Members present and vetiag were: Daniel T. 0,Leafy, 0hairman, Robert Burke, He~ry E. Lu~d, Reward Gi~m~ and Harold Morley Jr. Due te the ~umber ef people present the meeting was continued at the Fire Station Meeting Ream. At 7:45 PM a ~ublic hearing was held whereby Charles Waites requested a variation ef Section 4 Paragraph 4.06 of the zoning By Law sO as te permit the censtrustien efa privated clubhouse on the premises located at 80 Sauaders Street. Attorney Alfred D~a~iels appeare~ for the petitioner and pointed out the petitieaar was at the mercy of the Beard as the building was ef a non-co~fermi~g use. He stated this is a hardship case as the petitioner is out of business amd this is the sole support for his f~m~ly. Attorney D~_~tels pointed out a Club has ~ean ia the neighborhood for m~y years so by re-establishing the club would not be a burdan to the area. Abbutters opposing the variance were: Mr. & Mrs. Stanley Hurr-~, William Hurrell, Hr. & Mrs. De~ald Haigh, Mrs. Eva Rsuthier, Mary Sheridan, Katherine Sheridan, Mr. & Mrs. William Farrell, Mr. & Mrs. John Lyons, Mrs. Yve~ae Whittaker, Katherine Cun~h-m a~d Mrs. Jeha Costelle. They epp°sed the club because of the leu~, vulgar talk that comes from it when people are leaving and because of the traffic it creates. A discussion was held on ne~-co~ferming uses. Mr. 0'Leary explained why Mr. Waites had te come ia for a variance as stated in Paragraph 4.06. Mr. Burke moved to take the matter under advisement. Mr. Lu~d seconded the motian. U~a~imeus veto. The Beard resu~ its meeting at the Town Building. Mr. 0'Leary read a letter from Attorney Charles Trembly aakiag for an exte~siem ef the permit issued to E. V. Delduca. Mr. Gf~- moved te extend the permit with the same conditions until July 19, 1962. Mr. Lurid seconded the m~tion. Unanimous vote. A discussion was held oa the evening's hearing. Mr. Morley m~ved that the variance be denied. Mr. Lurid seceded the motion. Yete 3-2. Mr. 0'Leafy opposed the motion because he felt this is a h_=~dship case as the ~etitieaer de~ends en this for his livliheed and because he dees met feel it is fair a person should be put eut ef business because of the neighbor complaining. Mr. Gilman also eppesed the motion because he felt it is a hardship case. Mr. Merley's reason for the motion was he felt the spirit ef the zoning law ia, with in mind, te eliviate non-conforming uses as the physical characteristics ef the same disappear, since the building disappeared, the area shauld resort back tea village neighberheeA district as set forth ia the By Law.
