The Board of Selectmen held their regular meeting on this date with all mem-
bers present except Selectman Salisbury who is away on a business commtttment
Members. present were Thomas J. McEvoy, Ralph R. Joyce, R. Louis DiFruscio
Chairman John W. Graham presiding. The minutes and warrant were approved as
submitted.
ELEVATOR INSPECTIONS:
Charlie Foster, Building Inspector, appeared before the Board to discuss the
problem of elevator inspectzons. It seems that due to a c-, 4,
many elevator inspectors were laid off from their jobs lea~n~"o~;'~te
spectors to inspect elevators. The employees that were laid off formed
own company and are contracting with the cities and towns to inspect said
elevators at $1,000 per elevator. These former state employees are certifie¢
by the state, the inspectors are insured, and the fees are in line with what
the State used to charge when the employees were under the jurisdiction of
the state. The town of North Andover has 20 elevators that need inspection.
When the Town contracts with the inspectors for an elevator inspection, the
owner of the elevator pays the fee, not the Town. Before the Board makes a
decision on the matter, it was voted to have Brian Sullivan contact the Dept.
of Public Safety as to a fair rate schedule and to ascertain if the State
planned to do the inspections in the future.
SISTER ELIZABETH PETITION:
Sister Elizabeth appeared before the Board to request that the Board support
a ballot at the coming March Town Meeting which, in essence, would request
the U. S. Congress to make more federal funds available for local jobs and
programs, in quality education, public transportation , improved health care,
public safety and other essential services by reducihg the amount of our tax
dollars spent on nuclear weapons and programs of foreign military intervention
The Board advised her that they, as a Board, could not presume to tell the
government how to run their military defense program but, with ten signatures,
Sister Elizabeth could place her petition on the warrant, herself.
LAND' COURT PETITION:
A Iet~er received from"Attorney Mahoney requested that the Town assent to a
land court petition submitted by the Mangano trustees on property located On
Bunkerhill Street which is up for sale for condominiums. The Board approved
a. letter to be sent to Town Counsel requesting ~hat Town Counsel ensure that
all .the present rights of the Town are preserved to the satisfaction o~ all
appropriate Department Heads including the Highway and Public Works D~pts,
before any assent is given to the petition. Also received was ~ copy of a
letter to Town Counsel from the Highway Surveyor which expressed his concern
in regards to the 3-foot main drain line that runs through the Mangano proper-
ty between Rt. 125 and Bunker Hill Street. He requested Town Counsel that
legal action be taken to insure that this draihage will be protected and an
easement be recorded before any transfer of deeds on this property is
HAZARDOUS WASTE UPDATE:
The Board received a notice of hearings on hazardous waste management regula-
tions and cited the number of changes made on the DEQE Phase I Discussion
Draft. Board voted to accept the letter.
SHARPNER*'S POND LANDFILL:
Notice received from the Office of Environmental Affairs that the Sharpner's
Pond landfill project does not require an Environmental Impact Report. The
report stated that, based upon the nature of materials to be landfilled, ... ~
recFcling program for papers, metals, tires, etc. and separation of the
water, their office believes this presents adequate safeguards against adverse
impacts on the water quality. The Board voted to accept the notice.
TRAFFIC ORDINANCE - CHESTNUT STREET:
Approval of the amendment to our Traffic Ordinance for Chestnut Street truck
exclusion was voted to be tabled until next week's meeting upon motion of
Selectman DiFruscio.

MILTON HOWARD:
Letter of appreciation received from Milton Howard for honoring him with
the presentation of an official resolution from the Town at the Gr. Law.
Council On Aging Recognition Dinner, November 5, 1981. Selectman McEvoy
stated that he is highly esteemed and respected in the Town of North Andover.
PROPANE GAS TANK:
Letter received from Robert Dunn, Owner of the Boston Hill Ski and Slide
operation on Turnpike Street advised the Board of the facts regarding the
propane gas tank located on his property. Brian stated that Mr. Dunn had
told him that the owner of the tank is going to move it back from the high-
way.
LICENSING COMMISSIONERS:
Renewals approved of the followin~ 1982 liquor licenses:
K. of C. Association, Club All Alcoholic.
Thompson's Restaurant, Inc., Restaurant, All Alcoholic.
Rock Concerts:
Selectman Graham expressed his concern about events that involve crowds
over 1000 people. He was referring to the recent concert at Merrimack
College. He stated that some communication should be sent to the officials
of the Town to make sure said concerts would be orderly. He stated that
a policy should be adopted to impose license for concerts. Brian advised
that there was an Entertainme~,t By-Law that requires a license for largely
attended events. It was voted to send a copy of the by-law to Merrimack'
College. It was also commented that Chief Donnelly had been contacted and
everythin~ was in order at the concert. ~.
CITIZEN:
Chairman Graham addressed Carolyn Cole, Editor of the Citizen, stating that
she had distorted his remarks of a recent interview he had with h~r re the

Selectman Joyce stated that this situation had happened more than once.
and made a motion that ail legal notices in the future be withdrawn from
the North Andover Citizen from the Selectmen's Office. He gave the
additional reason that our notices needed a paper that had a wider circul-
ation t~an the Citizen could give. Vote was 3-1~rma~./~am against
