Selectmen Willtom A. Firmeran, Arthur p. Kirk with Chairman William B. Duffy, Jr. presiding
The warrant was approved as submitted.
PERMAN]NT PATROLMAN APPOIN~T:
~he Board voted unanimously to appoint Donald F. Kendall, 61 Farrwood Avenue, North Audover
to the position of permanent patrolman; date of employment to begin on July 2, 1969 at the
starting salary of $6624.00 per year. Certification and Report Form together with the
Authorization of ~ploymant ( in quadruplicate on Form 14) will be sent into the Civil Ser-
vice Office, Boston, Mass.
Selectmen Arthur p. Kirk drew the name of Thomas J. Cotter, 20 Johnson St.; an industrial
mechanic, to serve on the July 14 sitting at Superior COUrt in Salem.
JOlT POLE LOCATIGIS:
A petition was approved by the Board for joint pole locations;
and 4 poles on Walnut Street. No hearing was necessary.

Notice of installation of street lights on Church and Turnpike .~treets was received.
GAS SERVICE:
A petition to excavate for installation of gas.~z~vice on Johnson Street was approved by' the

DISPOSAL SITE LAND:
Letters from Atty. Salisbury and Harold Morley advised the Board that negotiations were
being set in motion for acquisition and use of land for the disposal site.
CHAPT~ 90 PA2~NTS:
Two vouchers for work done on Chapter 90 Salem Street reconstruction were recei~ed:.an~r,e-
ferred to the Highway De~t~.
EESI~ATI~:
The resignation of James P. Gordon, C. P~A. from Solid Waste Disposal Study Committee was
received and accepted, with regret, by the B~rd. Mr. Gordon has been appointed to the
Advisory Board committee by Judge Thomson~ A letter of thanks and appreciation for his
services while on the latter bommittee was directed to be sent to Mr. Gordon. A replace-
mant will be appointed at a later date.
C~TIFICATI(N:
Upon reco~endat~en of Chief Lawlor, R.Ashton Smith was certified for the newly formed

Waverley Road Truck
Atty. Willis end other residents of the %Yaverley Ro~d section' appeared before the Board
protesting once more the trucks travelling on said road. Chairman Dully stated that he
and Representative Paul Cronin had met with the Di%Y and presented a petition to have 2½
ton trucks and over to be excluded from going over Waverley Rd. Present survey shows
they make up 4% of the truck traffic. The DP~ ~,Lll correct situation if legally possible.
F~. Dully also stated that according to Town Counsel's ac~r2ce in his letter the Board does
not have the authority to exclude truck traffic on town ~mys~' but~. nevertheless, the Board
was using every pressure on the DB~ to regulate the exclustoE of truck (hearty) traffic,
Waverley Road. Atty.'W~l~s questioned Town Counsel's ruling on the Board's authority and-
quoted Chapter 8~, Section 10 and stated that, in his opinion, Home Rules does give the
Board the right to control any traffic of trucks on to~.m ways. He also said the United
Parcel trucks were the worst offenders. Andther resident stated that it w~s a safety
hazard for the many children living on .the street and the trucks also passed the Thomson
School and playground. Selectman Arthur p. Kirk made a motion that "in lieu of an
affirmative decision o.f the. state. Dept. of ~ lic Work~., that the Selectman take the
proper and necessary smeps mo resrm~ct truc~s on Waverley Road by submitting a By-Law in
Town Meeting guided by advice of Town Counsel."

Selectman William A., Fisneran made a motion that the Board direct that signs be erected to
prevent ~ruck traffic (2½ tons or over) on Waverley Road.
JUNK CAR VIOLATiG~S:
The Board received a copy of letter sent to Chief Lawlor from Bldg. Inspector, Charles A.
Foster listing 16 ~iolstions of the junk car by-law. The Board requested secretary to send
another letter requesting Mr. Foster to submit his report on the above-named violations as
soon as possible and upon receipt of same, the Board would hold a special meeting to discuss
the matter. A letter was requested by Selectman Finnaran to be sent also to the Board of
Health on this matter requesting a report on same.
TREE - G~ARLES NANZI:
A tre~ with roots that were making sidewalk walking hazardous on Massachusetts Avenue was
~reported taken care of by the Tree Warden and Highway Surveyor. Mr. Lafond reported that
the Highway Dept. would cut the roots around the tree adjacent to the sidewalk and then the
walk wo'~ld be repaired.

The Board received copies of letters written to Hurricane Fence (Sweeney) and to Ray
Finnochiaro from Atty. D. Mills ~hh is representing Thomas Lacey, complainant for many years
on the dump-like area on SUtton Street as you approach North Andover's Nsin· S~reet. The
Selectmen requested another letter ,,forthwith" from the Building Inspector and Board of
Health on these vi~latiens.

WEVERL~ R~AD TRAFFIC:
Residents of ~aVer.ley Road appeared before the Board once more on the truck traffic problem
on Waverley Road w~th Attorney John J. ~.~illis as their unofficial representative~ ~hairman
D~ffY advised the residents that at a meeting with the D~Y a survey was turned over to them;
the meeting x. ms on June 26th. Representative Crenin requested that the DM~ make an exceptic~
to their existing traffic regulations in ard~ to assist the residents, at this meetl6g.
F~. Duffy stated they are a~rsiting a report from K. Krekorian on this request amd is quite
that it will be a favorable answer. Mr. DUffy~also stated that he thought it wo~ld
at least ~o wee~s before a ~eply cam be e~pected$ that the BoCci'of Selectm~n will do
everything possible to achieve a favorable .solution to the problem. Atty. Willis stated that
the restrictions of .2~ ton truck traffic should be on a 24 hour basis. Another resident of
~averley Rd. between .t. 114 and Rt 133 stated that excessive speed amd .drag racing were in
existence at all times. Selectman Finneram stated that if the roads were pasted for speeds
it should take care of the speeding to a certain extent ~ith police patrolling, also.
AB~D~IED N~SSILE SITE: .
A letter was received from a Mrs. Doyle, Turnpike Street, complaining of several motorists
using the missile site road for a drag strip day and night. She also said many were using
60~ deep quarry hole to m.~m in and she feared a drowning might occur before the summer was
over. A letter was sent to Colonel Beatty requesting ImmaCuLate corrective measures to have
the road blocked off. Two days later, Selectman Finnerau directed the secretary of the Board
to call E~nel Beatty for a report. He stated that he I~Q~.T~ the proper authorities
of the situation and he e.xpectod a reply within tw~o waeks at the most.1 He told the secretary
that he would call the selectmen~s Office as soon as he had received notification. A copy of
the letter to Colonel Beatty was sent to Chief Lawlor.
