KatsiPms, d/b/a Helen's Place, 200 Sutton Street, for an all alcoholic, Restaurant license. They are presently holders of a trine and beer license to be drunk on the premises. Selectman Guthrie objected to the application stating their place vms too small, only five tables, that he, Katsi]~s, was tr~rlng to pull a fast one. Selectman McEvoy objected to the assumption...stated that Eatsil,',~s business is enlarging and because of many requests from business men in the office park situated behind his restaurant ~.:ho have lunch daily at Helen's Place, he asked ~Lr. McEvoy the procedure to acquire an all alcoholic license. Nr. Guthrie asked that a menu be obtained from the eating place. Notion was made !to hold hearing on June 18, 1979, at 7:30 p.m. To be advertised and abutters notified. It was a majority vote, Guthrie abstaining. · APPROVED: 1-day liquor license for a ~.redding reception at the B.U. Conference Center, June 9, 1979 from 12 noon to 5 p.m. from Jeanne O'Gorman, 174 Bradford St., N.A. Application for storage of 4000 gals. gasoline from Brooks School. BO~ELLI'S I,~IN STREET LIQUOR STOP~: Letter received from Bernard Ze!itch, Phblisher of The Citizen, to explain large ad in last week Citizen which stated that Sandra and Robin Munree x.~ere the proprietors of Main Street Liquors. Zelitch stated that it should have read that J. Bonslli was the proprletor not the Munroes. Selectman Joyce made a motion that Bone!~i be requested to clarify, in ~.rriting, his business relationship (or lack thereof) ~.rith the Hunroes, by June 18th. NcEvoy second the motion and the vote was unanimous. ~~ ' '(Z.~ COUNSEL APPOINi~D;T: osb,ers present from the designated Conmittee to appoint Town Counsel for the ensuing year were e~ Dewhirst, Edward Phelan, Daniel Long, William Chepulis, William Cyr, ~L%rk DiSalvo and eph Guthrie. John Thompson, Jr~ appeared after the voting was concluded. There was only one applicant for the position, the present Town Counsel, John J. Willis, Jr. Phelan made a motion to appoint Mr. Willis, which was seconded by Chepu!is, vote unanimous. Request of Mr. Willis was discussed. He requested inclusion into the Town's Blue Cress-Blue Shield program, in lieu of a raise in salary. After discussion motion made by DiSalvo, seconded by Phelan that Town insurance policy be amended and that Town Counsel be included in the Town's insurance program. Vote unanimous. J. Dewhirst requested a letter from the Selectmen confirming the committee:s action. John Thompson wanted to know how long a department had to wait before getting an answer from Town Counsel to their communications. His availability was discussed, also. Committee stated that Town Counsel should inform Brian when he was out of town and not available, and should be advised that all letters to Town Counsel from to~m departments and committees should be answered within 30 days. TRDOP 87: T~o groups of Troop 87 requested permission to use the To%m Farm area June 2]. and June 23rd. Both groups also asked permission to use Stevens Pond for canoe practice. Permission granted subject to the approval of the Public Works Dept. Public Works advised later that permission to use Stevens Pond for canoe practice was denied, but use of To~*n Farm area approved. Police and Fire Departmentm were so advised. DOG OFFICER: Dog Officer, Gene Northam, appeared before the Board to discuss his expenses which have doubled in one month, the first month he x.~rked as the Dog Officer. He stated that tours of the schools made twice a day and he was answering complaints. He was told not to cruise around tox. m and go to the School grounds unless he was called...to answer calls only. This procedure ~3T down on his mileage and keep him ~*ithin his budget. Issuing warning tickets and charges per offense were discussed. Motion x. ms made and seconded to authorize Brian to prepare a transfer from the Reserve Fund to pay Dog Officer's expenses through July 1. It was so voted. BD. OF APPEALS APPOIN~.~D~S: Tae appointment of two or more alternates for the Bd. of Appeals wa~ tabled until the ~.~rking session of the Selectmen, June 25. Copies of applicants trill be sent to members of the Board. POLE LOCATION: Approved: Installation of 7 poles on Oaks Drive. TOPICS AGRE~2.~EI,~: The Board of Selectmen voted unanimously to sign the Topics Traffic Agreement upon motion .of Selectmen Joyce, seconded by Selectman Salisbury. It was also unanimously voted to authorize Brian S. draw up and advertise the necessary amendments to the Traffic Rales and Regulations of the To~ra. JU~.~E 18 1979 (continued] ll0 SERGEANT APPOINT~,TTS: Letter received from Sgt. Charles ~Cubbin advising the Board of his coming retirement. A letter of thank~ and appreciation for his faithful services will be sent. Letter also re- ceived from Chief Donnelly recommending three officers for promotion to the position of Sergeant .... James Carabello, Thomas Giaquinta and David Rand. It ~.~s motioned and second to interview applicants at the working meeting on June 25 at 20 minute intervals starting at 7:30 P.M. It x.ms so voted. Letters x.~ill be sen'[', to applicants advising them of their time of interview. P~0VISIONAL P. ATRO~T: Two reserve patrolmen were appointed by unanimous vote..Patrolman Green and Lawlor, Jr. It was also voted to send letter to reserve patrolmen, T~ioha~d L. Geleazzi and Paul J. GaLlagher requesting they indicate, by letter, whether or not they were interested in accepting an appointment as a provisional Patrolman working a f11~1 time shift until a Civil Service list is available. BFAT~Y C O~T~I~TT: Mr. Beatty, 655 Waverly Bd. appeared before the Selectmen requesting a cease and desist order on all Archdiocese construction on Waverly Rd. until drainage is corrected. His property is being x,ashed away because of the lack of road drainage and construction. Cyr, he said, cleaned out the stem drains but it didn't do any good because the road is not finished. .~fter considerable discussion, it was voted to ask Cyr~ Highwmy Surveyor, to inspect the situation and report whether or not the builders are complying ~rith state erosion specs. If not, the B card ?~ill contact the Housing Appeals Board. BARKER FA~ ACCEPTA~EE: The Board of Selectmen voted unanimously to endorse the Barlmr Farm applicati on for accep$ tance under the Agricultural Preservation Restriction Act. A discussion ensued as to who would provide the necessary legal services to preserve or protect the interests of the Town, Selectman Graham made a motion, seconded by Selectmen Salisbury, to provide Counsel for the necessary legal services~ cost not to exceed $1,000. It was a majority vote, 3 to 1. Guthrie opposed. GO SL~Y-CHILDEEM"SiGN~: Requests received for the above-named signs to be installed on Concord and Court Streets. Requests were approved, safety officer will be so notified. CONSERVATI(N COM~SSION: ~'~ETLA~,DS PROTECTION ACT: Letter received from the Conservation Commission which contained a proposed, new policy involving the enforcement of the Wetlands Protection Act. The Board voted to meet with the Commission on July 2, at 9:00 P.M. They specifically requested that A~ members of the Conservation Commission be present at the meeting. ASST. BLDG. INSPECTOR: It ~ms voted unanimously to confirm the ~ppointment of Wilfred Chaput as Assistant~ Bldg. · . Inspector. ' ~.~ EXCAVATIONS: The Board approved the following gas excavations to install gas services: Chadwick at Sutton Lots I & 2, 447 Stevens St. and 12 Trinity Court~ Inglewoo.d, Spruce,Boxford,~IilkGreene, Hillside A~..~eath ~oad. FIREFIGHTER' S AGREEMENT: It was the unanimous vote of the Board to authorize the Chairman to sign the Firefighter's Agreement. ' LIBRAR~ INSURANCE: Letter received from the Trustees of Stevens Memorial Library for au insurance review. The matter was referred to Richard Lafond. POLICE SERGEANT EXAM: An examination announcement re the promotion to Police Sergeant received from Div. 'of Personnel Administration. It was voted to authorize the Chairman to sign the form and return to Civil Service. RECE~¥ED: Request for replacement of Ceta Worker at the Merrimack Valley Textile Museum. Sent to Ceta. Letter from V. Cantons, P.E. re truck traffic on Marblehead St. Letter from Civil Defense Director stating he had complied with Board's reques~ for pro- tect~.~n of the Town Garage and Town Building. Letter from Commission Against Discrimination re xeater supply grant, Ch.406, Acts of '78. Application for School Crossing Guard position from Karyn Bleszinski. Referred to Chief. JUNE 18, 1979 (continued) LICenSING C~rSSION: HELE~"S RESTAURANT: A hearing was hold ou the application for a Restaurant, All Alcoholic license from George C. Katsil~s d/b/a/Helen's Place, 200 Sutton Street. Katsikas presently holds a Wins and Beer license to be drunk on the premises. Letters from the Building Inspector and Board of Healhh stated the restaurant was in good condition. It was a unanimous vote to grant the all al- coholic license. PEACOCK RESTA-~U~ %~'.~ TRANSFER: The Licensing Board received an order from the Alcoholic Beverages Control Commission to transfer the license of The Peacock Feathers, 733 Turnpike Street to Snack Eteria, Inc. same address. They stated the reasons given by the N.A. Licensing Boar~ to deny the trans- fer were not valid. Motion ~,as made to transfer the license and seconded which was amended by Guth~_e. · .to restrict entertainment, restaurant space, not to be increased and to restrict hours of opening to 12 midnite. Amendment defeated, 3 against, 2 for. Selectman Graham stated that if this restaurant was to be restricted in operation hours, all other license restaurant holders should be restricted. Motion than made that the license be granted with the stipulation that the floor plan not be changed, hours not to be amended. ~oteo",~s h-1. COMMON VICTUALER LICenSES: Applications approved for the renswal of two Common Victualer licenses: Stand and Jean Chiarensa for the Stevens Pond C oncession. Treadwell' s Ice It was voted to send letters to all license holders that the Licensing Board intends to direct the Police Deparbment to vigorously enforce their hours of closing. I~EARING: Selectman Joy6e made a motion to notify the three license holders on Rt. 114, Cahoots, Inc. Snack Eterla, Inc. and Tnompson's Restaurant that a hearing %~ill be held in 4 weeks, July 16 to consider restricting all licensm on Rt. 114 to 12 midnite. Selectman Graham stated again that it would not be fair to restrict only three license holders, that all restaurants should' be treated equally. Guthrie seconded the motion to hold hearing on matter in 4 weeke. Vote ~ms 3'~3 ~in favor, 2, against. Clerk. July 2, 1979 Tae Board of Selectmen held their regular meeting on this date with all members present. The warrant and minutes ware approved as submitted. JUEY LIST: Voted to approve the j~ry list for 1979-1980. JURORS: Drawn for jury duty at Surperior (Criminal) Court, at Salem, for July 23, sitting was: June ~ilson, 28 Pleasant Street. Drawn for jury duty at Superior Court at Newburyport were: Andrew J. Sourcy, 485 Andover Street, Joseph A. Boar&man, 16 Silsbee Road, Dorothy M. Callard, 27 Putnam Road and Robert~. M. Midglem, 11 Putnsme Road. BALLOT CLERK, PRECINCTS: Motion was moved to send letter to Marjorie Heider, in how much we appreciated her time spent on pmcimct III as Ballot Clerk. ~e are deeply sorry to see her go. REAPPOINTMENT OF CONSTABLES FOR 3 YEARS: It was voted to reappoint David and Joseph Axlerod as Constables for a period of three years and approve their bonds. NOTICE OF SOLID ~,;ASTE FACILITY: A meeting will be held Wednesday, July il, 1979, at 4 p.m., Town Hall: Al! Selectmen that can make it will attend the scheduled meeting. APPOINTM~NT OF PROVISIONA~ POLICE SERGEANT: The Board voted by ballot to appoint officer David Rand as provisional police sergeant. The vote was as follows Ralph Joyce, Joseph Guthrie, Charles Salisbury voted for Rand. John Grahmau and Thomas McEvoy voted for Carabello. LETTER FROM PAUL J. GALLAG~ & ~YKCHARD GALEAZZI RE: PROVISIONAL PATROL~L~N: Received letter from Gallagher and Galezzi concerning appointment as provisional patrolmen. Gallegher indicated he was interest'ed in the appointment. Galeazzt was not. Voted to send a letter to Gallagher offering him the Job of provisional patrolmen and to inquire as to what arrangements he would want to make with his precent employer. COURT STREET TRAFFIC PROBLEN~: Received letter fr~. Fins. Charles Thompson expressing concern with traffic safety problems on Court Street. She :sted that Slow" signs be on the street.
