HomeMy WebLinkAbout1970-09-21 Board of Selectmen Minutes_SEPTEmbER 14~ 1970 (continued) LOUIS SAUntERS DEDICATION: A representative group from the American Legion and Veterans of Foreign Wars appeared before the Board requesting the Board's approval of their plans for the dedication of the late Louis Saunders, a member of the Registra of Voters for many years. The dedication ~ill consist of a short ceremony on Armistice Day dedicating the square at the intersection of Sutton and High Streets. A placque, in memory of Mr. Saunders, will be placed on the small diamond there. All expenses will be taken care of by the American Legion and V.~. W. The Board expressed their complete approval and offered their services if needed. LICENSING COMMISSIONERS MERRIMACK COLLEGE LICENSE APPLICATION: ~hairman Kirk reported that the hearing on the .above-captionedmatter held by the ABC was con- ducted in a very informal manner. The result of the 15 minute hearing was inconclusive. The ABC advtsed Merrimack College ~o write to the ~orthAndover Licensing Board for a meeting with them ~o reconside= the Board's negative decision rendered on April 27, 1970 denying the college their application for a Special Club Wine and Malt Beverage license. On September 14, 1970, Chairman Kirk read a le~er and reapplication for said license from Merrimack College. Mr. Finnsran stated that he was of the opinion there was no need of re- considering the Board's April action. However, a motion was made to meet with the college representatives on September 28, 1~70, for reconsideration of the license petition. No hear- lng necessary. The Secretary was instructed ~o advise, by letter, Attorney Earl ~. Brown, Merrimack College, of the meeting date. ~ · ~ ~ Alice M. Duffy, Jr. and Chairman William A. Finneran presiding. The warrant was approved as submitted. .~ PERSOnnEL BOARD: Daniel Griffin, Chairman of the Personnel Board, requested an audience with the Board to discuss an administrative problem concerning one department head. Selectman Kirk made a motion ~o discuss the matter in Executive Session after the Selectmen's regular meeting as it concerned an individual. The Bcard so voted. GAS EXCAVATION: A petition Was approved to excavate on 44 Sutton Hill Rd. to install gas services for Joseph C~ ~i. STREET LIGHT SURVEYS: Street light surveys, tabled from pas~ meetings, were reviewed by Selectman Kirk who that street lights be installed on Autran Avenue and in the vicinity of 91 Boston Street. An inquiry from Mass. Electric Co. re a light on Phillips Ct., previously billed to J. P. Stevens Co., asking if it should now be billed to the ~own, was tabled for further study and referred To Selectman Kirk for determination. SCHOOL PA~KING. CONDITIONS: School Committeeman, Thomas McEvoy, appeared before the Board to discuss letter received from the School Superintendent re parking conditions in the triangle in front of North Andover High School...Parking conditions in front of the Thomson School on Waverly Road...2nd trash collec- tion at Thomson School. Mr. NcEvoy stated that he had conferred with Chief Lawlor about parking in the back of the school at town meeting time, instead of in front of the High School which has resulted in damaging school proper~y. Chairman Finneran stated that the side and back doors of the school were never open and made available to the townspeople. Mr. N~Evoy stated that he ~ould see .to it, personnally, that the other doors to the school were opened at meeting times. He request- that No Parking signs be installed in front of the school and around the circle preceding the front entrance. He also requested that No Parking signs be installed in front of the ~omson School, and that the HighWay Dept. be requested to pick up trash twice a week, instead once a week; a necessity resulting from the addition of the portable school. The Board voted ~o re- quest the Chief to submit a progress report on the co~ferense he had with Mr. McEvoy. The Highway Surveyor will be requested by the Board to make the additional trash collection. PERAMBULATION: The Boxford Selectmen invited the Board to perambulate the Boxford-North Andover boundary on Saturday, September 26, at 9:00 A.M., meeting at the Boxford Town Hall. The Board directed their Secretary to send a letter of acknowledgement and acceptance of the invitation. The Lawrence City Engineer also sent a letter to the Board inviting a perambulation of the Lawrenc~ N~rth Andover boundaries on October 14, a Wednesday. Selectman ~irk stated that he would be unable to attend any Wednesday perambulation date. Chairman Finneran made a motion to have,~' the Board write to Town Counsel requesting the status of the Law-N.Andover boundary line be- fore it was perambulated. The Board so voted. .~ ~ · SEPTEMBER 21~ 1970 (continued) ~) ,3 ~MISSILE SITE: A letter from Town Counsel advised the Board that he had engaged the services of a firm, Morse and Martin, in Haverhill, to prepare a plan of the missile site roadway showing the names of the land owners involved, and draw up the various plots for the sum of $98.00 The Beard voted to receive the letter and pay the surveyors from the Contingent Fund. (It is unfortunate that Town Counsel did not know that the Secretary of the Board had procured s~me prior to the missile site meeting held on August 20, 1970.) PIA~NING BD.-TOPICS PROGRAM: A letter was received by the Board from the Planning Board re the Topics program. The Board directed the letter to be referred to Chief Lawlor who has implemented a program and to have the Chief contact the Planning Board with his recommendations. CHARLES ¥~TSES ' INTENT: Attorney Scalise appeared before the B card for his client's Notice of Intent, and after con- ferring with the Board, he was told they would send notice of their final determination on the matter. The firms of J.P. Stevens and Davls & Furber did not reply to the Board's letters or send any recommendations on the matter. The final determination was as follows and it was sent to the Department of Natural Resources and to Attorney Scalise: '~e recommend that permission be granted, provided adequate safeguards against flooding be taken. Cochic- hewick Brook, that runs from the Lake to Merrimack River and is abutted by a number of in- dustries, flows into Sutton's Pond. The manner in which flowage out of Sutton's Pond is controlled is, therefore, of critical importance. Insufficient data was presented for this Board to attempt to determine whether petitioner's plans for controlling this flowage are adequate." W.L. CYR COMPLAINT: Letters from the Board of P~blic Works and Highway Dept. re the Cyr complaint were received by the Board. The Highway Surveyor s~ated that his department was not involved as it was on a state highway (service station, Osgood St. ) that the conditions referred to by Mr. Cyr were caused by a break in the water main and the repairs were made by the town's Public Work's department. The Bd. of Public Works stated that there had been a break in the 12-inch water main on June 17, 1970, that the water main had been shut off as soon as possible and a new section of 12=inch pipe installed on June 18, 1970. They also backfilled the Cyr section of the right of way ~-ith material in the area on June 19, 1970. The letter also stated that at no time during the water main break or ~pairs was the Texaco Station ob- served to be ~rithout customers. Since there are no storm drains~ any heavy rain runs over the hot-top grading into the res~ rooms, covering the crushed smone area in rear of the station. The Board of Selectmen directed that copies of the two letters be sent to Mr. Cyr with a covering letter. NIDDLESEX ST. BY-LAY COMPLAINT: A letter submitted by the Building Inspector, C~ ~.rles Foster, Jr. advised the Board that the letter from the Middlesex residents had be~n written a~ his request to be addressed to his department, not to the Selectmen. The purpose was to clarify their verhal complaints. Be stated that he had corrected one complaint- the practice of the Crawford-Curtis Co. working during late hours. I have been investigating the operations at the site, he said, and have contacted ~r. Curtis re the complaints. However, the decisions on the complaints will· be made after he has contacted To~m Counsel on the matter. The Board requested that Mr. Foster submit a progress report for nex~ week's meeting, Sept. 28, on the results of his conference with Town Counsel. Chief Lawlor was also requested to submit a report o~ the alleged unregistered vehicles parked on the property for a year. BOOSTER CLUB: The Board received an annual invitation mo attend the Booster Club Banquet at Voc School, September ~L and the opening youth league footb~ ~ game. Chairman Finneran will attend. LICENSING C0~SSIONERS The Board voted approval of the request of William Haphey, proprietor of the North Andover Spa (The Blue Fox) on Osgood Street to extend the ~.losing time for Friday, October 23, from 1:00 A.M. to 2:00 A.M. A testimonial for a Westeru Electric Co. retiring Superintendent will be held on this evening. J. Roger Vaillancourt, Sec. to the N. A. Democratic Committee, requested permission to park a trailer, three or four weeks before the Nov. 3, election, on Main Street opposite the Town AliceBUilding'M.
