HomeMy WebLinkAbout1976-10-18 Board of Selectmen Minutes1 84 ocToB 18, 1976 . The Board of Selectmen held their regular meeting on this date with all members present; Selectmen John F. Coady, Thomas J. McEvoy with Chairman Joseph A. ~uthrie presiding. The minutes and warrant were approved as submitted. VOTING: Letter from John Lyons requested confirmation of voting hours on November 2...8 A.M. to 8 p.m. Selectmen Coady and Guthrie approved the hours, Selectman McEvoy abstained from voting. He contended that it was unnecessary to keep polls open as late as 8 p.m. GAS EXCAVATIONS: Petitions approved to excavate to install gas services on 669 Waverly Rd. and 115 Coachmass CON~JITS: Hearing was set for 10/25/76 on petition to install ,,~erground conduits on Pleasant St. Abutters will be so notified. CLATM DAMAGE: Reports received from J. Borgesi, Bud Cyr and Chief Lewlor on claim damage :of Mike & Sons Oil Service.who claims their truck suffered extensive .damage to its 'front end as a result of hitting an open man hole on Mass. Ave. at Narblehead Street on September 10, 1976. The Board voted to refer all reports to Town Counsel to determine whether or not the claim was legitimate. Advisory Land Use%Co~.~,~ttee; Letter from the Merrimack Valley Planning Committee requeSting the Board to appoint a Use Advisory Committee. The Board voted .to appoint the present Local Growth Policy Committee to serve in that capacity, Gayton 0sgood, Chairman. LOCAL GROWTH POLICY COMM. GRANT: Letter from Gayton Osgood advised the Board that the above-named committee had applied for a grant from the Office of State Planning in order to continue the activities of the Committee. Grants will be awarded by Nov. 1 of this year. Copy of Grant was e~losed. CONSERVATION COMNITTEE: Letter from Chair,~n Turan~ advised Board that in order to foster a closer cooperation ~ respensiveness between the Conservation Commission and the Board of Selectmen, the minutes of all Conservation Commission meetings w~ll be forwarded to the Board for their review.' The Board was pleased that an appointed committee had the consideration to wish closer commezication with other Boards. HUD FUNDING APPROVAL: Approval receive~ from the Dept. of Hensi~g & Urban Development of town,s application for Fiscal Year 1976 discretionary ikmding under the Housing a~_ Community Development Act ~f .I~74 in the amount of $36,500. Three forme of Hud-7082 were signed By the Board, two sent to the Boston area office and one to he retained by the Board. Louis Ninicucci was deSignated to follow through on the grants and to set up meeting with Hud representative and · Brian ~l~ivan on the matter. TEINIS COURFS: J. Borgesi advised the Board that the Public Works was in favor of mahing maximum use of the Tenois~ Courts but the q~estion of who will be reSponsible for maintaimance and oparat~omal .' expenseS would have to be determined prior to any decisions being made. Townspeople that had asked for night lighting of the tennis courts had been advised By the Chairman that they could submit an Article in the next annual ToWn Meeting for this purpose. TOWN GARAGE BILLS: Letter from R. Harrington requeSted advice on the pa2me~ut of overdue garage b~] )s. Selectmen requested Brian S,,~]ivan to contact the subCommitte to have meeting to clear up the matter of the overdue ht!)e. POLICE JUF~SDICTION-STATE OWNED PROPERTY: Letter from Town Counsel stated that there wins no question that local Police have full juris. diction to enforce the criminsl laws throughout the terrltyory of the Town, regardless of the legal ownership of ar~v Particular area of ~e~d i.e. missile., site area owned by State. in North Andover. However, local Police officials are not empowered to enforce on state property municipal by-laws of only local application.: Copy of letter sent to John Lonquei!. Letter from the North Andover School Cemmittee contained request that a position be ~l ed from Ceta for a librarian for the school. At the present time, there are no available ~xnds for any new positions according to Ceta officials and the School C~,,,,,:ttee will be so notified. Greater Lawremce Sanitary District sent letter requeSting that North Andever send a check to pay their share of the budget expenses; the first quarterly payment was due. Board requested Brian S. to contact the town treasurer about the matter. OCTOBER 18, 1976 (continued) 185 Inquiry re Santa Claus Parade. Referred to Bill McEvoy. Notice of meeting, Oct. 20, 'Michael Harrington. Notice of Businessmen,s Caucus, Holiday Inn, Oct. 27. Selectmen wi21 attend. Letter urging citizens to vote, "No,, on Referendum question #7 re flat rate (electric) Notice of N. A. Bloodmobile, Dec. 5, Middle School, 10 a.m. to 3:4% p.m. EMILY NURPHY DAY: T'etter received from the Gr. Lewrence Council On Aging advised the Board that ~mily Murphy Social Eirector for the N. A. Council On Aging had been chosen "Senior Citizen Of The Year and Chairman Joseph A. Guthrie was asked to be the main speaker at a dinner in her honor to be held at the Voc School, Nov. k. Selectmen Jack Coady motioned that the Selectmen's Secretary composed a Proclamation in honor of the event. GREENWOOD ASSOCIA2ES: T'etter from Victor L. Harem, Esq. representing Greenwood Associates, stated that certain allegations have been made at a Selectmen's meeting concerning the obligations of Green- wood Associates and its willingness to perform such obligations with regard to Chestrmt Street. He also stated that which was originally agreed to be performed by ~he Associates, they were willing to perform. He suggested a meeting with the Highway Surveyor to resolve the problems. Selectman Ceady offered to meet with Cyr and Bern Osgood at ar~ tine to talk the matter over but Cyr declared he would not change his mind. TOWN SEAL: The corrected town seal was discussed and the Selectmen'authorized Brian Su21i~mn 'bo three town seals to be presented at a Selectmen's Meeting. The eld town seal ~11 be given to the H}storical Society. CETA MANPOWER P~OGRAN: Letters from Ceta Manpower Program contained list of Ceta employees and their te~Lr.=tion dates. Copies w~l~ be sent to a~ department heads. A second letter contained a portion of the Federal Register that applies to Compensation for participants eligible for a pay increase thkt would mean a salary in excess of $10,000. This ruling would enable a Nain- te~-~e Cadet Foreman to receive the5% Cost of living raise given to all the other Ceta workers; the town to pay the difference. The Board sent a request from the Reserve Fund in the amount of $454.00 to pay Walter Niziak his cost of living increase, retro from July l, 1976. MISSILE SITE .W~EOMMENDATION: Letter from Chief lawlor received re complaints of the Missile Site Area and the inabil- ity of State Police, Enforcemen~..Officers from the Dept. Of Natural Resources and the local police to enforce the shooting at this area. Chief recozmmnded that the Missile Site Road be closed off by a permanent barrier at its intersection with 'Salon Street. The Selectmen stated that this would not solve the problem, that school ~nsses had to .. go down that street. A meeting wfll be held on the matter with Chief Iawlor, Brian S,,l~van and Bud Cyr. REQUEST FOR/WO PAT~OT~EN: Chief lawlor requested that the Selectm-n se~d in a requisition and request a certified liet of eligible men for the appointment of two perm~e~ patrol~,~ to serve in the N.AJ Police Dept. Two _~e_~ have recently retired and two patrol ~-n suspended indefinit, ely making the department short on personnel. RECREATZON COUNCIL: The Council would like the Selectmen to recomend places for the Recreatio~ Council to conduct their youth programs. The Board table request for one week observing they should make the recomm*~a~tions and advise the Selectm~. LICENSING COMMISSIONERS: Application received for a Class II license from Charles A. Bucba~u, d/b/a the North Andover Auto Sales, 41 Second St., rear. To be advertised a~ abutters notified of hearing to be held on November l, 1~76, at 8:30 P.M. A/ice N.
