HomeMy WebLinkAbout1962-07-09Monday - July 9, 1962 Regular Meeting & Hearing The Board of Appeals held their regular meeting on Monday evening, July 9, 1962, at 7:30 P.M. in the To~n Building. The following members were ~resent aha voting: Daniel T. 0'Leary, Chairman; Harold Morley, Secretary; Howard G~lmmn, Henry Lurid and Associate Member Arthur Drummond who sat in place of Robert Burke. 1. HEARING: Roy R. Farr Mr. Morley read the legal notice which was in the appeal of Roy R. Farr, Doris and Edna Fart requesting a Special Permit for an apartment development under Sec. 4.7 of the Zoning By-Law so as to permit the construction of five garden-type · apartment buildings, each conta~ng not more tb~ twelve dwelling units, as shown on the site plan filed herewith, and conforming with the provisions of S. 4.73 of said By-Law and such conditions as may be imposed by this Board; on the premises, located at the West side of Chickering Road as shown on the pre- liminary plan of the site, a copy of which is filed herewith as a "site plau" under S. 4.52, and as a "diagram" and "statement". under S. 4.51 of said By-Law. Atty. ~tephen F. LoPiano, Jr., 500-503 Central Bldg., Lawrence; and ROy R. Fart, petitioner, were present. There were approximately five abutters presemt. Atty. LoPiano and ~. Farr explained the plans to the Board. They discussed drainage, sewerage, etc. Atty. LoPiano said the garden apartments are a per- mitted~use under the By-Law. Ail M,llding will comply with the By-Law. Each unit will cost approx. $25,000. The complete project ~ll ~mount to approx. $500,000 which would mean rexes of nearly $12,000. The neighbors do not seem to object. Mr. O'Leary read a letter from Mr. Muller, 595 Mass. Ave. saying he was in favor of the apartments. Mrs. Lordan, 347 Mass. Ave. was greatly in favor. The other abutters present Just asked questions relaPSe where their ~ abutted the petitioner's. There ~as no opposition to the petition. Mr. Gilman made a motion to take the petition under advisement. Mr. Lured seconded the motion and the vote was ~m~nimous. Atty. Ralph Finck appeared before the Board to request a hearing for a special permit for a gas station for used cars on Osgood St. Retail activity may be prohibited according to the By-Law but he wanted to ask the Board if a special permit would be allowed. Mr. Gilman stated that a gas station is all right, but not to sell cars. Mr. Finck said this is a hardship case and ~ould like to have a hearing. The hearing date will he August 13, 1962. A letter was received from Atty. Charles Trombly requesting a hearing for John & Keidi Indelas. This hearing ~ill also be held on August 13, 1962. A letter ~as received from Atty. Charles Trombly requesting permission to extend the permit of DelDuca Construction Co. to July 19, 196S. The Board voted unanimously to notify Atty. Trombly tb~t an extension will be granted and that a new bond must be filed with the Board of Selectmen. The Board discussed the hearing for Roy R. Fart. and decided that a copy of the plans be sent to the following departments ~htheir recommandations: Board of Public Works, Highway Dept., Fire Engineers, Budding Inspector, Board of Health and Planning Board. The Board will discuss this petition further after all copies ~re returned, at their next meeting. The Board approved a bill for Anna Donahue - $40.00 The meeting adjourned at 8:30 P.M.
