HomeMy WebLinkAbout1960-11-14Monday, Nevember 14, 1960 Regular Meeting & Public Hea~ing The regular monthly meeting of the Beard ef Appeals was held on M~nday, November 14, 1960 at the Town Building. Members present and voting were: Daniel T. 01Leafy, Chairman, Charles Foster, Jr. Secretary, Rabert Burke, Howard Gilma~ and Associate Memher William Merten. The Chairman designated Mr. Morton te sit in place ef regular member Henry Luad who was absent. 1st hearing. Jehn Shea requested a variation ef the zoning By Law se as te permit the erection ef an apartment development en the premises located en the Nerth East side ef Main Street at the corner of ~llen and Russell Streets. Mr. O'Leary teld the Board ne one had paid for the certified notices to be mailed te the abbutters. Attorney John Willis appeared for the abbutters and said he felt the Beard should dismiss this petitiew with prejudice as u~der the By Law ne eno can appear before the Beard ef Appeals again fer tw~ years. Mr. Burke moved the petition be dismissed. Mr. Fester seconded the motion. Unanimous vote. 2nd hearing. William Sha~ requested a variation el Section 6Paragraph6.32 cf the seniag By Law se as to permit the erection efa single ranch type residence on the premises located at the South side of 0hadwick Street 400 feet distant fr~the corner ef0sgeod Street. Mr. Shann appeared for himself. Mr. O'Leory pointed cut te the Beard Mr. S~r~ts plus were in~d~qlL~te ill that they did net have the required four inch space fer the Beard's signatures. The Board decided in- asmuch as the abbuttars were present that they would ge ahead with the hearing and have Mr. Shan~ ~bm~t proper plans later. A discussion was held on the location ef the buildim~ te be erected. The abbutters, pre~ent at the hearing did not object to the petition. Mr. Burke moved to take the matter under advisement. Mr. Fester seconded the motion. Unanimous veto. Ralph Brasseur and ~ohe Shields eft Sherweed Hemes presented twa applicatie~ fer the December meeting to the Beard. A discussion was held en whether it was necessary for Mr. Shields to file these applications under Sections 6.31and 6.62. Mr. O'Leary said he would check with TewaOeunsel. Applications w~re also received free~Viuc~tAleci and Village LandCompany. Nr. 0'Le~ryread a letter fre~Atterney Charles Trembly asking for an oxtensie~ te the special permit for E. V. DelDuca. An extension was granted as requested. Mr. Fester moved te grant the variance te Mr. Shan~ subject te the presentatiom ef preper plans showing the set back ef 30 feet frem the back lot line. Mr. Gilman seconded the metien. Unanimeus vete. A bill fer $42,00 was signed fer Mary Deher~y. Mr. Fester meved the meeting adjourn at 9:30 pM. Mr. Burke seconded the metien. Unanimous vete.
