Safety Officer David Rand cited the need for Ms. Matloux appointment as one of the permanent corssing guards will be out on injury leave for quite some time. Issue Warrant for March 4, 1985 Anhual Town Election The Board voted unanimously to authorize the pos~--~ng of the Annual Town Meeting and the Annual march elections. The Board voted unanimously to go into executive session to discuss the continuation of a firefighter grievance (John Driscoll). LICENSING COMMISSIONERS: ~ichdale Liguor License Violations The Board heard testimony from Officers Stanley and McEvoy, arresting officers for liquor sale violation on March 3 and March 10, 1984, for sales to minors. This testimony was not opposed by Richdale's Attorney, David Bernardin, who reported that owner Wm. Maistrellis plans to install video equipment and will monitor these tapes frequently in an attempt to eliminate this problem. Tbe'~Qa~d"hoted that this is the Sth and 6th such violations since 1980, and voted unanimously to suspend Richdale's Wine & Malt Retail Package Goods Store license for a period of 30 days, commencing January 30, at 8:00 A.M. Licensing Commissioner, Chairman, Kenneth Crouch reminded Mr. Maistellis that a liquor license is a priviledge and not a right, and any future offenses will not be taken lightly by this Board. .One Day Liquor License The Board unanimously approved the request by the Mass. Federation of Business and Professional Women for a one day all alcoholic beverage license for the purpose of holding s luncheon a= Gildea Hall, Merrimack College on March 17, 1985 from 11:00 =o 1:30 P.M, Set Hearin~ on Class II Application/Andre C. Ga~no,, The Board voted to hold a hearing on the application noted above for the premises a~ 7 Hedges Street. Present holder of the license at that location, Joseph Giard, wishes to sell his business to Mr. Gagnon. Atty~amsey Bahrawy asked for a timely hearing, as the sale of the business is contingent upon the license being granted. The Board voted to take this up next week and solicit recommendations/comments from the appropriate boards. Catherine J. Graham, and Kenneth C. Crouch. Selectmen Francis Dugan and Charles Salis- bury were out of Town on business. The minutes of 1/28/85 and the warrant of 2/4/85 were approved as submitted. ~etition for Mill Rd. - Massachusetts Electric The Board unanimously approved a petition by Mass. Electric to install 2 - 3" ducts on Mill Rd. at the intersection of Cider Mill Rd., the purpose of which is ~o supply additional service to 18 new housing units on Mill Rd. Modification of Bxistin$ Traffic Signal - Route 133 & 125 James D'Angelo, Vanassa Hangen design firm, told the Board that the driveway plans hav~ been changed to a wider 22ft. on either side of the raised island, have incorporated keep right signs, and says it is now the same as a standard 4 way intersection. Bayfiled Corp. has said they intend to market the property as a 10,000 sq. ft.b~ildir~. ~suitab~e offi ce space. Sel ectr~n Graham questioned how the To~l can protect i ts interests i f this proposed busi ness requi res a great deal of ~ater or if the property com~s up to be re-zoned this spring. Chief Sullivan requested that "Ixb Right on red" sign be installed also. Essentially, these ~ officers ar~ grieving that d~ ~ferent vacation policies exist for these officers than the rerminder of the police force, in that the 7 officers were credited with 1984's vacation t/me at the start of 1988, and the rest of the force is advanced vacation t/me at the start of 1985 for 1985. The Board requested an extension to February llth to allow for time to respond to this grievance and will provide the Police Association with an answer at the next meeting on February 11, 1985. 1985 continued H~rin~ of Ea, ineer for Holt Rd. The Town was awarded a grant for $319,506 for the design and construction of Holt Rd. NESWC: Designation of Truck Traffic Route to/frcm ~ The Board voted to table action on this item until the next meeting on February 11,1985. Civil Defense Re~s The Board reviewed two proposals to renovate the Civil Defense quarters in the Senior Center, M.~chael Redden for $585.00 and A~juna Construction for $475.00. The Board voted unanimously to accept the bid of $475.00 from Arjuna Construction, however, Selectman Crouch added that no work shell cc~:nence until such time as proper ventilation, is. in'-place. Street Li h_~_~_~ The Board voted to table discussion on .this item until the next meeting on February 11, 1M65. Award of Prating of 1984 'Annual Town~ The Board reviewed two bids received for the printing of the FY 1984 Annuel Town Report: Naiman Press for $29.29 per page; and Town Printing for $24.50 per page. The Board voted unanimously to award the contract for printing to Town Printing at a price of $24.50 per page. Local Arts Cc~ssion - Res~ The Board~ed with regret the resignation frcm Charles J. Carrell frem the Local Cc~mission on the Arts and also the Christmas Decorating Cc~ittee. Constable ~ The Board voted unanimously to reappoint Richard L. Hayden as constable for the Town for a term of 3 years, effective 2-4-85. Museum of American Textile }i~story The Board unanimously approved the request of the American Textile History to close off a portion of Mass. Ave. from Osgood St. to Andover St., on Sunday, May 19, 1985 frem 9:30 a.m. to 5:30 p.m. for the 13th annual Sheep Shearing Festival. Formation of Water Treatment Facili~ Cc~mlittee Selectman Graham suggested the formation of a cc~mittee to stud}' the financial aspect of the proposed'water treatment facility: Town Treasurer, Advisory Board, Assessor, Public Works.~ The Board voted to table discussion on this item until n~ ~aeting on F~orua~' 11, 1985. : LICf~SING COMMISS~ERS: since several abutters were ~n attendance, Chaum~n Kenneth Crouc~ a-lowed time ~or ccm~en= by these abutters. Scme objectors cited the fact that John Dolan was denied a Class II license on the basis of the downtown beautification effort and so beliege~rth~t~Mr~ .Gagn0n Should be denied. It was brought up by one of the abutters that an agre~nant was made with' ~.ir. Giard in approximately 1964 or so that this property was to be returned back to residentiel zoning when ~r. Giard ceased his business. Selectn~n Graham said that perhaps it would not be legal to deny a license once a previous license was issued for the same pr~nises. Atty. Bahrawy, representing Mr. Giard, stressed that the new owner, ~.fr. Gagnon, would be improving the property by rebuilding scme of the structure and repainting, and also would not have a tenant. He added that no more than 5 cars would be ellowed. Chairman Crouch told those present that it is the Board's intention to research this matter further and T~ill send them official notice of the hearing on March 18th. Merr/mack Colles~__R_R~est for 'One~ Licenses The Board unanimously approved the requests of Merrimack College for one day Beer & Wine license for 2-14-85; and one day Beer & Wine for 2-12-85 in the S.t~/dent Union building.
