HomeMy WebLinkAbout1961-10-03Tuesday, October 3, 1961 Special Hearing A special hearing was held by the Board of Appeals on Tuesday, October 3, 1961 at the To~m Building. Members present and vot~8 were: Daniel T. 0'Leafy, Chai~-m~nt Henry E. Lurid, Robert $. Burke, Howard L. O~lm,, and Alfred Boeglin, Associate Member, designated by the C~trman to sit in the place of ~old Morley. N~.ARING: Charles B. Per~y The hearing began at 8:00 P.M., at which time the D,l~ beard was present. This hearing was in the appeal of ChArles B. Pe~z'~ requesting a variation of Sec. ? Para. 7.23 of the Zoning By-Law so as to permit the placing of a dwell~ being taken by Route 110 on Lot 87 at the corner of Beverly and Union Streets. There were appro~mAtely 15 people present. Mr. PeA:A-y spoke for himself and explained that he wanted the house moved in order to have a place to live since the State is taking all of his land, which is approxLmately 6 acres in different areas. Atty. Oh-~les Trembly represented the Hayes family of 103 Union Street, ~mm~diate abutters to the proposed lot, in opposition to the moving of the house. He stated that this Board does not have the authority to grant the petition. It could only be granted subject to hardship, but this is not a hardship case. He ree~ the petition be denied by the Board. Mr. & Mrs. Charles Smith, 56 Beverly Street, were opposed, saying that the house is old and would detract from the neighborhood and that it was not a hardship cas~. Mrs. William Emmett, 93 Union ~ee~, was recorded as opposed. After a short discussion, Mr. Gilman made a motion to take the matter under advisement, seconded by Mr. L~d and voted Bills were signed for the following: Eagle-Tribune Publishing Co. - $ll.00 John R. Hos~-~ ~ 36 After a discussion of the Perry petition, the Board decided to vote on the matter at their regular mee$.t-~ on October 9, 1961. Since former Secretary Charles Foster was appointed Building Inspector a~d is no longer a member of the Board, Mr. ~rke made a motion to appoint ~a~old Morley as secretary. Mr. Boeglin seconded the motion and the vote was unanimous. The meeting adjourned at 9:00 P.M. AD Clerk
