HomeMy WebLinkAbout1976-08-02 Board of Selectmen MinutesJULY 19, 1976 (continued) FI RF~IGHT ERS: Letter to Tewu Counsel for answers to following questions: 1.What are the responsibilities of the Selectmen regarding the Fire Dept? 2.Who is the policy making B card of the Fire Dept.? 3.What are the responsibilities between the Chief Engineer and the other Engineers appointed by the Selectmen? 4.What authority does the Board of Engineers have to direct the Chief Engineer in Fire Department matters? 5.What action may be taken if the Chief Engineer does not follow the directives of the Board of Fire Engineers if, in fact, they have the authority to direct him. VETERANS AGE~C: Letter to be sent to Town Counsel requesting information as to what legislation applies to the appointment of the Veterans Agent, particularly the requirements to appoint an Agent, full time. Also what salary should be paid to a full time Agent and, if the town ~ays the salary, would these funds be reimbursed by. the State government. LICENSING COMmiSSIONERS: Hearing: Application of transfer of P~staurant, Ail Alcoholic license from The ~lllows, Inc., Rober~ P. Regan, Nanager to Cahoots, Inc., ~icherd K. Garick, Nanager at same premises, §I5 Turnpike Street. The only objection the Board stated that an increased traffic hazard would be created if the public had another place to enter and exit on Turnpike Street. The Board voted that a letter were received from Chief Lawlor stating he did not feel there was any additional traffic hazard, the Chairman would be authorized to grant the license. The license cam not be used until the Building Inspector has acknowledged, in writing, that all necessary repairs had been made. On July 26, after conference with Selectmau'MeE~oy, Chairman Guthrie granted said transfer of license and the necessary forms were sent to the Alcoholic Beverages Control Com. for approval. Letarte, Secretary *~ lerk The Board of Selectmen held their regular meeting on this date with two members p~esent; Selectman McEvoy and Chairman Joseph A. Guthrie. Selectman John F. Coady was ill. The warrant an~ minutes were approved as submitted. Conduit locations: Approved: petitions to install conduits on Chestnut Street. APPOINTM~NTS: ..The Selectmen and the members of the Housing Authority appointed Daniel A. Verreault to 'the Housing Authority by a vote of 3 to 2. P~ceived a letter of resignation from John J. Nonterio from the Merrimack Valley ~ Commission. Accepted and letter sent. Gayton 0sgood was appointed in his place by unaimous vote. ' Stumrt Wilson and Dana Fisher were appointed to the Board of Fire Engineers by unaimous vote to be effective immediately. RECEIVED: Letter from Aeronautic Commission re; location of new homes in vicinity of Airport. Trembly will send a written report on building locations. Frank Drainage Proble~ at New Garage: Letter from Highway Surveyor re: drainage problem vicintiy of new garage - Letter to be sent to Town Counsel asking if it is necessary to go to the town for approval and authority to let the Couty Commissioner lay out Lexington and Wayne Streets. New Disposal Site: Plans from Mr. Gelinas are to be brought into the Selectmen this week. Acouisition of Land for Lawrence High School: Letter from Lawrence City Clerk to be given to new Administrative Assistant who is to set up a meeting. Bud Cyr, Highway Surveyor, brought up question of swap of land on Merrimack Niver for an access to the town by boat. To be discussed. Disposal of missile Site Land: Highway and Conservation Departments aware of what is going on at the miss~e site land - New Administrative Assistant to be named a member of Solid Waste Committee as a voting or non- voting member. Veteran' s Agent Appointment: Interviews to be held Wednesday, August 4, iof all applicants and appointment will be voted at nex~ meeting August 16th. Received from Dept. of Housing and Urban Development re: Block Grant - Mr. Minniccucci to act as designee in this area. Received from Board of Public Works, J. John Lyons, Town Clerk, came in to voice his objection to the Selectmen about his office being moved accress the hall. Selectmen state i~ was to his advantage - he acquires an office with his own vault. Fire Chief Daw: Fire Chief Daw csme to the' Selectmen claiming Selectmen's interference with his department. The Selectmen as the Bargaining Board of the town for the Firefighter's Union, has to receive grievances of the firefighters as they are submitted and try to resolve them. ~4hen decisions are made, not agreeable to the chief, he charges interference. Coady, Thomas J. McEvoy with Chairmna Joseph A. Guthrie presiding. The warrant and minutes were approved as submitted. TOWN PICNIC AREA: Board approved request of scout troop to occupy the to~n picnic area Saturday and Sunday, Aug. 21 and 22. Chief Lawlor and Chief Daw to be notified. COMPLAINT - MISSILE SITE: IJohnRLonqueil appeared before the Selectmen complaining o~ the target practice in the Missile ISite area. He stated that horseback riders, bikers and others were in danger of being hit by target shooters who shot indiscriminately, not at Just a target. He went to the Attorney Gen- era2.~vho told him it was the responsibility of the Dept, of Natural Resources and the town. The Board. told him a letter had been s~nt to the Dept. of Natural Resources at the request of Chief Police requesting signs be installed that prohibited the use of firearms in the area. would conform with the town by-laws. Selectmen directed Brian Sullivan, Administrative Asst. to contac~ the Dept. of Natural Resources once agin and report =o the Board at next meeting, Aug. JURORS: Leonard Windle, 116 High St. and Kathleen M. O'Connell were drawn for jury duty, at Sale~, on September 13, 1976. Jeremiah J. Dineen,' 4 Ashland St., was drawn for jury duty, a= Lawrence, on September 20, 1976. PETITIONS: Petitions approyed for Joint polerelocation on Boston St. and to excavate to repair gas main on Prancis Street. All petitions should ~e approved by Cyr, Borgest ~nd Lawlor before Board will approve. PERSONAL DAY GRIEVANCE: Copy of let=er to Firefigb=ers from Chie~ Daw stated that allowance or fundi6g'for Personal Days wasnot allowed by Advisory Board in budget, therefore, they could not be granted. A grievance from a firefighter was received that he had not been paid for a necessary Personal Day. Both letters w~re sent to 'Town Counsel requesting to be advised as to the legality of refusing the IPersonal Days.for the reasons stated ~n Chief Dew's letter. ~MAINTENANCE FOREMAN COST OF LIVING: The Board brought up ~he fact ~hat Walter Ntziak, 'M. Foreman for the town building under the Program was entitled to the 5% cost of living raise that all other ceta workers had received. Ceta Program would not furnish the necessary sum over $10,000. Advisory Board Chairman, present ~t the meeting, did not agree with the Selectmen that the difference should be funded from the Selectmen's expenses. It was finally v6ted to send a letter to Town Counsel explaining the sit- .uation a~d informing him that the Selectmen·had paid a former Administrative Assistant the same way. Mr. Salisbury was asked if the procedure used for the former worker correct and is, in fact, Mr. Niziak entitled to this increase? RECEIVED: Notice of annual roadway hearing, Sept. 23, at Danvers. Brian Sullivan and Bud Cyr will attend. Letter from Ceta Coordinator, Richard J. Wood stating that if a Ceta worker resigned or was fired he could no longer b~ ~eplaced.'
