This vote was based on the Public Hearing held on April 27, 1977. The Board voted to have Brian contact John Robinson, school teacher, ~ho is most in- terested in Cable TV. Applicants will be sought through the advertising LAKE STUDY COMMITTEE: Letter received from the Board of Public Works requested that the Lake Study Committee be re- established and listed goals for the Committee. Selectman Coady made a motion, which was seconded, that the following Board and C~i.,.~ttees be invited to attend a moe~ing with the Selectmen to. discuss the I~ke Study Co,~,,:ttee set up: Planning Board, Conservation Co~,~ss North Andover Growth Committee, and Public Works. RESIGNATION: Resignation of Joseph D'Angelo, member of the Conservation Co,=,,~ssian, was accepted with regret and a letter of thanks and appreciation for his services was voted to he sent to him. R~DEIVED: Letter of appreciation for aid in acquiring Ceta help fr~m F. Rex, Jr., Staff Asst.(School.) Notification of Housing Assistance Availability. Letter from Arbitration Association re N.A. Brian to contact Atty. Ford. Board voted to request funds from the~.Reserve' Fund for Selectmen's Expenses, sum of $1500. · SP~IAL COUNSEL: Letter from Arnold Salisbury reco=ended that Atty. Harold Morley be appointed to represent Board ..re incident of Chief Daw and a firefighter. Morley to set up hearing, after Nay 16 when a I~]1 Board will be present. Town Counsel stated that as it was the Selectmen ~o cons- tituted the appointing authority of the F. Engineers, they had to iniate re~..uired disciplinary :..: ACCIDENTS: actmen necessary. Selectman Coedy would like stops taken to ensure a better safety pattern at the entrance of Village Green Apts. on Rt..125 -~ at Stevens Corner. Letter from Town Counsel advised the Board that the Highway Surveyor may acceptaud expend a gift of i~tnds ~rom Scott Follansbee in the amount necessary to pay for one-half the cost of reconstruction of a portion of .Iacy Street previously agreed to by the Highway Surveyor' and Mr. Follonsbee. Amount to he received sb~11 be deposited with the Town TreaSUrer m~ held as a separte account and may be expended as aforesaid by the Highway Surveyor. SPACE NEED: Selectman Guthrie brought up the fact that more space would be needed because of Town Macring action.. Five Selectmen were voted and a Town F/anner but money was not appropriated for the increased personnel. Board voted Chairman to contact the Planning Board re what space would be needed. LITTLE LEAGUE FIELD LIGHTS: Selectman Guthrie stated that lights were needed for night games at the Litt!~ League £ield s~s requested Brian to find out if there was any state or federal monies available to foot' the cost~ Brlan stated that there was one program that sets up 50% of ~unding. Selectman Coady stated that a hear~_~E should be involved. FIR~FIGHTERS - BOARD OF FIRE ~NGINEERS: OFFICE: Letter was authorized to be sent by Chairman McEvoy to the Board of Fire ~ineers to vacate former Veterans Agent Office at their convenience, by Nay 15 so the Selectmen could carry out the ~C~%cn of the Town Meeting to enlarge Town Clerk's Office. Ceta Workers aid was offere~. for any hea~y work necessary. VERNILE- CHI~' DAW INCIDENT: iUnion~ ~; reported a "shoving/pnshing', incident between a firefighter ~ the Chief Engineer. Town Counsel advised that Harold Morley, Attorney, be appointed a Special Co~.~el at a' hearing to be set up by Mr. Morley after Nay 16th...Morley to represent the Board. APPOINTMENTS: ASST. GAS INSPECTOR - FIRE ENGINEEP~ Selectman ~thrie made motion that the Board of Selectmen appoint themselves as the Board of ~ire Engineers. Motion was net seconded. Selectman Guthrie then made motion that a meeting he set up between the Selectmen and the Board of Fire ~_-ineers. Selectman Coady second the motion. Chairman McE~oy stated that they had covered ~1~ the bases., that there was no reason for meeting, no good would come of another meeting, selectman Guthrie withdrew the motion... Selectman Coedy withdrew the second. Don Fountain, Fire Lieutenant, appeared before the Board e~l =Poke on beb~ of the present Board of Fire Engineers..that there has not been a finer Bd. than the present one...he s%ated that Chief Daw's word,!should he law es he is the head of the department. Selectman Gnthrie stated t~at they have not disputed the fact that the ~mineers have not served right but Chief's actions have cause disruption in the Fire Department persoen~. 2, l 77 (continued) 225 BOARD OF FIRE ENGINEERS: ASST. GAS INSPECTOR: Guthrie continued that he was aware of all the good work the Fire Engineers have done and that he respedted Fountain for standing up. for them. Fountain stated that the Chief and the Fire Engineers have run the department for 25 years without any trouble until the last two years. Chairman NOEVOy pointed out that in the past two years the fireman have had a Union and that it was a ~ole new b~ll game. In the past, Chief's word was law whether the fireman agreed with it or not but there wasn't anything they could do about it. With the Union, they could pretest and had a righ~t to but Chief Daw' and the Fire Engineers would not accept the Unien and, in fact, were ignoring the firefighter's right to negotiate completely as a result, continuous discord and disruption in the department. NcE~oy then made a motion to appoint Guthrie, Fisher and WLlson as the Bal. of Fire Engineers. Guthrie respectl~,l ~ y declined to serve without other members of the Board. NcEvoy then made a motion to appoint Dana Fisher and Stewart WLlson once again to serve as the Bd. of Fire Engineers~ Ooady seconded the motion. Another motion was made to. appoint Edward Scanlon Asst. Gas r~apector for the ensuing year. Notion seconded and vote AGENDA: Notice was voted to be sent out~ onse again, to al~ departments, Boards and Committees, advising them that all matter to be placed om the Agenda for Nonday Night Selectmen's meeting must b.e submitted to the office no later than the~preceding Friday Noon. Any material recemved after this time would be place~ on the/$ext week's A~da. . The Board of Selectmen held~ their regular meeting on ~h~s date with two me~ers present,' Selectman Joseph A. Guthrie, Chairman Thomas J. McE~oy presiding. Selectman Coady was on vacation. The minutes and warrant were approved as submitted. NEW PROGRAM: NVPC: ~etter received from the above-named announcing a new program of Zoca~ Technical Assistance The-~intent ef the program is to provide professional technical assistance to each m~mber community within the constraints of their budget. Each community has been assigned a pr~fessienal staff person ~ho ~.11 act as liaison between the co~.~.~uity and the commission. Board athorized Brian S. to communicate with Nr. Roberts, Planning Board, so the~ may take advantage of the assistance the new program ~ provide. ANIMAL INSPECTOR APPO~MENT: Dr. Edward C. Bo.lger, was reappointed Animal Inspector for the ensa,'l:r,g year. NEE2INGS: Gr. Lawrence Chamber of Cmnmerce, Honor luncheon, Bishop's Restaurant, May 20, 12 Noon. Ne~orial Day invitation to participate, May 30, beginning ~:30 A.M., Middle School. Selectmen wfll make every effort to attend. BLUE CROSS - BLUE SHIELD: Town Treasurer presented the new Blue Cross - Blue Shield contract to be signed. W~TERN ELECTRIC CO.: ~.etter of supporb for the Regional Waste Disposal Plant in North Andover receiwd from Western Electric Co. Board requested copy he sent to Solid Waste Committee and a letter of thanks to W. E. for their support. IN~JSTRIAL DEYELOPM~ FINANCE AUTHORITY: Discussion took place as to membership in the above-named Committee. Selectman Guthrie stated that d~ferent phases of business, banking, co~ercial ami department heads should be contacted. A mixture of talent is needed from the financial world. LA~ STUDY CC~TTEE: Selectmen requested that notices be sent out to the Planning Board, Conservation Bal. cf Public Works and the N. A. Growth Policy Co~m,.~ttee for a Joint meeting to be held on May 24, 1977, at 7:00 P.M. Representative from e~h of the above-named to meet with the Selectmen. Discussion would be the problems with the lake and reactivating the Lake Study C~lu~ssion. NUNICIPAL FACILITIES BUILDinG COmmiTTEE: Disc~us?ion ensued ~rding reactivating the above-named com~ttee. As members of the old co~a.~ttee did no~B~e involved, Selectmen requested that businessmen, Board of Trade, businessmen, commercial and department heads he contacted. SID~ALK BAZAAR: Downtown merchants requested permission to conduct a sidewe.lk bazaar. Selectman Guthrie made a motion that the merchants ~1 be a~owed to have sidewalk hazaar but they zmst make co~m~itment that they are responsible for any injuries that might incur during the bazaar. Keys to the former Veterans Office are due to be handed over to the Selectmen by Nay 15th. LICENSr. IG COMMISSIONERS: Hearing. was held on the status quo of Patti's He3_low Ribbon, Restaurant, ~21.~-Alcoholic license located at 80 Chickertng Rd. James J. McZenis, P.C. representing the estate of the owner of the building was present to state that Patrtcia O'Connor was evicted because of non-payment, of rent, sum of $8,420.48 owed. Nicholas M. DeBitetto, representing the Department of Corporations ~ Taxation stated the licensee has been delinquent in comply- lng with its tax obligations under G. L. Ch. 64B. ~_~ tax registration was revoked en April 14. The Licensing C~,~,.~ssinners voted to revoke the above-named lic~e for the following reasons: 1. As P. The Dept. of Corp. and Taxation has declared you delinquent in c~plying with your tax obligations.
