HomeMy WebLinkAbout1981-04-21 Board of Selectmen Minutes lg l The Board of Selectmen held their regular meeting on this date with all members present except Selectman DiFruscio who was working. Present were Selectmen Thomas J. McEvoy, Charles A. Salisbury, Ralph R. Joyce with Chair' man John W. Graham presiding. The minutes and warrant were approved as sub- mitted. HUD AUDIT: Letter received from HUD advised the Board that the Audit Report, prepared by Richard Scott Fenton, CPA, for the Community Development Block Grant Program for the period covering January 15, 1979 through December 31, 1980 was in order. The Board voted to receive the letter for the files. COUNTY ~ETIREMENT SYSTEM: Letter received from the Division of Insurance in answer to the Board's inquiry relative to the feasibility .of North A~dover withdrawin§ from the Essex County Retirement System and setting up' an independent town system for retirement purposes. The letter brought out the following reasons why the Town should not go this route: 1) It would cost more to run one small system than it would cost to remain in the Essex County Retirement System. 2) If North Andover establishes its own retirement system at this-time, retirees who have already retired and who are collecting presently from the Essex County System, would still continue to receive benefits from ~'~ ~i~9om the ECS and North Andover would still be 'assessed for these parti~ cular benefits paid by Essex County. 3) If a new fund is established by North Andover, a large initial payment must be made by North Andover in order to pay current operating.expenses; also, it must have sufficient funds for the payment Of immediate acctdeu- tal ~isability or death claims which would be made against the N.A. Retirement System. ..~hey concluded saying that it was the unanimous opinion of the .experts within the Division of Insurance who have dealt with reti~e~e~% systems for mayyyyears is that the withdrawal of a small town such as North Andover from a large county system'would not be advantageous to a small town and,. in fact, would ultimately be more costly. The Board voted' to appoint'; in thenear future, a three-man committee to research the pros and cons of having retirement system. Town Treasurer was mentioned as being one of the 3%man committee to be appointed. SCHOOL ~OMMITTEE EXMPTIDN: Letter received from the School Committee requesting the exemption of School ~ommittee member, Joseph A. Guthrie, from the provisions of Chapter 268A,. Mass General Laws. Chairman Graham stated that, in making this exemption, the Board would have to exempt everyone who requested exemption in the future. No municipal employee, elected or otherwise, can participate in negotiating contracts when members of his family are involved. Selectmen McEvoy s~id he upholds policy not to grant exemption. It Was brought up that positions'' might be Judged for exemption on an individual basis. Upon t~e motion of Selectman McEvoy, the Board voted 3-1 to disallow the Sehmo~l~ommittee's request for exemption of Guthrie. Selectman Joyce's vote was negative'. SCHOOL COMMITTEE-TOWN. COUNSEL: Letter from School Committee requested the services of Town Counsel to represent the School Committee at a Division of Employment Security hearing. Selectman Jo~c'e said he ~hought it was expensive to hire Town Counsel a $330. claim. After discussion, it was voted to have Brian contact locaI Supervisor of appeals to ascertain whether Town Counsel. waJ needed or n0t~ and to report to the Chairman. If Town Counsel was needed, it was voted to approve the School Committee's request. POLICE CONTRACT: The Board voted to authorize ~he Chairman to sign the Police contract. ALTERNATIVE STATE BUDGET: The Board voted to table an alternative state budget proposed by a group of State Representatives for further discussion. BUDGETS & A~TICLES FOR TOWN MEETING: The Board voteadto go with the Advisory Board recommendations. APRIL 21, 1981 (continued) 277 BOXFORD STATE FOREST ADVISORY BOARD: The Board voted to appoint Joseph A. Borgest, Supt. of Public Works, as a the second member Of the Boxford State Forest Advisory Board to represent the Town. John Lonqueil was appointed at a previous meeting. STATE FUNDING-LOCAL AID: Memo~.' received from MMA re the House vote on increasing state funding of local aid. The Board voted to send Representative Joseph N. Hermann, a letter of thanks and appreciation for his support. SHARPNERS POND LANDFILL: Letter received from Bud Cyr, Highway Surveyor, inviting the Board to view the landfill on Saturday, April 18th. The Board voted to send a letter of thanks and appreciation to Bud and his department for the years of hard work and effort expended on the landfill. They voted to have him request the necessary permit from the State. UOP ~ Letter received from R. J. Schoenenberger,.V-P & General Manager of UOP ~a ~an~irm UOP's intent to meet those environmental regulations in effect as of January 1, 1979 specified in the Service Agreement, and' upon which the Environmental Impact Statement .was based and approved. He also stated that~.t, here is no intent on the part. of UOP to relax or reduce the emission control capabilities of the facility should environmental standards be. relaxed in the future. Letter voted to be received for the files. MARATHON: Selectman McEvoy motioned to send a letter of commendation to Joseph Licciar- dello and John Costello for finishing the 26 mile marathon race on April 20th. It was so voted. Town Counsel, Attorney Willis, advised the Chairman that, if the horses were not out of the barn by noon, April 28, the horses should be taken to the Andover Riding Academy to be placed in the stalls there at Miller's expense. Approved: lvday liquor license, request of Rev. Gtlltan, for last day at Merrimack Collegein May. Application for a 1-day liquor license, June 26th, for wedding reception at B.U. Conference Center from Francis H. O'Connor, 84 Elmcrest Drive. Application for license (renewal) to operate Arcade machines at 1591 0sgood Street .from Christopher Adams, 51 Maple Ave., N.A.
