Salsibury: Ralph R. Joyce ~.rlth Chairman Joseph A. Guthr~ presiding. Selectman Thomas J. McEvoy was absent. The minutes and ~mrrant were approved submitted. 4th OF JULY CONMITTEE: Letter from the above-nsmed committee asked the opinion of the Board as to when to hold the 4th of July celebration as the 4th falls on a Wednesday. The Selectmen voted they would the 4th celebrated the evening before the 4th and on the 4th of July. APPOINTMENT R~EST: Letter received from Frank Dushame requesting consideration of an appointment to the el Board when vacancy occurs. Placed ou file until time of appointments. SOT~rn WASTE ACCESS ROAD: Letter received from the I.~PC re study of access to proposed Northeast Solid Waste Recover2 Facility. Letter addressed to former Chairman Coady. Board voted to send letter advising of present Chairman. Letter from Dept. of Housing and Urban Development notifying Board of Housing Assistance A~ailability. Board authorized Brian to confer x. rlth staff on the matter. Copies to be made. I~SS. LEAGUE OF CITIES & Letter x.rith Joint operations report to fill out. be placed once more on next week's Agenda. Letter from ~flrPG received re small cities community block grant preapplication. Brian S. stated that the applications ~.~ere set that if there ~,ms anyactivity required by Board he mould advise accordingly. ,taxes. SA~ITfutv_ DISTRICT: Discussion ensued re the unused funds appropriated by North Aniover and L~wrence to the Gr. Lawrence Sanitary District. The Selectmen feel that the to~nls that did not overcontribute should not receive any of the funds that have been unused. Selectman Joyce mad~ a motion ~.;hich ~.~as seconded by Selectman Coady that a restraining order be issued to the Gr. Law. District tp prevent them from distributing the funds until the to~.n%'s questions are armucered. Joyce stated that it x. muld act as a pressure naa~Ure x.~%ich x~uld expedite the fair distribu- tion of the un~%Tended funds; that he felt the action necessary because the GLSD had not acted on the Board's proposal presented at a January 16th meeting ~,rlth the GLSD. The vote for the restraining order ~,ms 3 to 1 .... Joyce: Coady and Guthrie: in favor, Selectman Charle,, Salisbury, against the motion. NcEvoy x, ms absent. Selectman Salisbury disagreed with the Court action saying that it x. ms unnecessary at this time, that there ~.ms mo strong that GLSD wasn't doing its job and c~led the court action too aggressive. Selectman Coady stated that it ~s a protective action that Just prohibits the distribution of funds that belonged to North Andover and La%r. rence and that the court order coul~t be lifted at any time. The Board were also concerned that the City of Lax.~ence, x.;hich stands to gain from the Board' proposal, had not: as yet, responded. The Board voted to have Tox,m Counsel take the case and to serve the restraining order. Henry Bennett: Appeared before the Board seeking advice re a t~xi cab service in N.A. that he ox,med several cabs in Laxc~enoe and x~uld like to locate in N.A.
