The Board of Selectmen held their regular meeting on this date :,ith ~'~ members present;
Selectmen Outhrie, McEvoy, Joyce ~.~th Chairm~n Coady presiding. Selectm~n S~lisbury attending
school in N~J York. The ~.~rrant and minutes were approved as submitted.
STREEI LIGHTING:
Selectmen approved the first three categories involving 27 streets for inst~l]ation of street
lights. They ~.~!1 be submitted in the future to Mass. Electric Company for installation of
sase. Brian S~l~ivan advised the Board that $5000. ~ll be available for new street lights.
SOVEREIGN 1~.D~ITY I~'~:
Letter received re the above-named law from Superintendent of Schools, Peter Garofoli. He
requested, on beba~ * of the School Committee, to be advised as ~nether the Town has any plans
to provide some plan for liability coverage in the event that some suits are filed against the
School Co~mldttee or individ~o_~ s x. dthin the School Department. They are quite concerned with
the changes as outlined in the Sovereign Ymmmu~ty Lax¢. Board authorized Brian to confer
Richard Lafond on the m~tter.

Letter from Tox.~ Counsel advised the Selectmen that, since there are no titles involved in
the vehicle, a transfer from one de.~rtment to o.nother would be proper. He ~u~gested~ ho~.~eve¥~
that the minutes of the meeting of the Board of Fire ~_ueers should reflect the fact that
they did vote to transfer jurisdiction of this m~chine to ~. C2~ as head of the Highx.my Dept.
The Selectmen voted to send copy of the letter to the Fire .Engineers.
S~0P SIGN-PLEASaNT AT STEVenS:
Approval received from S. Eidleman to have Stop sign inst~ed for northbound drivers on
Pleasant Street at the intersection of Stevens Street. Three attested copies of the Genersl
L~m ~.~ be sent to the State Dept. of Public Works.
GAS EXCAVATION:
Petition approved to excavate on 80 Chestnut Street to inst~ a gas service. Notice received
of s_~ excavation on Turnpike St., intersection of l~averly Rd.
SII, B_STREEI LIG~E:
Letter from C. Randelph Sims, Jr.~ 134 Beacon Hi~ Blvd. st-,ted that he had requested a street
!ight i~tmlled at the end of the Beacon H~ Blvd. Last month, a light was inst~l~ed at the
asd of Baystate Road and he ~..~ndered if the light wns the one he requested and inst~ed on
the ~mong road. Board asked that the matter be investigated.
CH~.TN LRH~ FENCE:
Letter from Bud Cyr requesting advice as to ~ose responsibility it x. ms to erect the necessary
cb~in lir~k fence along the Sutton Street sp~..~y. Numerons cslls h~ve been received re the
inst~lsation of the fence, Board voted to send letter to Town Counsel to determine whose
responsibility it was to erect the fence, the Toxm or Charles I~tses.
CHAPTER 90-STATE AID:
Letter from the Highx. my Surveyor listed the following streets to be eligible for Ch. 90
for the years 1979 and 1980: Continue the reconstruction of Ss.lea St. to the Middleton
Corrective drainage and re-surfacing of Gre~t Pond Rd., Dale St., Waverley Rd., Johnson St.~
Main and Sutton St. and Mass. Ave. He stated that no funds had been ~l~ocated for Ch. 90 for
fiscal year 1979 and 1980. He requested the Board to contact the local representatives asking
their help to secure the necessary funding.
.~crQrOBLICAN TOWN C0~ITTEE:
Letter received from Chairman of the above-named Co~mittee stating the precinct workers were
no~ divided eq,~l~y as to ~arty affiliation. The Selectmen took the matter under advisement
and ~11 meet with the Chairmen of both parties in the future.
LICENSING COE~SSIO~RS:
Hearing: Almar, Inc. d/b/a ~ggie's. Hearing on the tax delinquency of ~ggie's was held at
the request of the Department of Corporations and Taxation. Brian James, 1716 James Street,
Methuen, M~ss. Ess present. He stated he was representing Mr. Monahan, proprietor of ;~hggie's
and asked for a continuance. He explained that he was in the process of negotiatin~ the pur-
chase of the zestaurant. Nicholas DeBitto, representing the Dept. of Corporations and Taxation
x.ms present and the Board asked him if he would be opposed to a continuance of the hearing un-
til October 23, 1978, at 7:30 p.m. He stated that he did not object to the continuance but
Mr. James should know that the restaurame&owed ~12,500 in meals tax alone. It ~ms so voted
that Mr. James would have the continuance of the hearing until October 23, 1978, at 7:30 p.m.
Mr. Coady did not vote.
Application received for the storage of diesel and regular gasoline at ~ss. Electric Company.
Hearing ~as set for October 16, 1978, at 8:30 P.M.
The Peacock Restaurant proprietor appeared before the Board x~ith the necessary approvals of
the Board of Health and the Building Inspector. Voted 3 to 1 to grant the license with the
pro-rated fee of $200. Selectman Guthrie voted against the license...stated that there should
not be asy more establishments on Rt. 114 because of the heavy traffic. Board and Secretary
~¢ere invited to Open House at the Peacock on ~ednesday, October 4, from 4 to6~ p.~.
