The Board received a copy oS the acknowledgement of the Dept. of Natural Resources of receipt of Louis Kmiec, ~r's notice of intent to fill in swamp land adjacent to Salem St., Rt. 114. They also sent an acknowledgement of the town's intent to fill in land at the new garage site adjacent to Cochichewick Brook. PUBLIC WO~S - B & MRAILROAD INSURANCE: A request was received from Wm. B. Duffy, Sr., Supt. of Public Works, for necessary insurance funds. He enclosed an agreement, approved by Town Counsel, for Board's signatures. The agree- ment was approved by Richard Lafond, Insurance Chairman for the Town. DRUG ADDICTION REHABILITATION BD.: A letter from the above-named was received and Selectman Kirk made emotion that a letter be sent stating the Board would cooperate in anyway they could in this particular field and that they would be interested in any new information received by the Drug Board. TOPICS PROGRAM: The topics program re mutual aid from Federal Funds for traffic safety was received by the Board and the Board authorized the Chief of Police to apply for saidfu~s. DONOVAN TRASH DAP~REL COMPLAINT: The Board voted to send a letter to Mr. Donovan advising that his complaint had been properly investigated by Fire Chief Daw and Police Dhief Lawlor and Highway Surveyor who ha~e ascertained that the town is not involved in any way that the matter was a private, residential matter and would have to be resolved by the parties involved. E~CUTIVESECRETARY: Letters were voted to be sent out to the Town Charter Study Committee, Personnel Bd. to meet with the Board to discuss the proposed Ex. Secretary position. CIVIL DEFENSE SALE: Inreply to a letter sent to the Board from C.D. Director, J. Farrell, the Bemrd authorized Mr. Farrell to send out bids for the sale of a duct and 1959 Chevolet, no longer used by his department. Bids would be opened on November 17, 1969 at 7:30 P.M. HIGHWAY SURVEYOR: The Board voted to send a letter to N. Nicetta requesting a report of the Rt. 114 reconstruc- tion meeting he attended. The report was requested for Nov. 3, 1969. ~ - REPORTS REQUESTED: The Board also voted to send a letter to Charles Foster for reports on the Drive-Way By-Law and proposed amendments to the ~:f:3 ding Code. BOARD OF TRADE: A letter received by the Selectmen from Board of Trade, President, Mitchell Bootman, enclosed suggestions that new streets be named after prominent North Andover residents who had died. The Board voted to send a letter of acknowlegdement and appreciation of the suggestion.' CHHISTMASDECORATION COMMITTEEAPPOINTMENTS: The Board voted John Lyons, Town Clerk, to head this year's Christmas Decorating Committee which will include Mitchell Bootman, John McLayand Harold Trumbly. The Board of Trade voted not to donate their half of the expenses.this year because of the difficulty in obtaining the necessary donations from the business establishments. The Town donated $800. at town meeting. DALE STREET COMPLA.~NT: . The Board voted to send Mr. Murphy,'776 Dale Street, a letter in answer to his drainage com- plaint. ~he letter stated they regretted they were not in a position to be of assistance to him at this time on the drainage matter. The letter received from the Highway Surveyor ex- plaining the reason was enclosed for his information. ·~ CONFLICT OF INTEREST: The Board voted to send a request to Attorney James Glynn, Jr. and BichardHarrington, Chair- man of the Capital OutLay Committee requesting that they fill out the Conflict of Interest For 43 to be filed with the Town Clerk. STREET LIGHT: Upon motion of Selectman Finneran, the Board voted to have a street light installed at 21 Parker Street. STREET SION: Aththe req~es~ of Mr. Finneran, the Board voted to send a letter to J. Berkover, Nass. DP~ requesting that the Town Line sign on Essex Street indicating the North Andover-Boxford line be relocated from its present location which borders a residence's driveway to a place which will conform with the actual bounds. CLARK STREET ADJUDICATION: A hearing was set for the Clark St. adjudication by the Board on Dec. 22, 1969, at 8:00 P.M. OCTOBER 27 1 6~3 (continued) 28~ CLARK STREET - Letters ~b~ recommendation were voted sent to the Planning Board, Highway Dept. and Public Works to be submitted to the Board before the December 22,. hearing. SIDEWALKS: The Board received a letter from Supt. Garofoli requesting the Selectmen to expedite the in- stallation of sidewalks on Chickering Rd., from the Village Green apartments to the traffic lights, corner of Matm~Street and Chickering Rd. The Board voted to send a letter to Jacob Berkover, District Engineer of Public Works, in Danvers regarding the lack of sidewalks, both on Chickering Rd. and Osgood Street, reminding the state that the town had appropriated the sum of $8,000. nearly four years ago and the danger to the school children and pedestrians who have to use these roads has increased. The ard requested that top priority be given to the funding of the State share for their con- ruction. Letters will also be sent to R. Paul Crontn, Senator Rurak asking their aid on this GASOLINE BID: · matter. The only bid received by the Board was from the Gulf. Oil Company. The Board voted to re- Ject said bid because the Highway Surveyor had neglected to' give detail changes on the size of his tanks. The bids will be readvertized and opened on November 10, 1969, at 7:30 P.M. ZONING BY-LAW VIOLATION: STEINBERG CASE Aletter to the Board re the A. Steinberg case from A~borney James Glynn, Jr. stated that he had several conferences with Steinberg's lawyer but, to date, Steinberg had not co- operated. Ne stated he would begin court proceedings if the latter did not conform to By-Law requirements. The Board voted ~ advise the Advisory Board once more that the sum of $1500. would have to be set aside from the Reserve Fund for attorney fees on By- Law Violation court cases. ' ~t. 114 Widening Conference; Merrimack College The Board of Selectmen requested Highway Surveyor to represent them at the. above-named meeting and emphasize the following: 1. Objection to the closing off of Cotuit Street. 2. Request for "Stop and Go" traffic lights at Den Restaurant, opposite Waverley Rd. 3. Objections to the cutting down of so many trees. 4. The lawrence Eagle-Tribune plant should have an outlet on Turnpike Street. A report was requested from Mr. Nicetta on this meeting. J. BERKOVER : P~. 114: A letter was received by the Board from J. Berkover, P.E. Mass. Dept. of Public Works request- lng the Board's consideration and reaction to the possibility of municipal acceptance of the Rt. il4 area in North Andover after reconstruction. (From Wilson's Corner, at Rt. 125, northerly to Lawrence line at Waverly Rd.) The Board voted unanimously to send a negative reaction for the following reasons: 1. The portion of road suggested for inolusian in North Andover; road system is not only _ not a local road, it is an integral part of a numbered State Highway and it is a heavily traveled spur of the Federal Interstate Highway System.~ It is therefore, in our judgment, especially inappropriate for inclusion within our local road Jurisdiction. 2. The Town has neither the financial resources nor the operationa capacity to attempt to {undertake the additional responsibilities suggested, either now, or in the foreseeable future, ' 3. The portion of Rt. 114 involved, because of its role as an entryWay to Interstate 495, presents traffic and safety problems which, in our tendered judgment, must remain the responsibility of the Commonwealth of Massachusetts." "In sum, the Board stated that they were unequivocally opposed to assuming jurisdiction of Rt. 114, from Wilson's Corner to the Lawrence line, for the reasons above-stated.,, Copies of this letter were sent to Commissioner Edward J. Ribbs, Robert Yasi, Adm. Sec. to the Governor, Representative Paul W. 'Cronin, and Senator James P. Rurak. Alice M. Letarte, Secretary 1969 Clerk The regular meeting of the Board of Selectmen was held on this date with all members present. The Warrant was approved as submitted. BOSTON &NAINE R.R. INSURANCE: Supt. William B. Duffy, Sr., Board of Public Works submitted the Boston &Maine R.R. Insurance Agreement to be signed by the Board. This insurance will protect the town when vehicles cross over the railroad tracks to ~w the town's well field. FUEL OIL BIDS: Cyr Oil Company, the lowest bidder, was awarded the contract to supply the town buildings with · fuel oil for the coming year.
