HomeMy WebLinkAbout1978-07-17 Board of Selectmen MinutesThe Board of Selectmen held their regular meeting on this date with three members present; Selectmen Salisbury and Joyce with Selectman Guthrie, Acting Chairman of the SeleCtmen's meeting and Chairman of the Licensing Commissioners. Selectmen McEvoy was on vacation. Selectman Coady was absent due to other committments. The warrant and minutes were as submitted. ~ILY PEREINS: Emily Per]¢ings and her supervisor from the Women's Resource Center appeared before the requesting one BAblic Service Employee slot, under Ceta, from the toxin. The Selectmen agreed to postpone filling the slot until next month. LIGHTBU~: Tom Lightburn appeared before the Board to discuss the installation of street lights in the vicinity of his home and to protest the cutting down of trees in front of his house. The Selectmen stated that there must have been a misunderstanding as the tree department had been instructed to trim the trees, not cut them down. Nr. Lightburn was instructed to send a letter to the Board indicating poles that are not to have any light installed. GAR CORPORATION: Letter and statements received from Atty. Donald F. Smith, Special Counsel, stating that the motion for a new trial, made by the G.A.R. Corporation in action against the town had been denied. The judgement in the amount of $12,000 will stand. 2~VPC: Notice received from the MVPC re a new criterion of Standard Metropolitan Statistical Areas for 1980 census. Seletmen referred the notice to Brian Sullivan for perusal and report. RESIGN~IONS: GAS INSPECTOR -PE~SO~E~ BOA~: Letter of resignation as~Gas Inspector from Mitchell Bootman ~o has been in ~-ll health. Selectmen voted to receive the resignation with regret and to send a letter of appreciation of his serrices over the many years. Selectman Gathrie motioned that a page of the minutes be set aside in homer of Mr. Boctman. Letter of resignation received from Anthony J. Barry as~a member of the Personmel Board citing he could not devote the time necessary to serve. A Letter~o~f appreciation and thanks for his services will be sent to Mr. Barry. ~ GAS I~PECTOR: Three applications were received for the~ positions of Gas Inspector and Asst. Gas Edward J. Gas Inspector. BROOKSIDE HOMEOW~ERS, ASS~8~_.GN: Letter from William Klosek, President, requested advice on how the trees, lawn and planting would be cared for. Letter will be sent to him advising thatthe Public Works Department will provide those services. TOWN FOR~BT AREA: Reques~t_approved to use the Town Forest area for a company picnic, August 2?, 1978, for the Adva~j~Reproductions Corp., Charles Nigrelli, President. CE~A: Letter received re year-round employment and youth training programs from Ceta. The~oard authorized copies be sent to-ail departments. ~ ST. PARKINg: Letter ~eceived from Ron LeBel, President of the N.A. Board of Trade, requesting something be done about the parking-traffic problem of Nain Street; suggested using the hack of the Town Building yard space. Selectmen voted to request Mr. LeBel to recommend three members of the Board of Trade willing to serve on a study committee to solve the problemm. CABLE TV REPOR2: The three-man B~ard voted ik~rther time to re~iew the report and to vote on it at the next wor~ng session on July 27, 1978. GAS EXCAVATIONS: Approved: Petition to excavate on Harkaway Rd. to repair gas maine. S~EP~ RATES: The raise in the sewer rates were discussed at length. The Selectmen voted to write Town Counsel and ask by what authority does the Board of Public Works establish the fo~a~,r determining sewer rates and do they have the authority to deviate from this formula without prior approval from Town Meeting or the Selectmen? Eatsil~s d~o/a Helem's Place, 200 Sutton Street. Ail recommendations were affirmative from the Board of Hem!th, Building Inspector and Chief of Police. The application was taken under advisement on SelectmanGuthrie"s motion to enable others to be aware of this type of license. Approved: One-day beer license for company picnic, August 27, 1978, from Charles Nigre!li', President, Advance Reproductions Corporation. Approved: Letter from Charles Foster, Building Inspector, advised the Board that the premises of Henry J. Fary d~o/a Winston's had been approved and license could be re- leased · LTA TIME: Letter voted to be sent to Town Planner, Leonard E. Phillips, Jr. to advise him that the Selectmen voted to table action on designating the distribution of LTA time until the SCS hms completed the necessary inventories for the recreation and open space plans and the Selectmen have had a chance to disc~s the ~ork with the SCS. It is the Selectmen's impression that some LTA time will be necessary to provide some guidance ami assistance to the interns who will be worP~ng on the plane. The Selectmen, until it is lmown Just how much time will be necessary, phefers to defer the question on allocation of LTA time. SPRI~E~LER S~BTEM: Bids for renovating the sprinEler system reviewed, two were .~b.e same, almost, in cost.. $23%0. and $2397. and the thi~d bid extraordinarily high, $7,3%0. Brian Su21ivan re- ported that there are not sufficient funds in the renovation budget to pay for this cost but there is a possibility that funds, allocated to pay for ~the contract with Whit- man and Howard, could be used. To date, a reply from Town Coumsel has not been received on this question. POLICE CONTRACT: Brian reported that the Union has requested a meeting to discums the issue of using regulars before reserves. This is the only issue remaining in negotiations. POLICE CAR BID AWARD: The Selectmen unanimously voted to award the bid for two police cars to Derry Chrysler- Plymouth, Inc. of Derry, N.H. who submitted the lowest bid on the police.~cars. Bid: $9,980.00. Bid from Shawaheen Motor Nart, Inc ...$11,121.00. . . PETITION-VILLAGE GREEN RESID~S: . ~.etter received with 90 signatures of Village Green resmdents citing, tH~ hazards for the young and eI~r!y trying to cross E~. 125 to the ~ichd~l~' Store. Letter s~t~~ that it someti~esotook % minutes to cress. They requested flashing yellow, 'warning lights and a pedestrian, crossing button. Chairman Coady stated that a similar request had been submitted some months ago and that the state had rejected the request. Selectmen request'ed data on the matter be looked up. Chief Lawlor advised that a request should be sent to the Sta~e asking for flashing green lights and a pedestrian, activated button to change ~ . the lights to red. CGMPLAINT-DANIEL NETTI: Daniel Netti, 10% Hillside Road, appeared before the Selectmen stating that unauthorized drainage pipe had been installed on bis property. He stated that the Highway Surveyor had installed drainage pipe which emptied ~ater on his property. He sta~ed ~hat he would be agreeable if the'pipe was e~tended through his property to the ~ods. Cyr also installed manhole ~ich prevents him from putting in a driveway. Said. he been patient for 8 year§ but is now his ~TTI COMPLAING (continued) ~' ~ ~ Netti stated that they took the mnhole out and left a huge; dangerous hole and Cyr won't do anything about it. Cyr requested Right of Entry before he enters property again. Netti said he didn't know why Cyr requested easement as he had entered proper~y many t~mes before it...that he would give him a verbal permission .... he wants pipe on his property removed or extended to the woods.: ..said manhole was useless, hole was 4 to 5' deep and cannot park ear. He would like Town Counsel's advice. Selectmen stated t?..~t they cannot orde, an elected official to do anything and could not ask To~en Counsel in this matter for advice. Selectman Salisbury and Joyce will view the problem at the site. TAX TITLE PROPEF~IES: Letter from Tax Collector Dewhirst requested authorization from Selectmen to dispose of three tax title properties. The Selectmen voted to authorize Mr. Dewhirst to dispose of two of the three tax title properties, Green Street excluded. The minutes and ~*arrent were approved as submitted. FIRE E~BINE BID: Only one bid was received submitted by Paul J. Hobson, Andover, ~.hss. 9A Chestnut Street. The Selectmen voted to refer the bid to the Board of Fire Engineers to see if bid can be accepted for the bid was lower t~au the minimum bid requested, $1,000. Hobson's bid was for $600~00. CO~CIL ON AGING: Emily Murphy and Joe Kelley appeared before the Board to discuss what Steps must be taken to persuade the Trustees of Reservations to assign the Community Center on Johnson Street to the Council On Aging. Council needs the space especd~l~y on clinic day, and for their many activities. The Board fina~ y voted to have Brian contact the trustees to try~ to expedite the occupation of the Center by the Council ~n Aging. Resignation received from Mary Windle as Clerk of Precinct I. Ma~. l~;ind~ has been appointed a member of the Board of Registras and can no longer serve as a Clerk of Precinct I. Board voted to have letters of thanks and appreciation sent to both. T~ PICNIC AREA: Selectmen voted'pe~-~.~ssion to Firefighters local 2035 to use picnic area on Sept. 10, a Letter will be sent to ~Y. Iminski and the two Chiefs. T(Z,~N ~CHANIC~ Letter received from the Personnel Board re job description for a To~a Nechanic. T~ey stated that in order for tbeirBoard to draw up a job description, it would help i~ they knew to which department the new job description would be placed for supervisory purposes and priority of work ~ssignment. With this information, a description can then be prepared with the proper classification grade being assigned. Board asked Brian to check with the Board of Engineers and the Highway Surveyor on the matter. JUROR:' Venizelas V.
