One-da ?ine license: Application received from Mr. $chaker, candidate for
~ch~ol Committee, for a 1-day wine license for reception to be held at the
Merrimack Valley Textile Museum Friday evening, February 27th. R. Joyce
wanted to know if Tom Leavitt had been contacted by Schaker for permission

MARCH 2, 1981
The Board of Selectmen held their regular meeting on this date with all members present.
Pre.sent were Selectmen Charles A. Salisbury, Ralph R. Joyee, Thomas J. MeEvoy,
R. Louis DiFruscio with Chairman John W. Graham presiding. The warrant and minutes
for February 9, 15, & 24 were approved as submitted.

INCREASING BUILDING FEES:
The Building Department's Article to increase fees was unanimously approved by the Board
after a discussion was held with the Buil(ling Inspector. It was noted that the seleetmeh
can'set the eleetrioal and gas fees but building fees must go to Town Meeting.'
COMMITTEE STUDYING LAND USE DEPTS. - REPORT:
Ellis Fitzpatriok, from the Committee to Study Land Use Departments, presented his
committees report to the Board. The report essentially proposed to make some administrative
ehanges to improve the coordination between the Land Use Departments. Through an Article,
they are proposing to hire a full-time Coordinator who would serve as the eommunieation
link between all of those departments. The Board voted to reeei..e the report and: take it
under advisement and thanked Mr. Fitzpatriek's committee for a job well done.,
COMMUNITY DEVELOPMENT OFFICE:
The Board voted to create an Office of Community Development. Appointed GaYt0n" Os~ood
as its Director and authorized Gayton'to advertise for the positions of assistant administra-
tor and full-time secretary. '
STREET LIGHT REQUEST ON ELM STREET:
Mr. & Mrs. Rizza, who are building a home on Elm Street, requested a street ligl{t :in' f~ont
of their house because of all of the damage that has been done to their house. Selectmen
DiFruscio suggested that we put a brighter light bulb in the light that is already at the
corner of the street and maybe angle the light so that it shines down the street..' If~there
was a problem when the leaves came out on the trees, possibly the Tree Dept. could help out.
It was suggested that if a light was put in front of the Rizza's house it would probably:be
only a matter of time before the kids shot the light out since they were already shooting
metal ball bearings through the Rizza's windows. It was unanimously voted to.top.lace the
weaker light and to alert the Police Dept. to continue servailance. ' ' ''
CARL THOMAS BALL FIELD: * ~' -'
Joe Walsh called to the Boards attention the problem with kids congregating at the Carl:'.
Thomas ballfisld after dark and vandalizing the field and suggested that an"off-limits after
dark? sign be posted there. Since there is a by-law that says persons are prohibited from
trespassing on parks and playgrounds after dark, the Board voted unanimously to .put:a
sign in there. · ~
USE OF COMMON: ... -' -.
A request was unanimously approved for the use of the Common for the North Essex Council,
Boy Scouts of America to hold their annual Scout on Wools Bike-a-thon on April 11, 1981.
The Common to be used as a starting and finishing point and the use of electriciSY for ~their
C.B. Radio Base Station.
ARTICLES RE: TRANSFER STATION AT HOLT ROAD:
Ed Scan]on requested to speak with the Board concerning the citizens Articles for a transfer
station at Holt Road. He felt is was very peculiar for a citizen' to originate such. an Article
and wanted to know if the Board knew anything about it. He also wanted to know if the
Board was going to take a position on the Article. The Board indicated that they had not
had an opportunity to review the Articles yet, but they would be taking a position on them
prior to Town Meeting.
STATE CHAMPIONSHIP FOR WRESTLING:
Selectmen McEvoy brought to the attention of the Board that Al Belanger, North Andover
High School, has won the State Championship for wrestling for the past 3 years. A m6tion
was made and unanimously approved that A1 Belanger be so recognized by the Board for his
feats and his continuous outstanding wrestling and that a letter be sent to him via Mr. Crozier
from the Board.

LICENSING COMMISSIONERS:
HEARING - LOFT RESTAURANT RE: VIOLATIONS OF THE LIQUOR LAWS:
A hearing was held with the management of the Loft Restaurant re: violations of the
liquor laws. Two separate Police reports were filed from incidents happening on
February 15 and February 21, 1981, stating that the police walked into the Loft at 1:30 a.m.
and saw people still in there with drinks in front of them. Paul Cassidy, part owner/
manager, .stated that he never knew about the first violation when the second one occurred,
if he had, he wouldn't have let the second incident happen. He stated that the people
in the building were friends of the bartenders. He said that last call is between 12:30 and
12:40. Sometimes it's after 1:00 a.m. when people finishing consuming their drinks. Since
this wasn't such a serious offense as if they were serving to minors, the Board was willing
to treat this as a first offense even though they had 2 complaints against them 2 years ago
when they were first starting up. It was mentioned that any violation of any sort in the
future may result in losing their liciense and if they have a communications problem, they
had better straighten it out. Voted to send a written reprimand to the Loft management
with a copy filed with the Town Clerk. As there was some uncertainty as to the definition
of the 1:00 a.m. closing, a motion was made and it was unanimously voted that the Board
notify the local establishments of its policy that liquor be removed from all tabled by
1:00 a.m. and that no liquor be sold or consumed after this time.
GAS PERMIT:
A request was received for a transfer of the gas permit from Sun Oil Co. of PA to Sea &
Wharves, Inc. at the corner of Osgeod & Clark Sis. The Board unanimously voted to
grant the transfer pending a letter from Atty. Norman Shack on more details on this.
ONE-DAY LIQUOR LICENSES:
An Application was received for one-day liquor licenses from William Courtney, President
~82 Class at the Last Class Pub, Merrimack College, on March 5 and March 24. It was
approved by Rev. Joseph F.X. Gillin, O.S.A. Since the two licenses fell under the Boards
20 limit, the request was unanimously approved.
"SPACE INVADER" GAME - CRYSTAL MANOR:
Application was received for a permit to have a "Space Invader" game from Nelinda DeCola
at the Cystal Manor restaurant, 80 Chickering Road. Selectmen McEvoy was opposed
because last week the Board would not allow Star Pizza to have a permit because of the
scho.ol kids' that would be hanging around there. He felt that it wasn't fair to give it to
one establishment and not the other. It was mentioned that you are dealing with an adult
situation at the C~nystal Manor. The board voted 4 to 1 in favor of awarding the "Space
Invader" game to the Crystal Manor. Selectmen McEvoy opposed.
JUNK DEALER LICENSE :
Application was received for a Junk Dealer I~{cense to'transport antiques to~ antique shows
from Edward Saulnier, 844 Salem St., N.A. The Board voted to hold off on making a
decision on this until they have more information on it. ~/~
