The Board voted %o request a survey from the electric company.- The ~ass. Electric Co. sent a survey for street lighting vicinity of 39 Sutton Place, home ofMrs. Martha Hananian. ~he survey was'tabled until street lighting budget amount was de- termined. The Board, upon motion of Mr. Dully, voted to send a letter ~o J. Pare of the electric company requesting his presence, or a representative of the company, to appear before the Board to discuss the installation of underground fed aluminum poles as compared to overhead street lighting and any problems that may arise. OPEN TBENCH COMPLAINT: The Board received a letter from Walter F. Soule, 35 Fernview Avenue concerning an open trench that was dug for utility service to a building lot behind his house. He was cc that small children playing always in the vicinity would fall in and be injUred. Two dogs have already been rescued from the trench; the trench is 300 ft. long and 5 ft. deep. The Board referred the problem to Jack Erle for investigation and correction. N. A. HOUSING AUTHORITY APPOINTMENT: The B card of-Selecmmen received a communication from the Dept. of Community Affairs re the appointment of Alphonse R. Brien, 80 Penbroke .Rd., North Andover to the position of State Member of the No.th Andover Housing Authority; term mo expire on July 27, 1976. Tho Board voted to send Mr. Brien a letter of congratulations and to offex~ their assistance if required during his term of office. Jones, Regional Director of General Services Administration re:'a ~ segment of the surplus access road North Andover is interested in acquiring advised the Board that his department would soon submit their disposal recommendations to their Washington 'Office for review. When a final decision has been made, the Board ~ill be ..... ::so 'nctif~ed'. ANTI-POVERTY PROGRAM: A letter from Charles L. Lo Piano, Asst. 'Ex. Director of the Greater Lawrence Community Action 'Council expressed the council's concern on the~futUre continuance of their anti- p6ve~ty program efforts in Groaner Lawrence because of President Nixon's ve%o of the . $6:~itlion extension of the Economic OpportUnity Act and its programs. He requested' the Board to write a letter of support to Congressman Morse and Harrington and' Senators Brooks and Kennedy requesting the extension of the E0A and the continuance 'of the 0A0 anti-poverty efforts in'Gr, lawrence. The Board vote to acknowledge the letter and invite Mr. LoPianc, or a'representative from his office, to attend A meeting on any Nonday night convenient to him to discuss the program as it exists nc~ 'and the benefits derived by the Gr. Lawrence communities. THANK' YOU LETTER- CYR ASSOCIATES: A letter.from the Cyr Associate's contained their thanks and appreciation for the use of the ~orth Andover Town Forest for their annual Oyr Assoicate Outing. They realized $265. profit at the outing; spent $420.00 on the Santa Claus parade; and spent another $3%.00 to host-a lunche~m'~or the Elderly at their Christmas party at the Oo~nunity Center. The letter, written' by Mrs. Nancy A. Stevenson, Secretary of Cyr Associates, contained her personal thanks, as well. The Board received' the letter and remarked that the Town Forest was available to all groups in town providing they meet the requirements of cleaning up the a~ea after their events. TERMINAL LEAVE REPLIES: (DUFFY, CHAMBERLIN, DONOVAN) Letters received from the Board of Public Works and the Highway Dept. in answer to the Board' inquiries as to what action had been taken by both departments inregard to the payment of terminal leave pay due to Edward J. Donovan, former Highway employee and'Francis former Public Works employee. Mr. Nicetta stated that he would not process payment for are no funds specified for this purpose. John J. Willis, Chairman of the Board of Public Works, stated their Board would follow the recommendation of Town Counsel(enclosed in copy of letter attached) and not take any action on any terminal leave request until the problem of payment has been resolved by a court. (Former Supt. of Public Works, W.B.Duffy, Sr. intends to initiate legal 'proceedings for a determination of his right to terminal pay which Town Accountant refuses to pay until a cour~ has %old him that such payments should be made. ) ~00 JANUARY 17, 1972. (continued) REPOE~S RECEIVED: The Board received the annual reports of the Civic Holiday Celebration Committee and the Gas Inspector, Mitchell P. Boo,man. Also notices cf several meetings were received. The two annual reports were referred to the Town Report Committee and the meeting notices were to be posted on the bulletin board. LICENSING COMMISSIONERS: The Board approved the renewal of the Sunday and Operation license of NcIay's Florist & Garden Center, Turnpike Street. The confer~ ~ce on the Class II license applied for by both Farhas and Fiori was ~abled until next week at the request of both parties. Alice M. Letarte, Secretary ~~Clerk JANUARY ~4, 1972 Th~ Board of Selectmen held their regular meeting on this date with all members present; Selectmen Joseph A. Guthrie, William B. Dully, Jr. with Chairman Arthur P. Kirk presiding. The warrant and minutes were approved as submitted. _ ~ HEARING: POLE & WIRE LOCATIONS: A petition for a pole and wire location on Old Clark Street wa~ approved. A petition for the transfer of location of 2 poles on Glencrest Drive was approved. JAi~EE CARNIVAL PERMIT: 'The Board gave the Jaycees their unanimous approval to hold a carnival at Grogan's Play- ground in the month of April. They Advised the Jay~ees that they would have to go ~o the Department of Public Works to get an official permit as they had jurisdictioa over all the playgrounds. COUNTY EASEMENT -FARR: A letter from James Carlin, County Engineer, enclosed a print showing proposed drainage : easemen~ on Salem Street which is required for the continuation of the reconstruction of Salem Street. T~e easement is across land owned by George and Wanda Purr who have signed a release granting this easement at ns cost to the town or county. Mr. Carlin stated ~that he would meet~with the Board is there were any questions. The Board would like to know if this easement is in connection with this year's reconstruction of Salem StreetJ (At a later date, a call made ~o Mr. Carlin by the SecreZary of the Board, the easement was explained. Mr. Carlin stated that he had procured this easement from Mr. Farr without any~.cost prior to the reconstruction in that portio~ of Salem Street for 'the following . reason: Mr. Farr may eventually sell his land to individual builders at which time to acquire easements would cost a lot of money. So, he stated it was much more feasible and practical to take the easement on the land no~ without 6ost, courtesy of Mr. Farr. ) ZONING AR2ICLES: A letter from the Planning ~oard Chairman, A~y. Charles W..Trombly, Jr., .stated that the January 22 deadline for inclusion of the zoning articles in the Town Warrant was not enough time. He stated that the Planning Board WOuld like to' spo~&r ~a~Sp?cial T°wn. Meeting for these articles when they are completed. STREET LIGPE REQUEST: Mr.. ~ichard Houde, 656 Foster Street, requested a street light to be installed On the~ curve of the road just before his residence. The Board voted to' have ~a' survey made. JOHN PARE '~TING: John Pare, Mass. Electric Co. commercial sales representative telephoned Board's Secretary that he would meet with the Board on January 31, at 7:30 P.M. to discuss aluminum pole installations · TRENCH CONPIAINT: A report from Jack Erle'on the problem of a deep-open trench left a~ 70 P~leigh Tavern Lane advised the Board that the Building Inspector had already inv~estigated the matter and found that the construction company responsible, for it was in the stages of bank- ruptcy. The Board voted to send a letter to the Building Inspector requesting Mr. Foster to take whatever action he deemed necessary to correct the situation and any other sit- uations that may arise in the future which constituted a danger to the townspeople and that he had their unanimous support in any action he took. They also requested a written report on the problem from Mr. Foster. A copy of the Board's letter to Building Inspector was sent to Nr. Walter BOule, complainant. DRUG WALK-A-THON: Represemt~tives from the Gr. Lawrence Community Drug Council Auxiliary, a group of con- cerned citizens under the auspices of the Gr. Lawrence Community Drug Gour~il appeared be- fore the Hoard requesting permission to have a walk-a-thon through North Andover and other Gr. Lawrence Communities. It would be entitled, "Foot the Bill Against Drug Abuse." The subJec~and routes was presented by Emily Hoffman, 2 Union St., North Andover, Mass. The Board of Selectmen verbally endorsed the proposed event but requested more details on the matter after which Chief Lawlor would have to approved the route of the walk-a-thon.
