TOWN COUNSEL APPO~I~T: 7:00 P.M.
Eight members of the designated Town Counsel appointment Committee convened in the Sslectmen's
Office on this date, at 7:00 P.M. to appoint a Town Counsel for the ensuing year. Arthur P.
Kirk, Chairman of the Board of Selectmen, presided. Dr. Julius Kay, who had stated he would
attend, was absent.
Chairman Kirk opened the meeting with the reading of an application from Atty. John J. Lynch
for the position. Mr. Kirk stated that an "oral" application also had been received from the
present Town Counsel, Arnold H. Salisbury. After considerable discussion on the suggestion of
Atty. Willis t~mt the appointment be postponed for two weeks to allow other applicants to
Mr. Kirk stated that, if the Committee so vobed, it would be the policy in the future of the
Committee to call for candidates who were interested in the Town Counsel position; said
applications to be submitted before the appointment date. However, this year's appointment
of Town Counsel would take place on this date as planned. Atty. Willis made the new policy a
motion, seconded by Atty. Trembly, Jr. The remainder of the members so voted and the new polic~
will go into effect next year.
Chairman Kirk called for nominations. Atty. Trombly~ Jr., nominated Atty. John J. Lynch,
seconded by Atty. Willis4 John Lyons nominated Atty. Salisbury which was seconded by James
er. Chairman Kirk announced that an Austrailian ballot would be used. Secretary, Alice
collected and cou~ted the votes, handing them to Mr. Kirk for announcement. The poll resulted
in'a tie....4 votes for Atty. Salisbury and 4 votes for Atty. Lynch.
With permission from all Committee members present, Mr. Kirk had a call placed to the absent
9th member: Dr. Julius Kay, who'subsequently arrived ten minutes later. After advising Dr. Kay
of the two nominations, tbs ballots were distributed again with the result, announced by Mr.

Atty. Lynchl Atty. Salisbury was notified of his appointment by letter.
Selectmen's Meeting: 7:30 P.M.
The Board of Selectmen held their regular meeting on this date with all members present, Selec~
men~ Joseph A. Guthrie, William B. Puffy, Jr., Esq. with. Chairman Arthur P. Kirk presiding.
SCOUT-O-RAMA:
The Board ackncwledg~an invitation to the Scout-O-Rama '71 to be held on May 15, 1971'on the
Western Electric Grounds. The Board will make every effort to attend.
'ROAD EXCAVATIONS:
The Board approved a petition from the I~wrence Gas Co. to excavate on Johnson and Sutton Hill
to install gas mains. Received, also, and referred to the Police, Highway and Public Works
Depts. was a notice of excavations on Salem and Buxford Streets in connection with Chap. 90
ADVISORY BP.:
James Gordon, Advisory Bd. Chairman, sent a letter to t~e Board e~pressing his thanks and appre-
ciation for the cooperation of the Town Depts. and officials shown the Advisory Board. He
particularly commended Dave ~che, Town Accountant and John Lyons, Town Clerk for their help.
STREET LIGHTING: (Tabled)
Discussion of street lighting for the town was~tabled uhtil~the next meeting. A meet.ing held on
Narch~26'in the~Selectmen's Office with Mass. Electric officials, John Pare and Robert Gove,
and Selectmen Arthur P. -Kirk and Joseph A. Gut.brie on the town.s street lighting resulted in an
agreement that the electrib company would conduct a projected survey of street lighting in North
Andover. Letters were sent to the Planning Boa~d, John Brown Associates,~Highway Dept., Tree
Warden, Police and Fire Chiefs and the Capital Budget Committee requesting their cooperation
the electric company in relation to this survey. A letter of confirmation of the meeting
~ent to Mr. John Pare, Mass. Electric Co.
T. Officials, Committees and their Budget Requirements, the discussion of which was tabled until
April 5th meeting.
RESIGNATION:
Mr. Harry Turner, Chairman of the Town Charter Study Committee submitte~d his resignati6n from~
same. The Board accepted the resignation ~.th regret and voted to sena a letter of thanks ana
appreciation, for the time and effort he extended while a member of the Com~&ttee.

A letter from DiStrict Highway Engineer, Jacob Berkover, advised the Board that his department
had been requested to close the median openings on Rt. 114, from Wilson's Corner to Rt. 125 in
the interests of traffic safety. He requested the Board's opinions on this request. The Board
voted to send copy~of the letter to Chief Lawlor, asking his recommmndations ; Jacob Berkover
was so advised, that as soon as Chief Lawlor's recommendations had been submitted, the
contact Mr. Berkover.
COMPLAINT:
A copy of a letter to the Highway Surveyor concerning street sand removal was received by the
Board. The letter sent by Mrs. Edith Hayes, First Street, was filed for reference.
NO PA~KING REQUEST:
Referred to Chief Lawlor was a"No Parking" request on one side of Fountain Drive(Elderly Housing~
from Stewart Wilson, Executive Director, N. A. Housing Authority. (continued)
Kmiec Complaint:
Letters from Town Counsel and the Highway Surveyor were received by the Board; Town Counsel
stated that,after conferring with the Highway Surveyor and the Planning Board's decision on
the above-named complaint, the Board need not concern itself 'with the outlined problem which
appeared to be a matter for Mr. Kmtec to d~scuss with his own attorney. The Highway SurveYor
stated in his letter that the changes in the discontiuued portion of Chestnut Stree$ was, in
his opinion, an improvement. The Board voted to send copies of said letters to Mr. Kmiec
which were self-explanatory and Voted the file be "closed."
SCHOOL CO~ITTEE APPLICATION:
The Board received an application from William B. Dorfman, 50 Fernview Avenue, for the pend-
ing vacant position on the School Committee. The Board voted to acknowledge and thank ~.
Dorfman for his letter and forward said application to the North Andover School Committee,
Richard Haltmaier, Chairman and Peter V. ~arofeli, S.C. Secretary.
NOTIFICAIONS:
letters were sent to the Board of Heslth, all Town Inspectors, r~questing their cooperation
in sending to the Assessor's Office all notifications when permits, and/or, inspections are
made. This' information is necessary ~6r~the Board of Assessors to re-evaluate real estate~
in North Andover. They were requested to~ furnish this information fox the yekrs 1969-1970
and the first three months in 1971. Building Inspector's office informed Hr. Kirk that the'~
above-named are sent to the Assessor's Office at the end of every month.

On Saturday, March 27, 1971~ Selectmen Kirk, Guthrie and Duffymet with Chief Joseph 'Lawlor
for a discussion on police matters and Selectmen's business. ·
The following matters were voted on:
The Waverly Road Truck Restriction was Votedtobemade permanent. The State Dept. of
Public Works will be so notified. --
J. Berkovertobe sent letter advising of new rates and regulations for Specisl Duty
Police Officers when assigned to read projects with State participation and all outside
det~ s for contractors, dance halls, local carnivals, etc., were unanimously approved.
The following rat~s were approved:
1. An hourly rate of pay ............. $~.O0.per hour.
2. Any officer reporting for work and working less than four (4) hours .... $20.00.
3. Any officer working beyond four (4) hodrs shall be paid for eight (8) hours.
4. Work performed beyond eight ~8) hours shall be paid for at ~he rate of time and
one-half.

The Board voted to authorize~ Sergeant Russell Donnelly to be acting Chief of the Police
Department fromM ay 4 to May ? in the absence of~Chief Joseph'Lawlor.
The Board voted to request Civil Service to set up an examinatior~.for Sergeants in orde~
to establish an eligible list.
