HomeMy WebLinkAbout1977-07-05 Board of Selectmen Minutes The Board of Selectmen held their regular meeting on this date with all members present; Selectmen Joseph A. Guthri~, John F. Coady with Chairman Thomas J. McEvoy presiding. The minutes and warrant were approved as submitted. MUNICIPAL UNION: Members of the above-named Union appeared before the Board to discuss the 5% Cost of Living Raise voted at Town Meeting. Shoald Union members be paid before the Contract was signed or would they have to wait. Discussion will be continued ate meeting on Wednesday, at 7 P.M. JURY LIST: Anncal~ Jury List, compiled By. the Board's Secretary, was approved for the years 1977-1978. List will be given to Town Clerk and sent to the Salem Clerk of Courts, Salem, Mass..~ BURIED CABLE: Petition received to install buried cable and 2 ducts on Chestnut St. to Blueberry Hill. Hearing was set for July 18, 1977, at 7:30 p.m. RESIGNATION: Letter of resignation received from Stephen Doherty as an Associate Member of the Zoni~ Board of Appeals for the ensuing year as he is employed as the Assistant Building Inspector under the CErA Program. He would like to again be considered as a member after the year is up. The Selectmen accepted the resignation, without reservation. ASST. BNIL~ING INSP~ETOR: Letter received from Bud Cyr, an appointed Asst. Bldg. Inspector, and letter from Charles Foster, Building Inspector, had advised Cyr that, for many and varied reasons that they had frequently discussed, he was regretfully notifying 'Cy~ by letter, that he would perform all the necessary inspections on chimneys, fireplaces and all masonry work hereafter~ built in the town of North Andover. This relieved Cyr of all responsibilities.to the-Building Inspec-- tor's department and since he had no longer any responsibilities, Cyr would not be entitled to any compensation. Cyr's salary is taken from the Building Inspector.s expenses, not salary account. Cyr contended that he and Foster did not agree on the chimney inspections and that if this type of interference continued, the Board should accept his letter as a letter of resignation. McEvoy stated that the Selectmen appoint the Asst. Building Inspector and ~Uestioned Foster's authority to relieve Cyr of his duties. Guthrie wanted to hmow 'if there were some questions whether Cyr should continue to serve as Asst. Building Inspector when elected to the pestion of l-H. ghway Surveyor. Cyr stated Foster, at that time, wanted Cyr to continue. asked if they had a problem with the new State Code. Cyr stated that.he and Fostrer disagreed on its translation. Guthrie stated that if Cyr decided, to resign, Selectmen should look for a person with the same expertise. Selectmen voted to send lctter to Town-Counsel to ~k' answers to the follOwing~ questions: 1. Does the Building Inspector have the authority to overrule the decisions of an Assistant Inspector? 2. Does the Building Inspector have the authority to order his Assistant not to do his job, that is, not to make inspections? 3. Does the fact that the Asst. Building Inspcetor's position is not listed in the Personnel By-Law, and is paid for from the expense (not salary) account of the Building Inspector, have bearing on any of the questions that have been asked? SOLID WASTE: Selectmen Coady brought up cautions relating to the Town of North Andover being future host to surrounding communities as the Regional Resource Recovery Site~ Preparations are going forward and North Andover should be concerned that the project, itself, is properly constructed i and planned for the best interests of the town. U.O.P. has a great deal ~t stake; The Sel- ectmen, Solid Waste Committee and Administrative Assistant should meet to discuss hiring a consulting firm to represent the townts interests, to make sure U.O.P bore the costs , and not the town. Thru ways should be kept at a minimum in North A~ dover. STREET LIGHT: Se.%ectmen voted to haVe a street light survey made for the installation of a light at the entranc?, of Holy Sepulchere Cem.etery. 4TH OF JULY: Chairman McEvoy cemented on the fine 4th of July celebration the Lionts Club had forthe town of North Andover and motioned that a letter be sent thanking them for their efforts. It %r~s so voted. ANTI-RECESsION FUNDS: Brian S. stated that a Special Town Meeting would have to be held after the September payment to use the AR funds for renovation of the Town Building. It was so voted. Request to use Town Picnic area, Sept. 11, rain,date, Sept. 18th, St. Paul~s Episcopul Church. Copy of letter to Planning Board from Town Counsel re police protection of new streets. Request from Mass. League of Cities and Towns for applicants to the Executive Board% Copy of letter to Town Counsel from Tax Collector re delinquent taxes. Letter from rs Ceta funding for s~mer help. Letters and bills for dues in the amount of $1,221 from Mass. Selectmen's Association and Mass. Lea~ gue of Cities and Towns. It was voted to pay the bills. Copy of letter to Chief Daw from Andover Town Manager, J. Maynard Austin stating Andover will con- tinue to honor existing mutual aid arrangements for backup ambulance services for North Andcver until such time as a formal agreement has been developed and approved by appropriate authorities.
