HomeMy WebLinkAbout1961-06-19M~nday, June 19, 1961 $~ei~ Meeting A special meeting of the Board of Appeals was held on Monday, June 19, 1961 at 7:30 PM. Members present and voting were: Daniel T. O'Leary, Chairman, Charles Foster, Secretary, Howard Gilman, Harold Morley, Associate Member and Alfred Beeglin, Associate Member. The Chairm~- ~esignated Mr. Morley to sit in place of Mr. Burke and Mr. Beeglin ia place of Mr. LunG, regular members who were absent. Walter V. Darners and John J. Shea requested a S~ecial Permit for an apartment development under Paragraph 4.7 of the Zonimg By Law so as te permit the structiom ef five garden-type apartment structures, each containing met more than twelve units, located at the West side of Chickering Read, rear ef Lund Garden Center. Mr. 0'Leary read the notice. The plans were shown and explained by Mr. Shea. Each building would be 2 1/2 stor~s high, with three floors ef apartments. The project would conform in all respects to the zoning by law. N.r. Shea has an agreement to purchase the land from Henry Lund if approval for the ]~ject is given. The project would be near the new motel en one side, aud the railroad tracks fund along the other side. There are no private houses near the land, which is zoned for industrial use. Mr. Shea explained that the project would be good for the Town, because there is a dire need for apartments in Town and that they would be good for the tax rate. He said he planned to build an entrance r~ad into the project along the railroad tracks to Chickering Road, which would open unused land behind the apartments for possible light industrial development. Mr. Edward Phelan, Chairman of the Industrial Development Committee amd also a member of the Board of Assessors, was strongly in favor, saying the site was one of those his co~tttee had in mt_-d when it presented the apartment preJeo~ zoning amendment to the Town at the 1960 Annual Town Meeting. Water and sewer · facilities are available. Mrs. John Griffin, ~41 Chickering Road, violently oppesed the petitiom. She said she felt she had been be~ ed By the Town officials because, although the area around her home was supposed to be restricted residential land, shesaid it has now become a d~ep. in~ ground for anything they don't want in any other part ef Town. It would mean an addition of 60 new fan1 lies which would bring more children into Town and increase school needs. Harold Morley remt nded Mrs. Griffin that since the land is zoned for Industrial use, anyone could build a factory there without recourse to a public hearing. Mr. Shea said the apartments would be attractive and the rent would range from $120 to $185 a month. Mr. MaA-£~ Mellian, president of New England Industries, ~evelopers of the Merrl_mack Valley Motor Inn, which abuts the site of the proposed apartment project was also strongly opposed, not to apartment projects, but that particular area was becoming tee congested. On seeing the plans, he noted that the apartments would be within 80 feet of the property line of the motel. Ne said the closeness of the apartments would destroy the country atmosphere they were attempting to create. 'Daniel 01enio, 52 Clark Street, spoke in favor ~f the apartments, sa~ing that the inhabitants of the motel wottld be transients, while the apartment tenants would be permanent f~lies making a home in North Andover and said North Andover wants these f~lies. He said he was in favor if it will be attractive. Mrs. Horatio Rogers, 580 Osgood Street, asked if the co~versiow of the industrial area into land to be used for apartments would upset the long range financial structure of the Town. Mr. Shes answered that the apartments were needed as badly as industries, and that the presence of apartments in the Town would be an attractiow to an industry considering location here. He added, that the site, fro~ a builder's viewpoiwt, was the best in the Town for an apartment project, and that if permissiow was denied to build on this site he would not consider buildiag the project elsewhere. Mr. Gilman made a motion to take the petition u~der cowsideratian, secomde~ by Mr. Fester. Uaanimeus vote. 2nd hearilg. O. Osry Moured, MD requested a varia~-o-_ of Section 6, Paragraph 6.2 of the Zoniag By Law sc as to permit an additiew te present building located at ~. 800 Osgoed Street. Dr. Moured showed his plans and explained the meed of two adAitie-~l ro~ms, te provide more space for his family. The house is a ranch-type and the nearest neighbor is 110 feet away. Mrs. Griffin was greatly in favor. Mr~ Gilman made a motiow to take the petitiol u~der advisemont, seconded by Mr. Beeglin and voted u~animously. After the hearings the Board sicussed the petitiel ef Dr. Moured. Mr. 6~=~ made a motion to grant permissiow subject to the proper certificatioz ea the plan of a Registered Land Surveyor. Mr. Morley seconded the motiea and the vote was u~zn~mous. The Board then discussed the petition for the apartments very thereughly. A letter will he sent to the Planning Board along with the plans£er their recommendations. Mr. Boeglin made a motiow to accept the plans subject to the approval and agreement ef the P]~-ning Board.
