Albis explained that a few of the communities already expressed hesitancy to sign the contract without the host community first signing the contract. He added that any further delays in the project could seriously Jeopardize it. Final conclusion that the N.E. Solid Waste Committee would inform the Selectmen when the contract finally prepared. The officers of the Board voted are as follows: Chairman, Board of Selectmen: John F. Coady Chairman, Licensing Board: Thomas J. McEvoy Cler$ of both boards: Joseph A. Guthrie New Chair~n, John F. Cnady conducted the rest of the meeting. HEARING: DOG COMPLAINT - JAMES ~ A letter was received from the Dog Officer, Ernest Gauthier, requesting.a hearing on Mr. Dunn's violation of the Leash Law. Present were: Mr. E~nest Gauthmer, his wife, Mr. Domn, his dau~her, Mrs. Kulpinski, a f~iend Susan. The Board cslled upon Ernie to state the nature of the complaint. He cited two occasions of speaking to Mr. Da~n. On both occasions, he asked Mr. Damn to restrain & l~cense his dogs. Mr. Dunn refused to do both. Mr. Dunn questioned Mrs. Kulpinski re:. were ~he houses her horses. The B.oard felt this question was irrelevant. Mr. ~ accused Mrs..Ku~pinski of crossing. his property while riding. Mrs. Kulpinski sta~ed that "At no time did my horses leave the roadway. The dogs came onto the pavement and attacked my horses. I asked Nr. Dunn to cs11 of his dogs and was mot with obscen.e language. On the second occs. sion, I had with me a young .rider(S~san) and a horse whmch I was ponyi~g. '"h~?~§s ran off proper~y and attacked my horses. Nr. Dunn was in his filed at this time, but other than y~l somet~g at the dog, did nothing to stop the attack or restrain them. .My colt, in ~is fright, ~,11ed free and bolted a short distance, lost his foo~tng and fell, injuring the colt. I have an older st~]iou that I won't restrain if we're attacked by his dogs again." Chairmen Coady read from Nass Genersl Laws, Chap. 140, S.157 and asked ~. Dunn if he had made any attempt to l~c.ense his dogs. Dunn said he never gets down to town. The Board then moved to order Dunn: "That you sb~11 license your dogs and restrain them to your property." If Nr. Dunn does not conform to the o~der, to .refer to Town Counsel for further action. LETTER FROM GR. LAW. SANITARY DISTRICT The Administrative Assistant, Brian Sullivan, was c,~ ed upon the e~plain the .letters. They were accepted for our files. LETTER OF APPROVAL FROM DEPT OF YOUTH SERVICES A lette9 was received from Dept. of Youth Services. giving approval to juverdle detention. quarters. A copy sent to Chief Lawlor. LETTER FROM DEPT. HOUSING AND URBAN DEVE~PMEN~ Letter received re: 50 units of elderly and handicapped housing. No action taken. LETTER RE: N.A. POLICE UNION Letter received (copy) selecting Paul Dorr as Chin. of the Arbitration Panel for PF 164 North Andover Police (Final Offer). Moved to have copy sent to t~ commsel for his perusal. APPLICATION FOR ADJUDICATION OF OAKES DRIVE Application received and motion made to refer to the department heads for thier co~ents and to submit list of signatures on petition for article to Town Clerk fo~ verification. LETTER FROM CHIEF D~ TO EETIRE Letter addressed to Chairman Coady was read by him of the Chief's intent to retire effective Janm ry 31, 1~78. Moved to accept his resignation with regret and to ~ake action to co~,~omicate to lieutenants of such vacancy and be cousidered.for the posi- tion of provisional Chief. NpVed to open negotiations with firefighters on 1/26/78. Public Works Union negotiations - Jamaury 19, 1978 (swing date - Feb. 2)
