Graham,"Ralph R. Joyce, Jr., R. Louis DiFruscio with Chairman Thomas J. McEvoy presiding. The warrant and minutes were approved as submitted. TOWN COUNSEL APPOINTMENT: The designated committee to appoint Town Counsel was scheduled to meet on this date at 7:00 p. Members who were present were Robert Mascola, Ch. School Committee, Thomas McEvoy, Ted Phelan, Daniel Long, James H. Dewhirst. Those who failed to show up were Donald F. Smith, William A. Cyr, Paul A. Hedstrom, John J. Thom~nq, Jr. and Dr. Julius Kay. As a majority was not present, the appointment was rescheduled for June 28, 1982, at 7:15 p.m. The committee will be so notified. FIREFIGHTER'S & PUBLIC WORKS CONTRACTS: The above-named contracts for 1982-83 were signed by all parties involved. POLE INSTALLATIONS: The Board approved the installation of 3 poles (remove 3 poles) on Salem Turnpike. FIRE ENGINEER INTERVIEWS: The Selectmen interviewed two applicants, Frank H. Dushame, III and John J. McGuire, Jr. for the position on the Board of Fire Engineers. A third applicant, Richard Winn, who could not appear for an interview at this time will be interviewed at a later date which Brian S. was authorized to set up. SOLID WASTE ADVISORY BOARD MEMBER: The Board appointed Edward Scanlo~ to represent the Town as a member of the Solid Waste Advisory Board. He had indicated that he would like the appointment. Brian Sullivan was appointed the alternate member. Brian advised the Selectmen of UOP's acceptance of the liability for the 150 ton shortfall which means that UOP will subsidizeany cost above what the cost above what the cost would be if the Town had the 900 municipal tons. CONSERVATION LAND GRANT: Letter received from the Chairman Df the Conservation Commission, Anthony Galvagna, advising the Board that a parcel of land which lies within the watershed area of Lake Cochichewick, had been offered to the Conservation Commission by a Mr. Lawrence J. Cadogan, formerly of North Andover and now residing in Florida. The Board voted unanimously to refer the matter to Town Counsel requesting him to take the necessary legal steps to ex- peditethe acceptance of the parcel. LAKESIDE DEVELOPMENT: Letters 'received from the Conservation Commission, Town Counsel and the Board of Trade re the problem resulting from the Lakeside Development which is causing sediment and runoff from thedevelopment to enter Stevens Pond, especially during the continuous rain storms. The Conservation Commission had issued a deadline, June 2, 1982, to John Tuttle of Lakeside Development to resolve the problem. They asked the Board to direct Town Counsel to initiate litigation against the developer as the problem still exists. The Board of Trade sent a letter of protest against the developer for polluting the bathing beach area and requested that action be taken against the developer and others who are endangering our water supply. The letter from Town Counsel enclosed a list, submitted by the Highway Surveyor, that must be complied with by John Tuttle before the problem is corrected. Town Counsel stated in his letter, also, that, as the completion date for performance under subdivision control on the Lakeside development is August 3, 1983, the bank is reluctant to release the money unless Tuttle signs a release for the money. The Board voted to have Brian consult with Town .~ Counsel to expedite release of the money. GOVERNOR BRADSTREET BUILDING: Persons in'charge of the old Governor Bradstreet fire engine appeared before the'Board with plans which were proposed for the parking of the old engine after the .old Town garage is torn down to make room for the construction of the Senior Citizen Center. The area proposed would be where they now dump tree trunks. The plan was for a two-story building but they said they only needed a one-story building. They were asked about the possibility of storing the engine up at the town garage. Chairman McEvoy said that he would look into the possibility and would contact Mr. Hines by the next meeting. DESIGNER SELECTION PROCEDURES: The Board of Selectmen unanimously approved the North Andover Designer Selection Procedures. The procedures will be used in selecting designers (architects-engineers) for capital improve- ment projects involving building construction in excess of $10,000 to be undertaken by the Town of North Andover. The RFP will be publicly advertised, at least two weeks prior to the close of applications for the contract. MASS. SPINA BIFIDA ASSOCIATION: Letter received from Cynthia J. Ward, 17 Emerson Ct., North Andover, Mass. , President of the Mass. Spina Bifida Association, requesting permission to hold a Town wide cannister drive for the benefit to Spina Bifida victims under the chairmanship of Frank Brennan from the present to July 5th. The vote was unanimous to permit this drive. CONSTABLE APPOINTMENTS: ~he. Board~nanimously appointed Joseph and David Axelrod. Constables for the Town of North hoover, J yr. term. 596 JUNE 14, 1982 (continued) LICENSING COMMISSIONERS: COMMON VICTUALER LICENSE-SEA FOOD SALES: The application of Shelley Boron to sell sea food from a van at the Butcher Boy Meat Market area was discussed. Application had been tabled from last meeting. The discussion revolved around the responsibility the Board had to the North Andover business men involved in the same sales as peddlers...North Andover businessess had to maintain overhead bills, taxes, rent, etc. which the peddlers were not subject to. Because a prior license had been issued another seafo~eddler, the Board granted the Common Victualer license to Miss Boron. It was also voted,/~Kl~/~o have it go on record that beginning in 1983, this type of license would not be granted~£x~ ~ m~ ~ ~ ~ ~/~ c/~'~.uT~',~. ICE CREAM PARLOR: The Board voted unanimously to grant a common victualer license to Francis Smith for his ice cream parlor on 133 Main Street. WINE & MALT LICENSE: An application to re-apply for a Wine & Malt license received from J. Michael Gentry,d/b/a The Holding Pattern Restaurant, Lawrence Municipal Airport. Hearing was set for June 28, 1982, at 7:30 p.m. To be advertised, abutters notified. ONE-DAY LIQUOR LICENSES: One day liquor licenses for weddings at B.U. Conference Center were approved,'4-1, for Donna Wojkiewicz, June 19th and Thomas C. Fuller, August 14, 1982. The Chairman called for a brief executive session for litigation. SUMMER RECREATION EMPLOYMENT: PLAYGROUND INSTRUCTORS: The Board unanimously approved the list of students hired to supervise and work at the playgrounds during the summer months~ list submitted by Bill McEvoy, President of the Recreational Council. TOWN COUNSEL: John J. Willis, Town Counsel, submitted a list of matters referred to him by the Selectmen which he considered, "Special Legal," and requested authorization to proceed as legal counsel on behalf of the Town. Authorization was tabled until next meeting. BROOKSIDE v. BUILDING INSPECTOR OF NORTH ANDOVER: Letter received from Attorney Clifford Elias advised the Board he had reviewed with representatives of McDonald's the matter of having his office, Sweeney & Sargent, defend the building permit challenge in the above-named case. McDonald's have agreed. He requested the Board to appoint Sweeney & Sargent named, "Sp~own Counsel" with the understanding that the Town would not be responsible f~o~t-he_l~ incurred.
