HomeMy WebLinkAbout1970-11-09 Board of Selectmen Minutes ~ .~ ~ NOVEMBER 9, 1970 The Board of Selectmen held their regular meeting on this date with all members present; Selectmen Kirk and Duffy, Jr., Esq. with Chai:man Finueran presiding. The Warrant and the minutes were approved as submitted. GASOLINE BIDS: The Board received one bid for the annual delivery to town departments from Gulf 0il Co. The Contract was awarded to the G%~lf Oil Co. with the stipulation that Chairman Finneran cheek their bid with the specifications. GAS EXCAVATION: A petition to excavate on Brentwood Circle from the Lawrence Gas Co. was approved. SALON ST. EASEMENTS: James Carlin, County Engineer, sent a letter to the Board enclosing a plan showing the drainage easements required for the reconstruction of Salem Street. Basements will be required from the Trustees of Fuller Farm Trust, John Kozdras~ Phil~ip & Gmild Stoats and the Fellowship Bible Church. Mr. Carlin stated that each of the abova-named sign a release for the easement required and enclosed a release form for each owner. The Board voted to send the plan and releases to Town Counsel for his perusal to' ascertain if said papers were in proper order. SALEM ST. TRAFFIC LIGHT: The 'Board received a letter from District Highway EnJineer, Jacob Berhover, advising them that the Board's request for a flashing,yeLlow traffic light, vicinity of the new Fire Station, was being expedited by his department. 1970 STATE FUNDS: Mr. Berkovee sent a Memorandum of Understanding, in duplicate, re State ~,id Funds for 1970 to repair and mafutain Salem, Johnson and Foster Streets. He requested the Board to sign both copies and return to the Department of Public Works. The amount involved is $23,000. NBTA' CONTRACT: 1969'1970 '" Aletter from General Counsel of the Massachusetts Bay Transportation Au~hbrity stated that ~hrough some inadvertence they had not received the assent for authnrl~zing the agreement from the Town of North Andover.. with the NBTA for continued passenger service from August 14 1969 terminati~ July 31, 1970. They requested another for their records. Selectman's Secretary displayed a letter (copy) dated August 14, 1970 enclosing Assent for August. 1, 1970 terminating July 31, 1971, sent to the NBTA. The 1969 letter of Assent received by the Board on August 18, 1969 was sent to T own Counsel to be expedited. No reply was received. The Board voted to send the 1969-1970 assent to the I~BTA to complete their records. BOARD OF PUBLIC WORKS APPOINTNENT: At 8:00 P.M. theltwo remaining members of the Board of Public Works, Ck-~,~n John J. Willis and Arthur Drummond met with the Board of Selectmen to appoint a replac-m-nt on the Board of Public Works; vacancy created by the resignation of Irving C. Bowes. AttorneY motioned that names of one's choice be written on a piece of paper without nominations from the floor. Selectman Duffy, Jr., made motion to have nominations before voting. Selectman Xirk seconded Mr. Duffy's motion. Atty. Duffy ncminated~ A Oourtney Longton, an electrical engineer at Western Electric (Boll Labs) who, he stated, was very well q,,~lteed and who had been a resident of North Andover since 1958. ' Mr. Longton had submitted an application' s~- ing he was a member of the Capital O~t Lay Committee but would resign same if appointed to the Public Works Board. Arthur Drummond nominated Daniel T. O'Leary, member of theBoard of Appeals. Selectman's Secretary, Alice Letarte, distributed voting slips, collected same, and counted two votes for Mr. Longton, two votes for Mr. O'Ledr~and one blank. Mr. Dully stated that he thought the matter should be tabled until the following week. But Chairman Finneran stated that the purpose of this meeting was to appoint a replacement- and he thought that, in the best interests of the town, the appointment should be expedited at said meeting. Slips were distributed again by the Secretary and the count was three (3) for Mr. O'Leary, two (2) for Mr. Longton. · he Board o~i~cIa~ appointed N~. O'Leary and he ~s sworn in the same hight by Town Cle'.'k. Er. O'Leary was in the town building having attended a~ Board of Appeals meeting. A letter was voted to be sent to Mr. Howss expressing appreciation and thanks of the Board of Selectmen for his long, faithful and dedicated service to the town. T~N CHARTER STUDY COMMITTEE APPOINTMENT: As previously agreed, Harry Turner, Chairman of the above-named c~ttee, submitted names of said committee's choice for appointment to replace the late mamber, Philip Sutcliffe. Names s~bmitte~ were: Richard A. Bum~an, 44 Lisa Iane...~obert E. Nascola, 281 Andover St. and Theodore Peters, 201 Dale St. of North Andaver. Mr. Dully nominated Mr. Peters, the ncminetio~ was seconded by Mr. X~rk and made unanimous by Chairman Finneran. Mr. Peters was a past chairman of the Town's Advisory Board, and is presently Chairman of the Tax Payer's Association. CERTIFICATE OF INCORPERATION: Two certificates from the Secretary of the Co~nonwealth was received for the Community Day Care Center of Zawrence, Inn, and the Nmdover Hockey Association, Inc. Members residing in North Andover were referred to Chief Lawlor for character references. A letter from the Highway Surveyor, N. Nicetta, stated that it was impossible for him to give a final decision on the Davis & Furber water damage complaint until the results of a study, currently being made, is complete.
