He also mentioned the fact that this was an Industrial Zone and should be kept as such. He brought out the fact that the land is not owned by Mr. Keeler. Mr. Burke asked Mr. Daniel~ if Mr. Keeler had an option to purchase the land and was told yes. Ralph Breasseur explained to the Board au Industrial area all=es a restaurant and the only objector was Mr. Chepulis who is no~-conform~. Mr. Burke moved to take the matter under edvisememt. Mr. Lund seconded the motion. Unanimous vote. Mr. Forgetta appeared before the Board amd stated he would like to enlarge his stand. The Board suggested he go to the Building ~aspector aa they felt a hearing was act necessal~, Christopher Agh~ns of Osgged Street requested a hearing for May 11. Mr. Burke moved the Variance be granted to the Estate of Alfred Garneau as no other land can be acquired and it would create a financial hardship. Mr. G41m~ seconded the motion. Vote 4-1. MAr. Foster opposed the petition. Mr. Burke moved to grant the Site Plan Review for Edward Keeler. Mr. Gi~am seconded the motion. U-~4mous vote. Mr. Gilman moved to grant the variance to Oliver Kirk as this conforms to the area. Mr. Morley seconded the motion. Unanimous vote. Mr. Burke moved the meeting adjourn at 9:45 PM. vote, Mr. 6~w~. seconded the motion. Uaanimous
