HomeMy WebLinkAbout1995-02-07Planning Board Minutes February 7, 1995 Senior Center The meeting was called to order at 7:11 p.m. Members Present Richard Nardella, Chairman, Joseph Mahoney, Vice Chairman, Alison Lescarbeau, Richard Rowen, Clerk, arrived at 7:15 p.m. John Simons arrived at 8:10 p.m. Staff in attendance were Anne Marie Tucciarone, George Perna, Karen A. Fitzgibbons. Rezoninq of 1145 Os~ood Street~ Daniel McCarthy, on behalf of his mother who owns the property at 1145 Osgood Street, handed plot plans to Planning Board members. Property currently zoned residential 1 (Ri) and wants to rezone to B2. Mr. Nardella recommended that applicant work with other landowners to rezone all three (3) lots. Not ready to endorse article at this time. Mr. McCarthy will consult with other land owners and come before Board on February 21, 1995. NadineLano Richard Rowen made a motion to release $15,000.00 and $5,000.00 bond, seconded by Mr. Mahoney; unanimous vote of approval. Richard Rowen made a motion to release $70,000.00. Seconded by Alison Lescarbeau. Unanimous approval. Dave Powers from Somerset Savings Bank brought original documents for Bruin Hill. Nadine Lane/Common Driveway Members endorsed plans. Form& Plans -- lot 3iA and 4~ winter Street Mike Rosati from Marchionda Associates presented revised plans to Planning Board members. Planning Board signed plans as Form A. Vublic Hearinqs East Pasture Estates Richard Rowen read public notice William Bergeron from Hayes Engineering presented plans for East Pasture Estates: Total length of roadway is 402 feet Capture run off from roadway into a proposed drainage system with catch basins. Storm water drainage capable of handling 100 year storm John Simons arrived at 8:10 p.m. Requested waivers: Requested a waiver for a full environmental impact for only three houses. 2. Request to incorporate 32 foot pavement with a cul-de-sac Streets and right of ways -- reduce pavement 24 feet instead of 22 feet. Request that cross section be modified (allowed to do some si4e sloping) want to be able to maintain existing trees. Azaleas, juniper, white dogwood to be landscaped in the cul-de-sac. 5. Wants sidewalk on one side. Possibility of installing overhead utilities? Planning Board wants underground utilities. Waive requirement of installing dry sewers. Richard Nardella requesting a determination from Bill Hmurciak on dry sewers. Mr. Nardella: ask Kathleen Bradley Colwell if drainage calculations have been sent to independent consultants. Also, does applicant know he has to pay for it? Brad Latham, attorney for Mr. Johnston, is concerned about cost for such a small subdivision. Applicant has already paid $1400 and in the past that has included a review on drainage calculations. W~y have to pay an extra $12007 George Perna explained that the drainage calculations were picked up when there was an experienced member on the Planning Board. Fees were never raised because of that. We no longer have the advantage of that experience. Mr. Mahoney suggested that Planning Board members take a site walk. Alison Lescarbeau asked what style houses being built? Mr. Johnston replied 3-4 bedroom, 2 car garage colonial style. Mr. Nardella asked are there any abutters here for this subdivision? 2 Mark Vaughn 124 Boston Street, abutter on south side has no complaints at all. Mike Rosati willing to get a letter to the Planning office to grant the Board an extension to draft a decision until February 23. No abutters Richard Rowen made a motion to close hearing re: common driveway and direct staff to draft decision. Mr. Mahoney seconded the motion, unanimous vote. Richard Rowen made a motion to close public hearing re: access over legal frontage and directed staff to draft decision. Mr. Mahoney seconded motion. Unanimous vote. John Simons made a motion to accept a written extension, seconded by Alison Lescarbeau. Unanimous decision. PB~ Development (Crossroads) Attorney Peter Shaheen to discuss traffic issue: Changed from a specialty retail site to a shopping center. Filed an E.N.F. Mass. Highway. Will Mass. Highway move proposed Osco curb cut to be directly across the street from Crossroads? Waiting for input. Board initially approved site plans contingent upon receiving curb cuts from Mass. Highway Dept. Richard Rowen read into record letter from Police Chief Richard Nardella: have shown moving of detention pond? Atty. Shaheen: yes, reduced in size. Atty. Shaheen also stated that Mass. Highway must tell what they want done. Asking Planning Board to grant what was granted to Osco Drug. Mr. Nardella: staff recommendations= too soon to close the Public Hearing until state and MVPC make final recommendations. Mr. Nardella opened public hearing Mr. Netti, 10§ Hillside Road, against opening up Hillside Road. Concerns regarding traffic and endangering children. Doesn't think it's right to dump commercial traffic into a residential neighborhood. Alice Piessens, 125 Hillside Road, also worried about traffic and the safety of her children. Does not want curb cut near Hillside Road. John Casey, 84 Innis Street, what's going in Crossroads? Afraid of fast food restaurant, thereby creating more traffic on Hillside. Phil Busby, Hillside Road, problem with policing, heavy trucks. On his curve there were 17 accidents in 4 years. Jay DiOrio, Hillside Road, very upset about nothing being done. Comes to meetings all the time. Suggests combining ZBA and Planning Board. Says much time and money wasted. George Perna: pointed out there are still open issues; if you close the public hearing you can't discuss those at a later date. Mr. Mahoney made a motion to continue public hearing, Alison Lescarbeau seconded the motion, Richard Rowen voted yes, John Simons voted no. Mr. Rowen requested that Atty. Shaheen come back with drainage, landscaping info. ZBA to relocate fence, plans along buffer zone of McGarry property. Economic ODDOrtunity Ares Jay Donovan .helps to bring in jobs and attract businesses .submit a revised application with Lawrence to include area along Merrimack River .does not effect zoning .does require a warrant article .airport is the basis for having the joint application Joseph Mahoney: what are the down sides? Jay Donovan: no tax benefits to the communityimmediately, but long term gains. Richard Rowen: would like the area highlighted on a map for review Richard Nardella: question about foreign trade zones Jay Donovan: will also seek foreign trade zone designation 1145 OsGood Street No one appeared. Richard Rowan made a motion to accept and retain &78,400. Joseph Mahoney seconded the motion, unanimous vote. Richard Nardella: why no sprinklers proposed? Phil Christiansen: not providing sprinkler sysetems fire alarms are required by the building code Richard Nardella: would like fire sprinklers Joseph Mahoney: fire sprinklers are not a requirement Alison Lescarbeau: how does the compensatory flood plain work? Phil Christiansen= grade out the land to extend the wetland area, capture water suchthat Salem Street will not flood, designed for a 100 year flood. Phil Christiansen: 20 foot span of a culvert with 1:1 slope 10 foot road above streambase at crossing Joseph Mahoney: how do the detention ponds work? Phil Christiansen: water will drain out of them Richard Rowen= 6% grade from crossing, what are the other grades? Mr. Rowen: any more water flOwing into Boston Brook after development? Mr. Christiansen: no more water flowing, may even be less flow Mr. Rowen: can any relief be given to current conditions? Mr. Christiansen: need to provide compensatory storage at the same elevation that is not in the wetland. 100 year flood--102'elevation Kathleen Bradley Colwell: ask consultant for a mechanism to relieve current flooding issues. John Daly, Architect, from Wayland, MA. was also present 40' x 100' = 1,000 sq. ft. building proposed made to look like three separate buildings combination of brick and shingle interesting roof lines one story occupancy 3 tenants proposed Tina Messina: Marketing shows a need for this type building 25' entrance is off of North Main Street .site drainage to the rear .water and sewer through Sutton Street .fire sprinklers will be provided .request to reduce access behind the building to increase parking and create an island of 15'possibly has Planning Board ever reduced the access and to what degree? Ms. Colwell: are there any spaces on Sutton Street at North Main Street? what about parallel parking? ? a no parking sign Mr. Nardella: request for reduction of parking space size John Daly, architect, reduction in parking size would allow for additional greenery--parking spaces in the back designated as employee parking in design. Ms. Colwell to check on parking space size and access behind building with Bob Nicetta. Discussion of landscaping behind building will remove snow Ms. Colwell: will need lighting locations and design intent is to have 3 distinct facades, brick colors, etc. Wood Signs: illuminated indirectly Mr. Rowen: discussion of "internal" "for sale" signs, limit on large for sale signs. Applicant is to seek out DPW to get a written response to issues Continued to March 7, 1995 Crossroads Ms. Colwell update: Meet tomorrow with state received a letter from residents on Hillside Rd (8 families) who do not want access out to Hillside Lost po~d continued to March 7, 1995 continue discussion of drainage issues Discussion o£ common driveway and access decisions Mr. Mahoney made a motion to approve lot 3AA and 4A Winter Street common drive, seconded by Richard Rowen. 3 yes - Mr. Rowen, Mr. Nardella, Mr. Mahoney i no - Alison Lescarbeau, does not think driveway is safe for vehicles--too steep. .Where the two driveways meet there is an expanded turnaround area. .Concern that person would not be able to see other car where driveways merge. .Put a turnout in so that a car can get out of the way of the intersection of driveway to lot 4A. Richard Rowen made a motion to revote, seconded by Mr. Mahoney. Unanimous vote. Motion made by Mr. Mahoney, seconded by Mr. Rowen, to approve common driveway as amended with turnout at access to lot 4A. Unanimous vote. Motion to approve lot 4A Winter Street access made by Mr. Rowen, seconded by Mr. Mahoney. Unanimous vote. Motion made by Alison Lescarbeau, seconded by Joseph Mahoney, to approve the minutes of January 24, January 31, and February 7, 1995 meetings. Unanimous vote. Motion made by Mr. Rowen, seconded by Ms. Lescarbeau, to go into executive session to discuss litigation. Hr.
