HomeMy WebLinkAbout1971-07-26 Board of Selectmen Minutes ~o~IJULY 26, 1971 O ~The Board of Selectmen held their regular meeting on this date with all members present; Selectmen Joseph A. Guthrie, William B. Dully, Jr. and Chairman Arthur P. Kirk presiding. The minutes and warrant were approved as submitted. NOTICE OF INTENT-FARR: (Conservation Commission of No. Andover rePOrted its approval) A hearing was held on the Notice of Intent of Mr. & Nre. George Farr who intends to dredge and fill land located off Salem Street to provide a larger pond and more efficient control of water through Boston Brook as it is located on his land. Atty. John J. Willis represented Mr. Farr who was present with his wife and abutters who had been notified. DHW Engineer, Mr. DiAngelo, appeared and stated that his department had not been notified. However, Atty. Willis had re- ceipts of certified mail required, one had been sent to the main office of the DI~ in Boston who had neglect'ed to forward a plan and the notice of intent to the District Office in Danvers. After considerable discussion, Mr. DiAngelo was given ~ plan and he stated he would submit a report to the Board in a few days. The only objectio~"to the petition was James Dunn who. was not an abutter. He thought the project would add to drainage of water onto his land and cause flooding in his cellar. Selectman Dully made a. ~tion that the Notice of Intent be approved, but Chairman Kirk stated that he would prefer to table the Board's decision until Mr. D~ngelo'J investigation and report had been received. The Board so moved. On July 30, 1971, Mr. Kirk dictated the following comments in a letter to the Department of Natural Resources: 1. Boston Brook floods periodically when we have heavy rainfall, especially in the Spring and Fall. 2. To our kncwle..dge, there are no down stream communities that use the water from this brook for a public water supply. But we wish to call your attention to the fact that thi~ brook empties into the Ipswich River from which various co~,~nities take water for public .purposes. 3. We understand that it is the intent of the petitioner to use material dredged from this brook for the purpose of f~lltng adjacent land. We assume the leeching characteristics of this soil would be similiar, if not identical, to swamp soil. 4. To our knowledge, there has been no percolation tests to this date. NOTICE OF INTENT-NEW HIGH SCHOOL: .." ~; The Board received the notice of ,intent and?plan-~f"the new high 'school. As a muuiCi~t~~ Notice of Intent does not require a hearing, Chairman Kirk directed that be received and filed. PEtNANE~T PATROLMAN APPOINTNEh'2: ' The Board of Selectmen appointed Maur~ce F. Lynch, Jr. a permanent patrolman in~.the North And- over Police DePartment, effective July 26, 1971. The necessary Civil Service forms, were ex- ecuted and sent to Boston. P~ILI~IAD WARNING SIGNS: The DePartment of Public Utilities sent a letter to the Board requesting warning signs to be installed at the Sutton and North Main Street railroad crossings. The Board voted to send a 'letter. to the NBTA re~~ esting said signs TP~,FFIC SPEED STUDY-E~..-125. ~,. The Board received a letter from J. Rerksver, District Highway Engineer, acknowledging. ~he Board's previous letter requesting traffic safety m~asures On Chicksring Road, Rt. 125.' He stated a speed study survey re the reduction to the present speed posting would be conducted shortly--the request for "No Passing: from And0ver St. on Chickering Road to Dufton Court. is ,being considered with a possible change of the pavement marking, between Peters. St. and Nass; Ave. The entire length of Rt. 125 in ~orth Andov~ is being studied for inclusion into. future "Topics" activity...a consultant is being assigned to the North Andover area who will prePare recommendations based on st,,~es and meetings with officials of North Andover..:the will~.include C~Aef Za~lor's request for the installation of sidewalks and traffic signals.on Chickering Road. The Board voted to receive said letter and to keep the subject matter on current .Agendas. Copies of 'the letter were sent to Senator Rurak, Rep. Hurrell, Chief Lawlor, P..Ga. rofoli, Sup't. of Schools, R. Hal+.m-~er, Oh. School Committee, N. Nicstta and Michael Gia~nusso. ' ' MASS. AVE. TRAFFIC ANENDMENTS: The Board approved amendments to Trafi~c Rules and Regulations submitted hy Secretary on "Obedience to Traffic Control Signals, Sec. 13" ~a "Stop" signs on Mass. Avenue. Also accept- ed was amendment Section lh-"Operation at Under or Overpasses and at Intersections with Islands" for Chapter 90 project on Salem and Boxford Streets. Amendments also approved by Chief Lawlor. Three signed copies of each amendment were executed by the Board, attested by Town Clerk and sent to K. Erskorian, Traffic Engineer, Mass. Dept. of Public Works. HIGHWAY CONSTRUCTION NEETING: ?~. · ~& notice fr~m J. Bor~ver, DP~ District Engineer, advised theBoard of a meeting on the ahove- captioned subject. Chairman Kirk stated that he would be u~able to attend but hoped 'one of the Board could go. Copies of the notice w~re sent to Public Works, Hig~ay Dept. ~ Chief Law- lot and the Conservation Commission. Maetiug w~l be held Wednesday, JulY 28, 8 P.M.,Da~vers. CERTIFICATE OF INCORPO~ATION: A member of an occult corporation, Stanly Matzes, Union Street, was referred to Chief lawlor for character reference. POLICE LEGAL ADVISOR: Selectman William B. Duffy, Jr., Esq. reported on the Monday morning meeting in Andover Town Clerk's office re a police legal advisor for both towns. Mr. Duffy advised the Board that the committee voted to ask for applicants to the positions letters were being circulated to all law schools and lawyer's offices, and the POsition is being publicly advertised in the papers. l 71 (continced 383' Police legal advisor must have one year's experience in criminal practice among other qualifi- cations. Mr. Duffy stated that Joseph Bosetti should be sent a letter of thanks and apprecia- tion for his actions and ~efforts ca this matter. Selectman Guthrie made a motion that Mr. Duffy send an appropriat~ letter of thanks from his office and that the Board ratify Duffy's action taken at the Monday Morning meeting in Andover on July 26. The Board s~ voted. S~' LIGHT SURVEYS: ~ Street light surveys,received from Mass. Electric, vicinity of 90 Putnam Rd. and971,998 Salem Street, were filed with other surveys until projected survey for whole town is received. MASS. AVE. ACCEPTANCE-OFFICIAL NOTICE: Official Notice received from the State 3)epartment re the town's acceptance of Mass~ Ave. was referred to Town Counsel for verification. YOUTH COMMISSION: The Board met with a representative from the State Youth Commission, George Cashman, William McEvoy and Michael Thompson. Mr. Cashman answered questions from the Board re programs in this field of other towns and cities. Mr. Cashman, who was pleased that the town of North Andover was interested in a proposed Youth Commission, advised theBoard that a proposal and a budget must be submitted by the Town to the State Commission by September 1, 1971. After considerable discussion, the Board appointed Selectman Joseph A. Guthrie, William B. McEvoy, Michael and Bobert Licare acting as a Sub-Committee to formulate plans for a North Andover Youth Comm- ission. The primary purpose of the proposed Commission is to establish, extend, and services to the youth of the town; to prevent, control and assist them in any problems which may arise and to promote programs for all youth, not only delinquent, to interest and instill a sense of responsibility and pride in competition and good behaviour as a Junion Adult. Funds, raised o2 appropriated by the town for this project will be matehed by the State. A meeting will be held on Wednesday, July 28, at 8:00 P.M. with State Youth representatives, George Cash- man, David Crawley and the Sub-Committee. Selectman Guthrie will send letters of the proposed commission to Senator Rurak and Representative Hurrell requesting any aid they can give. OLD WELFARE BILIS-AHTIOLE: George Wilson, Director of Welfare, submitted an Article for payment of old, accumulated bills for the next Town Meeting. The Board directed that the Article be referred to Town Coun- sel for his perussl and to file said Article until the next town meeting is held. NOTICES RECEIveD: A notice from Land Court. Request from Personnel Board for office Space. Selectman Guthrie will look into the matter. Copy of resignation of D. Griffin, as Chairman of the Personnel Board. Request for registration of the Board for the AnnuAl Town Rooting(State) Oct. 8-9-10. Letter from County Commissioners with notice of decrease in Town's 1971 County State Tax. (The decrease amounted to $5439.30 - the Board received notice with pleasure. ) Thank you note to Chairman Kirk from D. Parent, Director of Community Center, for his contribu- tion to the Community Center. Letter from State DPW re Federal Funds for Highway Safety promotion. Copies sent to Chief Lawlor and Highway Surveyor. Letter from State Group Insurance Commission re legislation passed amondinc G.L. Chap.32B. Copies sent to Town Acct., Town Treasurer, Personnel Bal., Ted NcAloon, R. Lafond and Town Ins. Group. A notation advised them that explantory files could be read iu Seiectmen's Office. Report on uncollected taxes from David Roche. Voc School minutes. Study Report No. 1-Legislatiqn on Planning and Zoning from Dept. of Community Affairs. Letter from Bd. of Education re Police Higher Education Incentive Pay Program. Referred, EDA program appointees-A. Kirk will confer with John Monteiro on matter, lor. LICENSING CONNISSIOI~2~S: A hearing was held on the application for the transfer~ of the Restaurant, Ail Alcoholic of Lynch's Restaurant, Inc., John J. Lynch, Mgr. to Lucille's 125, Inc., Lucille Fiorensa, Mgr. at same address, 80 Chickering Road. The hearing was duly advertised and x~ affirmative char- acter references on the corporation's officers submitted by Chief Lawlor resulted in approval of the tranfer of license by the Board. The application and Board's approval will be sent to ABC for their approval. Auctioneer s licenses .w~.s granted by the Boa.rd to Frank B. Greens~ Jr. for one day, August 7, to auction off estate totems from the Ruth Whittiea homestead, 933 Gr. Pond Rd. and a one year renewal license to George Kittrel, 69 Fernview Ave. The Board voted permission to Cyr Associates to use Town Picnic area subject to further c~rif- ication of use of profits. The outing will be held Sept. 11 and 12. Selectman Guthrie stated that the Board should set a definite policy procedure for this type of activity. STE~ET LIGHT: Selectman Duffy requested Secretary to notify electric company that a street light burns day and night opposite Atty. Tl~mas Burns' residence on 675 Great Pond Road.
