HomeMy WebLinkAbout1988-05-31 Board of Selectmen MinutesThe Board held a regular session on this date with all members present: Chairman Charles A. Salisbury, Christine M. Smith, Kenneth C. Crouch, Robert Ercolini, Francis X. Dugan; Town Manage= Paul Sharon. The minutes of May 23rd were approved as presented. ? ~nd 7ele hone Pe'tition Toby Keiser of Mass. Electric represented the petition to install one pole on Charles St. to provide the capability of a 2nd tie-in to the substation in that area. The Board questioned their involvement since Charles St. is a private way. Motion by Ercolini, seconded by Smith, voted unanimously to approve subject to the determination by the Town Manager that it is appropriate to take action as it relates, to a private way. LICENSING COMMISSIONERS Re___q~est for ~cense The Board unanimously ap--~ved the request of David May of the Andover Marriott for a function on June 9th at Merrimack College, Gildea Hall to benefit the Mass. Dept. of Mental Health. Motion by Dugan, seconded by Ercolini. Request for Transient Vendor Permit Representative of Shamrock Carriers met to request a'permit to sell furniture from a 15 wheel truck; reporting that the items were in a warehouse waiting for delivery to a buyer who has since declared bankruptcy thereby making it necessary to dispence of the furniture. The Board questioned whether the company has been approved by the State. Motion by by _gug-a~, yoted 3-2 to deny the request. (Salisbury, Crouch ~pposed). ~, seconded Paul.Niman re: GLSD Director of Public Works Paul Niman presented the report of Tighe and Bond, which firm reviewed the Gordon Associates report dealing with odor emissions from the Greater Lawrence Sanitary District. Mr. Niman added that he feels the problems are not as severe this year and that the GLSD commission members are becoming moreeducated,~ and have agreed to do whatever is necessary to correct the problem in the future, including not accepting outside septage. AdHoc Committee members Jim MeAloon and Vin Turano'did'not agree that the GLSD will work with the Town, and requested.that the Board hire special counsel to see what powers the Board of Health may have in effecting a solution. Mr. Turano added 'that the plant is overloaded and discharges waste int, the River on a regular basis. He said he has counted ~44 violations in less than one year; and that DEQE is not being strong enough with GLSD because they need the facilit~'to take outside waste. Motion by Ercolini, seconded by~po~.., unanimous to direct the Town Mgr. to hire appropriate counsel as expeditiously as ~%~s~ie. Joe Walsh and ~r-~ Salisbury met to discuss the activities proposed for this year's 4th of July celebration to include fireworks on the 3rd, and a full day of activities, entertainment craft'and food booths on the old common on the 4th. Mr. Walsh added that the rain date for the firewoYks display will be the following Saturday; and that some thought was given'to having a chicken barbeque at the'Middle School prior to the fireworks, but could not find~a caterer to do so this year. Ma. Salisbury added that all town deparmtents have been very cooperative in supplying materials/manpower for the event each year. Approval of Renewal of Bonds Motion by Crouch, seconded by Dugan, to approve the sale of $300,000 bond anticipation notes dated June 3, 1988 payable December 6, 1988 at parand accrued interest plus the premiums indicated as follows: Interest Numbers Denomination Rate Premium Purchaser ~ ~ 5.0-----~-- $295.00 Eastern Savings Bank 2,3 50,000 4-7 25,000 and that the provisions of GL c44, s23 to 24A, 26 and 27 shall not apply to this issue of notes and it is hereby confirmed that the Treasurer has solicited proposals for the notes from at least three financial institutions. Town of Middleton: Cou~ The Board discussed a letter from the Middleton Board of Selectmen requesting suppor~ for their efforts to be involved in the siting of a oounty Jail in that community. It was agreed to send a letter neither supporting or not supporting the Jail, but that North Andover feels that any community being considered should be thoroughly involved, as a matter a public policy. Mazurenko Ac~uisitioq ~ Ercolini raised the idea of having a 21E clearance o~ the property conducted prior to closi~ Motion by Ercoltni, seconded by Dugan, voted 3-2 (Crouch, Salisbury opposed) to authorize an appropriate 21E study be done prior to taking title.
