A meeting was held by the B card of Selectmen on this date with all members present!
Selectmen F inneran, Kirk and Chairman William B. Duffy, Jr. presiding for the re-
organization of the Board. A recommendation was signed a.nd presented to Town Clerk
on this date by the B card for the.creation of a new precmnc~ ~.
REORGANIZATION OF THE BOARD:
The following~ were voted for the coming year, 1970:
Board of Selectmen:
Chairman: William A. Finneran
Clerk: William B. Duffy, Jr.

Newly appointed Chairman, William A. Finneran, the 8th time he has served as Chairman of
the Board in his 17 years as a Selectman, accepted the' chairmanship with the following
cmm~endation for the retiring Chairman, Mr. Dully: ,'Mr. Duffy, Chairman for the first
time on the Board, showed a deep responsibility to the Town and handled Town business
with great ability."
HIGHWOOD WAY ADJUDICATION:
Present at this second meeting on the acceptance of Highwood Way were the Planning Bal.
members, headed by Chairman William Chepulis, the Highway Surveyor, N. Ntcetta, Atty.~
John Willis and abutters of the street.
Mr. Chep~lis submitted an affirmative recommendation to the Selectmen, in writing,
which stated that at their meeting on March 2, 1970, the Planning Bo'ard reconsidered the
matter of the adjudication of Highwood Way and now recommend adjudication of said street
provided the stone bounds are actually in place at the time of the adjudication.
Mr. Chep,,11~ also'added that the Selectmen have the power to adjudicate a street with or
without stone bounds.
The Board Of Public Works Superintendent W~llt.am B. Duffy, Sr. stated in their recom~aenda-
tion that the water mains, gate valves and h~irants had been installed satisfactorily and
had no objection to the acceptance of the ~kittier Farm sub-division which included High-
wood Way.
Highway Surveyor, Mr. Nicetta, stat.ed ~that it was not his purpose to object to the accep-
tanee'of any street 'if street is in proper condition to be accepted. He said the burden?
and expense, to repair Highwood Way would rest od the Town for, ~n his opinion, said street
does not mee~ the requirements mo be accepted. The drainage system is not right...does
not take water from the surface of the road, causing the surface water ~o drain onto
private property down om to S. Bradford Street~ In the ~inter, this causes icy and
dangerous road conditions. He stated'it would cost $3100 to correct drainage and $3 to
$48~. to resurface road. He also questioned the presence of stone bounds.
Selectman Kirk stated that this sub-division was set up some time ago. Last year same
conditions existed. He asked Nr. Nicetta if he had been consulted by the developer.
Mr. Nicetta replied, "No." He went on mo add that he had never bemapproached.
Atty. Willis stated that he w as an attorney for the developer in this matter. He sub-
mttted letters (copies) that he had sent with his petition to the Planning Board, Public
Works and Highway Surveyor, with plans, on April 18, 1966. On May 26th, a letter from
the ~ Highway Surveyor stated only that he had found the road ~oo narrow. They had re-
quested an inspection from the Highway Surveyor, ~ited for him for two .hours one, cold
day, but Mr. Nicetta never showed up for the inspe¢.~o!ou. The only fault the Planning
Board found was that water was deposited on street creating icy conditions. Mr. Willis
also advised the Board of Selectmen that the developer had, at an added cost of $14,000.
installed a water main (12"water main) on the street. He added that the services of
the%own should be given the residents of the subdivision, as tax payers of the town.
Chairman Finneran asked Mr. Nicetta if had appraised the Planning Board of the ~l~eged
conditions of the sub division. Mr. Nicetta said that he had.
Planning B card member, Donald Kierstead, s tared tha~ad every r e ason to believe
Mr. Nicetta's commen~s to be valid, that the drainage is poor. However, the Planning
Board has no authority to control developer.
Selectman Duffy stated that stringent regulations should be imposed or proposed. Mr.
Chepulis~ stated that there would be amendments made on present regulations.
Chairman Finneran stat ed that the Board acted on the recommendations of the Planning
Board before voting on the adjudication of any street. The Board assumed that the
Highway Surveyor and the Planning B card have consulted together on street petitions
before recommendation is sent to the Selectmen.
Selectman Arthur P. Kirk made a motion to adjudicate Highwocd Way and Chairman Finneran
seco~d the motion. An Order of Lay Out was then s~igned by the Board and submitted to
the Town Clerk with street plan.
A meeting will be held on Saturday, March 7, at 9:15 a.m. with
